In reference to the complaint tiled, if l did not know better after reading it, I would conclude that this came from a scorned women in her last ditch effort to get the last word in and to tarnish some ones reputation out of vindictivenessAfter reading it several times I could only chuckle at the flip flopping of his very own words as its riddled in contradictionsFirst off I will address the actual contract that is enclosedThis contract which is signed by [redacted] very clearly list one property, [redacted] This property is [redacted] 's as he very clearly stated when meeting him in the beginning of November at this property whereas he retained my services on location and told me where to put the snowThis is the only valid and true statement within his complaintThis is a shared driveway with [redacted] NEVER at anytime did I agree to give a for deal and include both properties for the price of one { please see enclosed contracts of other shared driveways whereas it is clearly listed or not listed when services are retained)Both properties would be listed as a contractual agreement and for insurance purposes as any damage could be denied by my insurance company due to this technicalityOnly a FOOL would not list the properties under contractual agreement [redacted] is VERY CLEARLY attempting to use a weak statement that both properties were included in one price due to the fact that snow was piled on both propertiesThis does not prove anything as this was done out of simplicity for my benefit as the snow NEEDS to be put somewhere ( please see the enclosed pictures) [redacted] tenants at [redacted] occupy parking spots in comparison to parking spot occupied by the tenants located at [redacted] This creates a VERY OBVIOUS reason why snow was pushed onto the unpaid property's side due to lawn space not blocked by carsThis had absolutely NOTHING to do with the ENTIRE paved area as [redacted] is attempting to manipulate and sell his storyNEVER ONCE, did [redacted] tell me the owner of the other house at [redacted] pays half of anything (This is SEPARATE PROPERTIES and SEPARATE PAYABLE ACCOUNTS)It was discovered in early February that [redacted] was going to receive money from the owner of [redacted] This happened when the tenants there attempted to come out and move their one vehicle for me to plowI informed the tenant from [redacted] ***, that their not my account and I cant sit there waiting for them to clear their cars off and warm them up and ultimately move itIt was at this time, the discussions were made with the owner [redacted] that he was paying [redacted] for half of the contract made for [redacted] Within the discussion I was outraged that [redacted] was PROF1TT1NG from my services as he used the simple fact that snow was cleared all alongThis is where [redacted] was caught stealing from me and making statements so he could REDUCE his cost by taking money from [redacted] ***I very clearly stated to [redacted] ***, that [redacted] is a selfish, self centered lying THIEFThe exact same statements were made to [redacted] and I am also making the same statement to the Revdex.comAs angry as I was and still am, I did continue this contract as I am still legally boundPlease see the enclosed ROUTE PLANNER that clearly list the days that I plowed ALL my contracts EQUALLYThese records are kept just for this purpose and protect myself from accusations of the ignorance of people like [redacted] and their statements in regards to complaints that I am not doing my job and not showing upThis supports the contradictions within his complaint as one sentences states I don't show up and the next sentence states I am piling snow up to the tenants bumpersWHAT IS IT?????? I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear on the attached PDF. I am writing to you in reference to my Revdex.com claim against Mr. [redacted] (Above and Beyond Construction), claim #[redacted]. This document shall serve as my reply to Mr. [redacted]'s reply to my initial complaint. POINT I MR. [redacted] AGREED TO PLOW THE ENTIRE PAVED SURGACE When I met Mr. [redacted] at [redacted] in the fall I specifically told him that I wanted a price to plow the entire paved area. Mr. [redacted] assumed I owned both properties ([redacted] and [redacted]). On the rare occasion that Mr. [redacted] plowed the lot he plowed the back lot that is located straight ahead, but 99% of the time neglected to plow behind the house to the right. In mid February 2015 I told Mr. [redacted] that I did not own [redacted], but that the owner ([redacted]) splits the plow costs with me. Mr. [redacted] immediately tried to bamboozle Mr. [redacted] and collect the $150 that was slated to come to me. Mr. [redacted] contends in his reply that I did not inform him that Mr. [redacted] was going to pay me for half of the plowing costs, but that he "Learned" this in a conversation with Mr. [redacted]. This "story" is full of holes. Firstly, how does Mr. [redacted] account for the fact that he suddenly left a note for [redacted]'s tenant at [redacted], asking for Mr. [redacted] to call him (Exhibit A). Furthermore. Mr. [redacted] has sworn to the fact that Mr. [redacted] ALREADY knew that Mr. [redacted] was going to pay me for half of the plowing PRIOR to calling him (Mr. [redacted]). Please see Mr. [redacted]'s sworn Affidavit, attached herein as Exhibit B. Additionally. Mr. [redacted] has no idea where the property line is at the property. I own approximately 80% of the paved surface at [redacted]. I have paved the entire area, both my driveway and the driveway for [redacted] at my own expense. I also ensure that the entire surface is plowed and sealed each year. Mr. [redacted]'s contention that he merely plowed the small area that is owned by Mr. [redacted], as a benefit to himself (Mr. [redacted]), is an insult to all of our intelligences. Plow companies do not plow driveways that they have not been paid to plow. Plow companies also do not pile one properties snow on another properties lawn without permission. It is logical that if I am the one that paved the entire driveway at my own expense and arrange for the sealing and plowing of the driveway. I would ensure that the entire driveway was plowed. Clearly Mr. [redacted] tried to "hustle" Mr. [redacted] out of $150. Mr. [redacted]'s claim that I am stealing from him is outrageous. Every year I arrange the plowing and sealing and [redacted] and I split the costs. This is none of Mr. [redacted]'s business. His contention is laughable. POINT II MR. [redacted] USUALLY DID NOT FULLFILL HIS DUTY TO PLOW WHEN 3" OR MORE OF SNOW FELL Plain and simple Mr. [redacted] rarely plowed the paved surface that he agreed to plow and when he did plow, he did a terrible job. Three of my tenants at [redacted] have signed Affidavits attesting to Mr. [redacted]'s performance. Please see attached Affidavit of [redacted] (Exhibit C). Affidavit of [redacted] (Exhibit D) and Affidavit of [redacted] (Exhibit E). All three tenants have sworn, under penalty of perjury, that Mr. [redacted] clearly did not fulfill his obligations, as per the contract (see contract attached to Mr. [redacted]'s reply.) In fact, my tenants spent much of the winter shoveling the driveway, as Mr. [redacted] rarely showed up. When Mr. [redacted] did show up. he purposefully plowed them in and exercised little care. It should be noted that my tenants specified in their Affidavits, that the snow that Mr. [redacted] neglected to plow came usually within one day and usually at a rate of 6-12" on that day. Mr. [redacted]'s contention that the snow piled up an inch or two a day, over a long period of time is clearly a lie. POINT III MR. [redacted]'S REPLY SS FULL OF LIES AND HEARSAY Mr. [redacted]'s reply attacks my character. Careful inspection of the Affidavits contained herein. (Exhibit B. C. D and E) clearly show that all others involved hold me in high regard. Mr. [redacted] referenced in his reply that he had made negative comments, about my character, to me directly, but that is not so. As a much older and decrepit person. Mr. [redacted] choose his words carefully each time he was in my presence, as our physical statures are much different. Mr. [redacted] included his "route planner" as evidence of his detailed job performance, but that very "route planner" is an incitement against Mr. [redacted] and ABOVE AND BEYOND CONSTRUCTION. The route planner is messy, unclear and a incomplete, which explains the fact that Mr. [redacted] rarely showed up to plow and did a terrible job when he did. Because he could not perform his duties as specified in the contract Mr. [redacted] did offer to give me a pro-rated refund in late February. Of course I refused the pro-rated refund that would have amounted to a few dollars as I would have had a hard time finding anyone to plow for the end of February and early March. Clearly Mr. [redacted] was in over his head by signing on to plow as many driveways as he did. Mr. [redacted] included pictures labeled as "3rd week of February" which were where obviously taken after Mr. [redacted] received notice from the Revdex.com that I filed a claim. Mr. [redacted] staged a "plowed driveway scene" for the sole purpose of taking those pictures. Much of the driveway that he took pictures of was shoveled by my tenants. As attested to in my tenants Affidavits, Mr. [redacted] usually refused to plow behind the house, to the right. In fact, [redacted]'s wife. [redacted], texted me on February 6. 2015 and notified me that Mr. [redacted] did come, but that he did not plow their parking area, behind the house, at ail (Exhibit F). POINT IV MR. [redacted]'S DESTROYED THE FLOWER BOX AT [redacted] AND SHOULD PAY TO HAVE A NEW ONE REBUILT. Mr. [redacted] has informed me that Mr. [redacted] ran over the flower box located well into the patio/lawn of his home, located at [redacted] (see attached pictures as Exhibit G). Mr. [redacted] sure plowed a long way onto the property of [redacted] for someone who allegedly was not hired to do so. I would estimate the cost of replacing this flower box at $350. Please direct Mr. [redacted] to mail a check to [redacted]. NY [redacted], payable to Mr. [redacted], within 5 business days, or action will be taken to recover those costs legally. POINT V MR. [redacted]'S TORE UP MY LAWN AND DAMAGED MY FENCE As previously written, most of the time Mr. [redacted] refused to plow around behind the house, to the right, where [redacted] and [redacted] parked. I repeatedly asked Mr. [redacted] to plow this area. In late January and/or early February Mr. [redacted] plowed the area behind the house to the right, but he plowed all of the snow up against my new black, chain link fence. I personally uncovered the fence by shoveling the snow off of the fence tor 3 hours. I sent Mr. [redacted] a text on February 6, 2015, asking him not to push the snow up against the fence (Exhibit H). As evidenced by these texts Mr. [redacted] is not a typical business owner. Mr. [redacted] refused to reply to my texts. When he did reply to my texts he asked me to stop texting him, instead of replying, "ok. no problem." Because hundreds or thousands of pounds of snow were piled up against and on top of this fence, the fence gate is no longer in alignment (see exhibit 1). Additionally. Mr. [redacted] tore up the lawn in the front and back of the house (Exhibit I). The cost of replacing the fence and repairing the lawn is $475. More damage to the fence may reveal itself as the snow melts. I agree to waive future damage claims to the fence if Mr. [redacted] sends me a check for $475. made payable to [redacted], by no later than April 10, 2015. CONCLUSION ABOVE AND BEYOND CONSTRUCTION IS CLEARLY A FRAUD, RUN BY A LIAR (NOT A LYER) [SIC]. Clearly Mr. [redacted] was in over his head this winter in regards to his plow contracts and also in his attempt to litigate this claim against me. The overwhelming documentation provided herein leave the only conclusion that Mr. [redacted] and ABOVE AND BEYOND CONSTRUCTION should refund me ([redacted]) $400 as he did not meet the terms of the contract. $475 to cover lawn and fence repairs/replacement and send a check to Mr. [redacted] in the amount of $350 to cover the destruction of said flower box. I also encourage the Revdex.com to level any and all sanctions against Mr. [redacted]and Above and Beyond Construction, that that they see fit, including, but not limited to changing his rating to an "F" and writing reviews against his company on [redacted] etc. Please relay the message to Mr. [redacted] that he is no longer allowed on my property, for any reason. Because a customer gives some one a very small amount of money ($400), this covers 5 months. Let me repeat 5 months of 24/7 on call service, it does not entitle them to abuse a person in this matter. [redacted] was offered a pro-rated amount of REFUNDABLE MONEY he would of received in early February when all this theft was discovered. [redacted] DECLINED roughly 6 weeks of refundable money which would of RELEASED both of us from doing any further contractual agreements and the remainder of the season. [redacted] wanted all his money back to release me from any further business with him. This was comical in its own right as roughly 10 feet of snow within this season was already plowed and the season was winding down (see pics). [redacted] CONVIENTLY forgot to put that in his statement/complaint. Nothing would of pleased me more then to legally eliminate this man from my life with this refund and dissolving the contract. I am just going to make a couple brief comments regarding [redacted] unrelated comments which mainly target accusations related to senior citizens. Please review BID#1. This bid is from [redacted], a senior citizen located at [redacted]. My contractual agreement was SOLELY with [redacted] to plow BOTH driveways which are shared. Clearly stated house number ** and **. Very much the same situation as [redacted] property to say the least 2 streets from [redacted]. Let the records reflect BOTH houses listed on the contract as both sides were to be plowed as per this contract. Also take note at the substantial discount given to a senior citizen. Not only was a discount given for [redacted]'s age, but he just wanted a bulk of the snow removed and clearly stated to just drag once. { pushing snow gives a better finish job, DRAGGING snow leaves a bass packed snow of roughly 3 to 4 inches which loosens as you drive over it. I prefer and always push snow when applicable) It surfaced one day as [redacted] called complaining about [redacted]. I believe he said it was his partners house. I never met this man or seen him ( his partner). My contract is with [redacted] at [redacted], NOT [redacted]. [redacted] called several times on this property complaining on the loosely packed snow left behind due to dragging it out and piling it at end of driveway at the apron/street. I explained the difference between the final fished job. [redacted] also wanted me to maneuver my truck behind the house to do a area for the tenant there. This was a very tight spot. I did it several times with much difficulty and finally broke my mirror. I stopped when this happened. Enclosed, please review the replacement mirror receipt. [redacted] conveniently combined those incidents on [redacted] Street into the complaint on [redacted] in his attempt to discredit me.  BID#2 .... This is a shared driveway as well, whereas the customers in one house/duplex paid The SAME AS [redacted]. The owner of the other duplex next door opted not to render my services as had a new snow blower to say the least he stored his car in a garage. These customers had 3 cars just as [redacted] tenants. This man benefited greatly as 90% of the snow was pushed onto his side of the property. This was done done out of simplicity just as both addresses at [redacted] ( [redacted] and [redacted]'s properties). Let the Records reflect, #1 house number on the contract and the exact same price (S400) [redacted] paid for his property on [redacted] and not 2 houses to include [redacted]. This supports my billing per household and consistency of my contracts in a shared driveway situation. In closing, I have produced a VERY CLEAR REBUTAL to counter the false statements of a THIEF and LYER, namely [redacted]. It is my opinion that the Revdex.com has no other choice but to find complaints filed against myself as inconclusive and false whereas as the only actions by the Revdex.com is to press the button on the shredder. There will be NO REFUND submitted to [redacted]. The only thing I might consider is a shiny new shovel wrapped in a pretty red bow, hopefully he uses it rather then hiring YET ANOTHER plow service. This should be a VERY CLEAR indication to the Revdex.com, of the characteristics were dealing with in [redacted]. CASE CLOSED Humbly yours, [redacted]
