received no mail or email regarding this matter from your office prior to this letter of August 3, 2016, unless your email was sent to my spam file, which I generally do not open in this day and age of hacking Next, I do wish to state that Mr*** should have no standing to even bring this matter since he was not my client and has also not furnished any proof that he is an authorized representative of his mother's estate. Further, since he is not the client, I am not authorized to release confidential information regarding this matter I did meet with Mr***'s mother and her husband prior to her death and did discuss the guardianship of her daughter at length. It was determined that further investigation would be necessary at that point and I did receive a retainer of $1,to investigate the matter further. I did go to the County Clerk's office in Midland, Texas and reviewed the matters in the Guardianship file and then had another meeting with my clients to discuss the findings and discuss a course of action, and it was decided that they needed to take some additional steps prior to filing for Mr***'s mother to seek Guardianship if they determined certain things. However, prior to them completing that review then Mr***'s mother died and that is when Mr*** became involved. I did advise him that prior to spending more money fighting over the Guardianship that he might want to contact his father to see if he was willing to relinquish being Guardian since I understood that he was very old and in poor health himself. However, it was later determined that the father was apparently unwilling to resign as Guardian I, however, did not agree to handle a contested Guardianship for a flat fee of $1,000.00. My hourly rate is $per hour, and a contested Guardianship would also include filing fees paid to the County Clerk and citation fees to pay a process server to serve the current Guardian. It would also include preparation of discovery and court time for one or more hearings. I only agreed to investigate the matter and decide on a course of action with my clients prior to Mr***'s mother's untimely death and this was done. Further, since I have not had a secretary for some time, I am just now billing for the past several months and will send a statement to Mr***'s stepfather, who is my only surviving client and will return any unused funds to him since he paid it. Mr*** did not pay the retainer fee and has not automatically become my client due to the death of his mother. Further, with his bullying attitude and threats that he is influential and knows lots of people I have no interest in representing him.
