They spoke with us after we called and only after we were denied several responses to email inquiries Perhaps we could have even avoided this awkward exchange They left us in quite a bind after we had applied and been accepted with no further communications I don't feel that refunding the application fees is unreasonable considering the financial and residential distress in which they left us Complaint: [redacted] I am rejecting this response because: Sincerely, [redacted] ***

This entire situation would be resolved if the [redacted] 's had only read their lease, to which they signed and agreedIt would also have helped if he would talk to me on the phone instead of hanging up on me Or if he would talk when he comes into the office instead of punching and cracking my desk in a show of intimidation He was not robbed His lease clearly states that when a tenant desires to not uphold their commitment to the lease and terminate early, they have to give days notice and pay a fee equal to months of rent, among other thingsThey paid that fee, but then never paid their rent for the days Hence they accrued late fees, and a notice fee for non payment of rentHe has now stalked me and my family online, and sent multiple threats via text and email We will not be working with him, we will be sticking to our guns against The [redacted] 's

I spoke to Mr. [redacted], and explained the situation.  They applied for a house and we processed their applications.  As is the standard in the property management industry, application charges are non refundable.  We're happy to send them the credit reports as proof of having used that...

money for it's intended purpose.  Also the listing was not misrepresented.  We had that house for rent, and we still have that house for rent.  The misrepresentation that he is suggesting is in the fact that the terms of the rental were that the home is also for sale, and would be for sale for not more than 60 days from the time he applied, not the time he moved in. If it sold, the new owner would have to abide by the current lease in place, were there one signed by him and his party.  If it did not sell in the prescribed 60 days, it would be taken off the market and not sold until the current lease was ended.  They declined the offer to rent, and will therefore not be refunded since the money was used for it's intended purpose, and they withdrew their applications, we did not decline them.

They paid that fee, but then never paid their rent for the 30 days.  Hence they accrued late fees, and a notice fee for non payment of rent. I am rejecting this response because:It is becoming more and more clear that you are just going to hide behind your way to get around the system and taking advantage of people $25 bucks at a time,  Congratulations.  Good for you.  Ignore your customers until they give up and blame it all on them.  Way to go.  We know what really happened.  You know what really happened.  The best we can hope for now is maybe someone else stumbling across this report or one of the others filed against you with copies of this conversation and the emails (before they stopped completely) about how you accepted our applications for a RENTAL and NOT mentioning about the house being up for sale, before they try to do business with you.

[redacted] hired our company to manage his rental home.  The renters were properly vetted and checked thru the Transunion background and credit check system.  The renters lived there for just over 6 months before they stopped paying, and we did have to evict them. The carpets and appliances...

were nowhere near new or great condition when the renters moved in, in fact we have noted that "owner ([redacted]) advised us that freezer shelves are broken, and dishwasher stinks when not used".  The carpet was also not new to [redacted] when he moved into the property, let alone when the tenants did.  The repairs were done by a contractor that we hired who is insured.  If [redacted] has issues with the work completed, he can take them up with the contractor. We didn't do the work, we simply managed it.  There was a vent cover on the dryer vent outside, it is no longer there, but was to begin with.  The light also worked, multiple people can vouch for that. The fact that there is no cover now, and the light doesn't work, doesn't mean the work was not completed correctly.  The rental house is an investment.  As all investments go, there is risk and reward.  [redacted] had 6 months of reward and now has some risk.  As the owner of the investment it is his responsibility to pay for any and all repairs to maintain them.  If they are due to tenant neglect, he can go after the tenants for the money, but the management contract specifically prohibits the Management company to be moniterily responsible for his investment.  The tenants actions are in no way the management company's fault, neither are they [redacted]'s fault.  [redacted] terminated his contract before the first 12 months were up, and according to the contract, that carries a $500  fee.  We did not charge a "final management fee", we charge a management fee for each month that there is a tenant in the home, regardless of how many days of the month the tenant lived there.  They were in the home in sept, so we charged the management fee for that month, which happened to be the final charge since [redacted] terminated his contract.  We already refund [redacted] the tenant's security deposit and his $200 reserve fee, minus any outstanding charges to his account, as per the contract terms.

As previously described, and as he even just suggested, they were accepted and then decided not to move in.  Had they decided to move in, they could've been living there now.  Any residential distress was self imposed as we accepted them, then they declined to move forward with the lease and the move in.
