Rhodes Driving School is the involved training facility National Traffic Safety Institute of Texas, Inc (NTSI) is the Course Provider for this program, and is responsible for all certificates of completion, including any and all duplicate certificatesThe Instructor discussed with complainant on November 3, the process for which a duplicate document may be requested via the Course Provider
Texas law: All driver safety forms must be submitted to provider within days of class Provider has twenty-one (21) days from the date of the class to process, print and mail certificate to student-provided address
Rhodes Driver Safety Program: Ticket dismissal class documents are mailed to the Course Provider the next business day after class is completedThe Course Provider is required to mail certificate to the student's mailing address within daysAs per student-provided court documents, the student is required to submit the received certificate to the applicable court for citation dismissal consideration

[redacted] This letter is written in response to your letter dated Monday, May 4, 2015 regarding a complaint received by your office from Mr [redacted]. This letter was received by my office on Wednesday, 20 May 2015. Complaint (verbatim): I stopped by the location and paid $50 on 4/20/15. This was a deposit for my son to start driving. I was advised that I needed to pay $335 before the 4/27/15, so my son could start. I was advised that if my son did not start or attended any classes I could receive a full refund. I asked for a copy of the contract but was informed the copier was broke and I could not receive one. On the 24th, I called to pay the balance, but they were closed for Fiesta. I called on the 25th and spoke to [redacted], the director. I paid $335 by phone on my debit card. This was processed the same day and cleared my bank on the 27th. Unfortunately, my son was promoted to varsity on the 27" and informed practices would not end until 7 or after. I emailed the intent to cancel, because I could not reach the school by phone. Finally, I was able to reach someone and they stated this was okay. They stated to come by and complete refund paperwork. Upon arriving, the director stated I did not need to complete anything. When I asked for a copy of the contract she stated she would have to mail it to me. Then, she spent 20 minutes trying to convince me to keep my son in the class. Finally, she stopped pressuring me and stated she could not reverse the charge to my card, because they not capable of doing this. This was odd to me. She stated the accountant would bring by a check and she would call me in a couple of days. After I did not hear, from her I called her. No contact was made, so I sent an email. Still no contact, so I advised her I was going to have my attorney contact her to revised. She then emailed me and stated she did not appreciate the threat of an attorney and that! was going to have to wait 30 days to get my refund. I feel helpless at this point and plan to let my attorney know tomorrow. I feel this is a theft of service. We did not attend, paid in full, never received a contract or receipt of the $335.00 Gust my bank statement) and were told I could receive a refund of 4/29/15. Can you please help me? The total I paid was $385.00. Response: Rhodes Driving School staff discussed with complainant the contract refund policy as listed in the Rhodes Driving School Teen Driver Education Enrollment Contract. This review was conducted with the complainant in writing (contract and email), over the telephone, and in person on multiple occasions. Therefore, the email dated 4/30/15 to complainant stated any additional communiqué at his behest would by accepted from his attorney, as he had already suggested this mode several times and continued interaction with office staff was no longer desirable or productive. Although by law, $69.25 is allowed as a refund deductible ($50 fee + $19.75 credit card fee), his refund was submitted for the full amount ($385) on 4/28/15 as a goodwill gesture. will be picked up from school (we had a problem ;nth that as well) We were told afier we signed up for scheduling our drives online, we would receive a phone calls to help with scheduling the drives. (TI-IA T NEVER HAPPENED) From the beginning we've been diligently tryin g to schedule drives. We never once waited on anyone to call us. The software, for scheduling drives are not even compatible with all technological devices. So we had to call to schedule. Also, it stoles that we if- we need to cancel a drive, then the school needs a 24 hour notice. Since we weren't able to schedule online, this meant we had to call to cancel the drive. Lets look at the school operating times. Noon -7pm. And there's no one to answer to the phones between the hours of 3-4pm. So now this student's family are going to have to incur a cancellation penalo, for not being able to cancel a drive, iftbeir technological device aren't compatible with the software. There isn't a answering service or any office staff available before noon. My husband drove me to the office and I spoke to [redacted] (irrelevant inkrmation). She refused to help us. I also brought up to her one incident where my son came in fora schedule drive, but when he arrived found out that he was merely observing; Which was fine, but he never received the credit hours for the observation. I Has informed that there was an issue with an employee and a scheduling conflict Hiller nay, my son showed up. [redacted] said that the burden of proof was on my son due to change of personnel She needed a name oldie driver/instructor, and that she would get back to us. My son did provide the info to [redacted]. When I asked again if she would help us with scheduling, she simply stated we needed to continue to try and schedule online. To this day our son has not received the credit towards his hours. Also, may I add that prior to signing up for the online scheduling, which is an additional $12.00 on top of the fee, the school refused to schedule us for any drives. So essentially I was 'breed to pay an a fee just to have access to schedule a drive. (irrelemnt inktmation) It almost seems like they Haat us to go over a year. So that we have to pay another fee to continue. Response: 1.      This student was originally signed up for the Basic Package on April 6, 2015 (Attachment A). Student was upgt        tided to the Premiere Package on April 22, 2015 (Attachment B). Class began April 13, 2015. School shuttling is not part of the Basic Package as explained to the parent during contract signing, therefore, the student was not scheduled for pick-up at their designated high school prior to their upgrade. 2.      Our regular business hours are noon - 7pm as published in our brochure (Attachment C), and we are closed for lunch 3-4pm. The answering machine is on around the clock, 7 days a week. 3.      Parents and students are instructed, once the permit has been obtained, they should call the office to schedule a drive and should plan on driving once per month. Any and all changes to pre-scheduled drives must be completed by the student/parent online (Attachment A, D, E). 4.      Parents are informed any drive not canceled with more than 24 hours will incur a $40 no show/late cancellation fee (Attachment A, D, E). Parents are required 5-6 hours of practice with their student driver before the next drive is scheduled as parents are required by law to complete a minimum of 30 practice hours with their student. To date, no practice hours have been entered for this student (Attachment F). 5.      I met with this parent on Aug 12, 2015, and scheduled the student to drive the next day. During this meeting, parent stated student came in previously and was not on the schedule to drive that day. This happens occasionally when students fail to check the online calendar and assume they know their drive is scheduled. Our policy allows students to join a driving session if there is room in the vehicle in order to complete observation hours when this occurs. Given that the student was not on the schedule, the date the student came in is needed in order to verify the amount of time the student observed. It is unlawful for our school to give credit without verification. Research has shown all time driven by student was credited accurately (Attachment G). 6.      Parent was informed at contract signing and again at the time the TEA-964 certificate was issued the next step was the creation of their account on the Schedule2Drive online calendar (Attachment A). All student drives are tracked and scheduled via that website tool. This tool is functional on all web-enabled devices. 7.      Students are not charged for an extension if they find 12 months is not enough time to schedule their 7 sessions and they have been diligent in their efforts to complete within their contract period. In conclusion, the legal contract for this student is valid April 13, 2015 - April 13, 2016. The student is scheduled for completion of the Rhodes Driving School Driver Education Program on January 14, 2016 (Attachment G). This letter is written in response to your letter dated Monday, September 8, 2014 regarding a complaint received by your office from Ms [redacted].
 
Complaint:
 
Rhodes Driving School is not responsive to scheduling times for my daughter.  The way they are scheduling her appointments it will take until the end of the year to meet the hour requirements to qualify for a driving test.
 
Response:
 
Rhodes Driving School staff has discussed with complainant the state requirements and how those requirements define our school program.
 
Texas law:  State law requires teens under the age of 18 hold their learner’s permit for a minimum of 6 months.  Driver education students are required to complete 14 hours of driving with an instructor, and a minimum 30 hours of driving with a parent. The parent was explained (at contract signing) the student would drive an average of once per month (1-2 hours per session) during the initial 6 months required by law.  This allows the parent to drive with the student a minimum of 5-6 hours between instructor sessions to complete the required 30 practice hours.
 
Rhodes In-Car Program: The required Form DE-964 is issued to the student once they have passed the written DMV test.  This form is submitted to the DMV for a state issued learner’s permit.  The student is then required to turn in an Availability Form and create an account on the online calendar, Schedule2Drive.com, for scheduling purposes.
 
The following is supported by the included Attachments (A-G):
The online student message board reminds students the DE-964 is not a learner’s permit (Attachment A).
The online registration for driving sessions was completed on 08/13/14 (Attachment B). 
Two sessions, 2 days apart, were scheduled in August during a telephone session (Attachment C).  The typical scheduling queue is 2-4 weeks.
Student arrived for both August 19th and August 21st drives with the DE-964 form (Attachment D and E).  Several more telephone sessions were held with Complainant after the first failed session, including a conference call with the instructor involved.  Complainant insisted she was told the DE-964 was adequate. It is unlawful to drive a student without a legal license.
Permit issue date is listed as 08/22/14 (Attachment F).
The first no-show fee was waived as a courtesy (Attachment B).
Complainant came into the office the on September 4, 2014. Her visit was friendly and without incident.  Our staff scheduled her drives for the months of September and October (Attachment C).
 
Student is currently on target to complete the driving hours within the initial 6 months as expected (February 2015). To date, the parent log (Attachment G) shows no practice hours have been completed and listed as required.
 
We will continue to work the program with Ms. [redacted] toward the completion of the state requirements within the timeframe listed above.
