Review: When I walked into the Chiropractor office I expressively verbally refused any type of contract to sign, they offered me a care credit which I refused and asked if I could pay as go. We agreed for a price per month to taken out of my account. As of 3/29/2016 I had to cancel going to the office for financial reasons, I was under the impression that what I signed was a agreement to pay as you go, they called me demanding 600 dollars for 5 weeks of care, I paid for the first month $150.00. Now they want 600 because according to them I broke a contract I never signed. They are now threating collections and I offered various solutions and they would not accept any solution at all other then the 600 dollars by 4/1 or they would send me to collections. I feel like I was completely taken advantage of. He does free chiro care for my wife but will not work with me for nothing at all.Desired Settlement: I offered to pay for $150.00 dollars for 2.5 weeks of care between 3/1/2016 thru 3/21/2016. They would not agree. I understand I had services performed which I am willing to pay for under the agreement we had for monthly care which is 150.00.

In response to Mr. [redacted]’s complaint, in fact Dr. [redacted] did agree that he may pay our office through an auto-debit system vs. care credit per Mr. [redacted]’s request. Mr. [redacted] did sign a contract stating that he would receive a specific amount of adjustments based on medical necessity and the payments would be spread out over a course of 18 months making it affordable for him to pay. Nowhere does it state that he only had to pay 150 for a month of care. Care is provided upfront and any services rendered would be owed. Our contract clearly states, under Discontinuation ” Retail fees will be calculated without discounts and pro-rated on a per visit basis. You do not simply owe your monthly fee.” Retail Fees equal $75 per visit. (Example: if you have had 10 visits at $75 each when care is discontinued, you will owe $750.00).

Review: I went in and had digital xray's taken and paid for those xrays. When I called today 08/14/2013 to request that the xray's be copied onto a CD they informed me it would be $15.00 fee, which I agreed to pay, but they stated I would have to wait to get my disk for 24 hours, and then they would let me know when it was ready. I explained that I would pay when I received the disk and not pay first and wait for them. They refused and stated they would only make a copy after I paid and then let me know when they get it done. I may be wrong, and I believe that I am intitaled to the product when I pay for it unless I am requesting it through the mail.

It is unfortunate that [redacted] is disgruntled with our office policy. This policy was implemented due to past experiences resulting in loss of income. My front desk receptionist advised the patient of our policy. When [redacted] requested an exception she told him that she would need to talk to her office manager and get back with him. When it was brought to my attention I agreed to make an exception by accepting a verbal request for X-rays and take a credit card over the phone for payment and that when the records were ready he could pick up receipt and records within 24 hrs.

Since I needed the X-rays for my doctor to help determine how serious my injury is, I went to Dr. [redacted]'s office with a request from Dr. Office, they took it and did not charge me anything to send to my doctor. Though I believe they have poor practices that are not in the best interest of their clients, I believe this case has been settled, and you can close your file. Thank you for your help.

I would also like to post the actual state law requirements for a copy of xrays. As you will see our 24 hr turnaround is more than appropriate.

California Health & Safety Code Section 123100

Copies of x-rays or tracings from electrocardiography, electroencephalography, or electromyography do not have to be provided to the patient or patient's representative if the originals are transmitted to another health care provider upon written request of the patient and within 15 days of receipt of the request. A patient may request to purchase copies of his or her x-rays or tracings. All reasonable costs, not exceeding actual costs, may be charged to the patient or patient's representative.
