I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

 [redacted] has not resolved the issue. This hunt was
originally scheduled for 2013 and as previously stated in my complaint. [redacted]
[redacted] failed to fulfil his obligations to send our deposit money to the
outfitter. ([redacted], [redacted]) and arrange for our hunt
in 2013.
My hunting partner and I sent [redacted] a total of $3,000, his
fee, $500 per person plus the $1,000 per person that was to go to the outfitter
for our deposit. This was sent to [redacted] in April or May of 2013. All [redacted]
[redacted] had to do was to send our $2,000 deposit and signed contract to the
outfitter. We were to owe $2,000 per person paid directly to the outfitter when
we arrived for the hunt. (We have this on signed contract)
After failing to make the 2013 hunt happen as agreed but
refusing to refund our money [redacted] said he would get everything right for a
2014 hunt.
Now in 2014 the same thing (he actually stopped payment on
the check he sent to the outfitter for the 2014 hunt). Only when finding this
out through the outfitter and contacting [redacted] by phone on July ** or **
did he agree to resend the outfitter our deposit, however again he only sent
part of the deposit ($750 per person and not the full $1,000 we paid him………..because
of this the outfitter says we owe $2,250 per person)
In this type of business a deposit is required / needed by
the outfitter to cover the upfront cost of putting the hunt together; paying
for our license, arranging lodging and sometimes to determine personnel help he’ll
need. As a business man in this type business [redacted] fully understands this.
Here it is Aug. *, 2014 and the outfitter has not received
any deposit, for a hunt that was supposed to start in less than 4 weeks. (a
deposit that [redacted] has had for almost a year and a half)
The outfitter told me that [redacted] called him and said the
check is in the mail, however what [redacted] refuses to hear is because of his
waiting again until the last minute the hunt is not going to happen. The
outfitter said it is very unlikely that he can get everything arranged with
this little time left and give us a quality hunt. Because of my type of
business, working with my contracts I cannot easily rearrange time off. I don’t
have the option of just going on the hunt at a later date as I must schedule my
time off well in advance. This was also communicated to [redacted]. The
outfitter also stated that he doesn’t want anything to do with a check from [redacted]
[redacted], first [redacted] did not send the full $2,000 deposit as agreed (only
sent $1,500) and second the outfitter is concerned that he may stop payment
again or in some other way something happen after he’s paid for our license,
booked our rooms, etc. and him not get paid, therefore he told me that he
wasn’t accepting his check as payment for our deposit.
I called [redacted] to explain but he refuses to listen, he
over talks you on the phone very loudly at a scream and just keeps repeating
over and over “it’s done, it’s over, done deal, checks in the mail”. Well it’s
not a done deal, the hunt had to be within a time schedule which [redacted] was
well aware of.
Also another reason I cannot reschedule a later date this
year is I have some surgery scheduled for right after the time I would returned
from this trip (one of the reason I held off on having the surgery in the first
place was to get this hunt in) The surgery will keep me down for two or three
weeks. My hunting partner and I already have other hunts scheduled for 2015 and
2016……so 2014 was likely the only chance we could do this hunt. We ARE NOT
trying to cut [redacted] out of his fee, he failed to timely arrange this hunt 2
years in a row. [redacted] has had our deposit money for over a year and a half.
[redacted] has messed up my hunting partner’s and my vacation
hunting plans 2 years in a row just because he would not and did not send the
deposit to the outfitter.
In compromising in order to resolve this issue at this stage
I am willing to give [redacted] a total of $500 for his time ($250 from me and
my hunting partner) [redacted] would return the remaining $2,500 directly to me
in the form of a certified bank draft, made to [redacted]. Again this
gives [redacted] $500 for a very little amount of his time.

The business has responded. Please read below.
My commissions on my hunting trips come from the outfitter not the client. I have a set agreement with each outfitter I work with as to what percentage I make. Their is no amount that [redacted] is paying me, it is what the outfitter is paying me. I set a check to the outfitter overnight and he texted me back that he has received it but [redacted] said not to cash it. So I am not understanding the issue. [redacted] has advised the outfitter to return me my check I still have not received it. Once received I will send it to **. I do not understand the games that are playing here. The outfitter has had the check since the beginning of August and it is Now the middle of September!!

[redacted] has a moose hunt booked for October 2014 and the deposit check was sent out out on Thursday July [redacted] and should be getting to the moose out fitter in Canada by Friday August [redacted]. I will send a copy of the check once it has been cashed. I spoke to the outfitter and [redacted] was set to...

go on his hunt, then Saturday I received a call from [redacted] stating he wanted to go through the outfitter directly and not go through me. I advised [redacted] that I spoke with the outfitter and he was all set to go on his hunt and to have a good time in October. We are a booking agency and get paid by the outfitters to send clients. [redacted] wanted to take us out of the equation and still go on the Moose hunt in October . I explained to ** that everything was set and go have fun on your hunt!.

Review: Last year we, myself and a hunting partner booked a moose hunt in Saskatchewan Canada for Sept. of 2013. We booked this hunt with Rich's Hunting Adventures ([redacted]). The outfitter/guide that [redacted] booked us with was [redacted], [redacted]. About 6 weeks before the scheduled hunt I contacted the outfitter ([redacted]) directly who said [redacted] did not send him the money and he did not have us booked for any hunt. After several attempts to contact [redacted] he finally contacted me and wanted to know what the problem was, I explained that he never sent the money and booked our hunt. He began to tell all kind of excuses basically that his girlfriend had got mad at him and destroyed his books and therefore he lost all his information, could not contact the outfitter and couldn't get in touch with me since he lost addresses, phone numbers, etc. (he couldn't explain why he didn't use the internet to look up the outfitter, ([redacted], [redacted]...it was easy for me to find). After much discussion he agreed to make immediate contact with the outfitter and send him the money, he made contact and the outfitter agreed to the last minute hunt if he received the money in time to get our license . [redacted] did not send the money as he said he would . I called several times as the deadline approached and the outfitter kept telling me he had not received the money or booking contract. I would call [redacted] and he kept making excuses, saying the check was in the mail, etc. The day before the hunt was to begin the outfitter called me and said he just received a check from [redacted] in the amount of $1,500 but it was too late to make the hunt happen, couldn't get us license, etc. (it was too late for us as well since the drive was 30 hrs - from Jonesborough Tn. to Sasketchewan Canada .....also the amount was supposed to have been $2,000.....We (myself and hunting partner) had paid Rich's Hunting Adventures $3,000, $1,500 each to set this hunt up, we were told we'd owe an additional $2,000 each paid to the outfitter at the start of the hunt.........out total hunt cost each was to be $3,500 each......we have this in signed contract) We were now being told by [redacted] that it was incorrect that he was to get $750 per person to book this hunt not $500....now it was going to cost us $3750 each) However it didn't matter since we couldn't get the hunt scheduled. Again after much discussion with [redacted] (Rich's Hunting Adventures) he said he would get everything settled with the outfitter (money, dates, contract, etc.) to get us a rescheduled hunt in 2014. I hadn't heard anything as of July **, 2014 so I called the outfitter who told me that [redacted] had never contacted him on our behalf, had not sent him any contract and had actually put a stop payment on the check he was sent. He said he no longer would have anything to do with [redacted] and would not schedule any hunts for him. I called [redacted] and left a message (I think it was on July [redacted]) [redacted] called me the morning of July [redacted] and seemed to be at a total loss of memory. Said he would get in touch with the outfitter and work everything out. I told him what the outfitter said, that he would no longer accept any hunts through [redacted], and he wasn't happy and started the same thing about not his fault, he'd get in touch with his girl friend and have her see what went wrong, get contact information and contact the outfitter and make it right. he couldn't answer why he had cancelled the deposit check he sent to the outfitter. In 2013 we (my hunting partner and I) worked hard to get ready for that hunt, planned vacation, saved, etc. and of course was very disappointed not to be able to make the trip but we agreed to let him hold our money and reschedule for this year, 2014. Now it's the same old excuses, he's not done one thing he said he would and at this late place we're not willing to continue anymore discussions with [redacted], just not willing to continue to hear excuses and be cheated. We're asking that [redacted] send our money back in the form of a certified bank draft. (total of $3,000) The correct phone number that I've been able to contact [redacted] at is ###-###-####.Desired Settlement: Total refund. $3,000 in the form of a certified bank draft.

Here's an update.

On Sat. Aug. **, 2014 [redacted] called me and agreed to send our $2,000 deposit paid to him for our hunt directly back to me. (This allows [redacted] to keep his original $1,000 booking fee per contract). I requested that the money be in the form of a bank draft or other form of guaranteed funds but not a personal check. He said he would go to the post office Tues. Sept. *, 2014 and get the check sent to me on that day. I told [redacted] that as soon as I have the check and it clears I'll end my complaint. [redacted] asked me where to send the check and I was giving him my address but he said he was driving and on his cell but he could get it from my previous information.
