From: < #1155cc;">[email protected]>Date: Thu, Aug 28, at 12:PMSubject: Rice Banking Company's response to Complaint # [redacted] To: [email protected] to Revdex.com Case # [redacted] On June 15, Rice Banking Company made a loan to the Customer who filed this complaintThe amount financed was $3,and a Mercury Marquis was used for collateral The Customers wife was listed as borrower and the Customer was listed as co-borrowerThe payback terms were months at $with first payment being due on July 25, Three payments were made on this loan and it was renewed on October 5, The payoff amount was $3,871.92, an additional $1,was also advanced for a total loan amount of $4,Again, the Customers wife was listed as borrower and the Customer was listed as co-borrower and the Mercury was used for collateralWe have signatures from both parties on both contracts and the Customer’s signature is on the State of Alabama automobile title application for both loans The Customer’s wife subsequently filed bankruptcy and they defaulted on the loanRice Banking Company filed a small claims action against the Customer for $3,000.00, the maximum amount for small claimsThe balance was actually $4,After we filed, the customer alleged that the signature on this loan and the signature on the second title application was not hisHe acknowledges he signed on the initial loanI responded to his allegation with a correspondence addressed to him stating we take allegations of forgery very seriously and would he please contact us so that we could resolve this matter fairly and legallyI have not received any response from the CustomerI did however receive a rude and personally insulting correspondence from his wifeShe alleges the loan was only supposed to be her nameNo one is contesting the validity of her signature on the loan and his signature appears directly below hersHis name is also printed on the contract directly below hersIt is difficult to imagine she did not know he was listed on the loanRegardless, we elected to dismiss the small claims case until we could determine if it is his signature and if not then who forged his name on our contract and the State of Alabama title application I am assuming the genesis of this complaint is the Customer is still alleging that is not his signature on the loan documentsThen Rice Banking’s question is “who signed it”? Our attorneys would be very interested in talking with the Customer and his wife’s regarding this matterI repeat, the wife did sign the contract, the Customers name name is clearly on the contract and there is a signature directly below her’s At this point in time, Rice Banking Company has a signed contract and State of Alabama automobile title application for this loanWe will not be changing any reports to Equifax nor releasing the title to the MercuryAgain, I ask the Customer to contact us so we can set up a time and place for our attorneys to meet with him and his wife His allegation that I stated our system was screwed up is totally as well as the allegation that we have had complaints about suing people for loans that do not belong to them Dan Deloney, Jr Rice Banking Company *** [redacted]

On June 15, 2010 Rice Banking Company made a loan to the Customer who filed this complaint. The amount financed was $3,934.70 and a 1996 Mercury Marquis was used for collateral The Customers wife was listed as borrower and the Customer was listed as co-borrower. The payback terms were 30 months at $159.95 with first payment being due on July 25, 2010. Three payments were made on this loan and it was renewed on October 5, 2010. The payoff amount was $3,871.92, an additional $1,000.00 was also advanced for a total loan amount of $4,888.42 Again, the Customers wife was listed as borrower and the Customer was listed as co-borrower and the Mercury was used for collateral. We have signatures from both parties on both contracts and the Customer’s signature is on the State of Alabama automobile title application for both loans
The Customer’s wife subsequently filed bankruptcy and they defaulted on the loan. Rice Banking Company filed a small claims action against the Customer for $3,000.00, the maximum amount for small claims. The balance was actually $4,193.47. After we filed, the customer alleged that the signature on this loan and the signature on the second title application was not his. He acknowledges he signed on the initial loan. I responded to his allegation with a correspondence addressed to him stating we take allegations of forgery very seriously and would he please contact us so that we could resolve this matter fairly and legally. I have not received any response from the Customer. I did however receive a rude and personally insulting correspondence from his wife. She alleges the loan was only supposed to be her name. No one is contesting the validity of her signature on the loan and his signature appears directly below hers. His name is also printed on the contract directly below hers. It is difficult to imagine she did not know he was listed on the loan. Regardless, we elected to dismiss the small claims case until we could determine if it is his signature and if not then who forged his name on our contract and the State of Alabama title application. 
I am assuming the genesis of this complaint is the Customer is still alleging that is not his signature on the loan documents. Then Rice Banking’s question is “who signed it”?  Our attorneys would be very interested in talking with the Customer and his wife’s regarding this matter. I repeat, the wife did sign the contract, the Customers name name is clearly on the contract and there is a signature directly below her’s.
At this point in time, Rice Banking Company has a signed contract and State of Alabama automobile title application for this loan. We will not be changing any reports to Equifax nor releasing the title to the Mercury. His allegation that I stated our system was screwed up is totally false as well as the allegation that we have had complaints about suing people for loans that do not belong to them.
