Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Homeowner did not breach contract and paid for all agreed upon payments with the exception of Oct13th payment which the RHR Contractor agreed could be paid on Oct16th due to a HELOC that was in the process of being approved for Oct16th When homeowner moved into the condo residence on Oct15th, the homeowner saw that the pebbles put down in the shower were not the pebbles that were originally shown to the Homeowner by RHR Designs and Renovations The morning of Oct16th when the Contractor showed up, Homeowner discussed how the pebbles weren't the ones originally shown and that there needed to be a remedy to satisfy the homeowner prior to the Oct16th check of $5,to be paid to RHR Contractor left and the next day Tuesday Morning told the Homeowner that "You will be happy, I fixed the pebbles." When Homeowner saw the same pebbles she let the contractor RHR know that that they were not the orginal pebbles since the colors were not the same as the sample shown and once again told the contractor to please have the person who installed the pebbles meet with me so we could see the original swatch of shower pebbles to compare and then have a plan on removing and replacing with pebbles that would match the backsplash in the shower Since the shower pebbles were paid for by the homeowner and they were NOT the pebbles originally shown, the Homeowner expressed concern that the pebbles were selected without her knowledge and placed on the shower floor and that the Contractor was responsible for showing the original pebbles and how it would match the pebble shower floor RHR Contractor didn't respond when Homeowner said, payment of $34, was already given to the Contractor and homeowner wanted the "pebble floor" situation resolved prior to giving the $5,payment due for Oct16th Homeowner was shocked when returned to home to find materials purchased by checks that were previously given to RHR were gone In addition the Contractor RHR left Unfinished living room, dining room floor, lighting installation, baseboards Abandoned the remodel without meeting with the Homeowner at the pm time that the RHR Contractor's wife [redacted] Noel said she would meet with the Homeowner to discuss the situation(per phone conversation [redacted] stated we can meet at after I asked her to please calm down and not curse me - she said "F you - I have a great lawyer and I will see you in Court." Homeowner was also locked out of her home from till 5:pm when Homeowner's friend who had a key let her in RHR Contractor took the key and the Homeowner was locked out for hour and minuntil friend who had the key opened the door Letter was given to the Homeowner at 5:and RHR was invited to enter the condo to discuss RHR Contractors said to read the letter and to call Wednesday morning Oct19th Several attempted phone calls and texts were made to RHR on the morning of Oct19th and RHR did not return phone call or texts to discuss how to resolve the remodeling issue.Homeowner was aware that only the shower and toilets would be installed for her move in date Oct15th and was surprised that contractor didn't install a shower head or faucet knob to turn on the water in the shower Homeowner wrote letters sent certified mail on Oct19th and Oct20th to contractor RHR to see if the issue could be resolved and as of the morning of Oct29th Homeowner went to the Post office to see if the Certified mail was received by RHR Post office traced mail delivery and RHR did not pick up the Certified mail as documented by post office and Homeowner receipts Continued efforts are being made by the Homeowner to resolve the issue so that the remodel can be completed by RHR however, RHR has not responded in a positive remedy manner and has abandoned the remodel taking paid for materials and leaving the condo without sinks, countertop, electrical pendant lighting, unfinished baseboard, desk, countertops, vanities, backsplash, and kitchen cabinets undone..glass is missing from one of the cabinets and siding has not been installed on the countertop In addition paid for paint was taken by RHR Shutters were not installed for downstairs and upstairs windows as well as quartz counter top and backsplash for kitchen and desk.Homeowner tried to resolve what RHR calls a breach of contract with letters, phone calls, texts No response was given only threat of Lawyer action and statement by [redacted] this morning, Oct30th that I owed RHR money State Contractors Liscencing Board has received a complaint form and is wanting RHR and Homeowner to resolve issue prior to it being investigated by an Enforcement Representative Regards, [redacted]

The Homeowner breached contract by not paying according to the agreed upon payment schedule she signed in contract with RHR dated August 31, The Homeowner was not billed in advance for work, rather according to an agreed upon payment schedule in a Home Improvement Contract commiserate to the work anticipated to be completedAt this time, the project is 90% complete, with proof of receipts showing that all materials to complete the project had been purchased for the project by RHR, including the quartz slabs for the countertopsThe quartz slabs for countertops were at the fabricators when the Homeowner breached contract due to non-paymentThe Homeowner stated that she paid for 80% of project, however more work has been done on the project than the Homeowner has currently paid forDue to the Homeowner’s refusal to remedy the breach of contract, all work ceased on the project The Homeowner was notified verbally multiple times, beginning in mid- September by both [redacted] and [redacted] of RHR Designs and Renovations that the project would not be complete by October 15, and that countertops and sinks would not be installed due to a delay in cabinet delivery and thus subsequently with the subcontractors for countertop fabricationRHR stipulated in contract that there was an estimated completion date of October 15, and RHR notified homeowner in writing on October 9, that project would not be complete by October 15, and that there would be new completion date of October 27, Homeowner continued to push RHR for an October 15, deadline to be met and moved in to condo despite written and verbal notifications from RHR Contractor Homeowner texted times and woke [redacted] and [redacted] of RHR up at 1:am October 16th, to notify them that the shower floor was not to her liking [redacted] from RHR met Homeowner to discuss at 8:am October 16, 2017, and was told by Homeowner that grout on the shower floor was too thick for Homeowner’s liking [redacted] from RHR spent hours sanding grout down to produce a more “pebble like” effectHomeowner insisted that it was still not to her liking and insisted that it needed to be redone [redacted] stated that the tile contractor would be able to come the following day, Wednesday October 18, to reviewHomeowner then told [redacted] of RHR that she would not pay any more on the contract until the shower floor was redone at his cost, even though a scheduled payment was past due for October 13, [redacted] reassured Homeowner that the pebbles for the shower floor were the ones she had chosen for installation and that even if redone, it would look identical to what was currently installedRHR advised Homeowner that if she would like a different type of flooring installed that she would need to pay for the work to be redoneHomeowner insisted that RHR redo the shower floor at his expense and that she would not pay according to the terms of agreement signed by her in the Home Improvement Contract RHR gave written notice of Breach of Contract to Homeowner and stipulated a remedy so that work could recommence on projectHomeowner failed to contact RHR to resolve breach, and in writing refused to pay according to the signed Home Improvement ContractContractor RHR notified Homeowner of Termination of ContractHomeowner filed complaints with Revdex.com and CSLB against Contractor RHR
