Cash & Cars promotional mailing used language that made winning seem certainI recently received a promotion from Rick Hill Nissan in [redacted], TN. The promotion was sent out on a big card that was titled "Cars & Cash" or "Cash & Cars". When I attended the promotion, my card was taken.I am an educated woman with a B.A. in Mathematics and a Masters in Education. I'm currently working on my 2nd masters degree. I read and re-read the promotion and did not see the normal hidden language and details I expected to see. The mailer included a game card where you tear back items and said if you match three you have won. I matched on the prize of $3000, so again, I looked and looked for the special language I expected, but did not find it. For that reason, I decided to visit the dealership.This was one of these "events" with out of town sales people running the show/circus. Lots of balloons and people. I was not able to see if I won until going through the motions of giving my information to the sales person. I even mentioned to him that I didn't see the language I expected to see that would let me know it was only a possibility that I won rather than a certainty. He pointed to the large phrase at the top of the back page which read "You may have won $30,000", which was the major prize. I'm not ignorant, so I wasn't surprised when my number didn't match the numbers on the prize poster (carefully hidden behind a wall screen). However, the mailing WAS misleading. I left with a gold coin replica as my prize.By contrast, just this week I received a similar event mailing for a [redacted] dealership in [redacted], MO. This mailer has all the lingo I would expect to see making it clear that winning is uncertain even if I "match three symbols" which I did. Furthermore, this mailing even mentions the consolation prize of the gold coins (which of course are basically worthless). I would like you to look into this misleading mailing that was sent out on behalf of Rick Hill Nissan.Desired SettlementBusinesses that run these misleading adavertisement practices should be penalized. Once I didn't win, my mailer was "discarded" by the sales person, so I do not have proof my supposed $3000 winning.My real reason for reporting this issues is to make it stop. I have NEVER reported anyone to any Revdex.com before. As mentioned, there is a correct way to do these promotions (See "Back To School Savings" which appears to be a similar event, probably ran be outside people as well, and conducted at [redacted] in [redacted] MO). I am contacting you all to see if you all can help me in anyway because I am retired and do not have the money to try and live and pay for this car if you can help me in any way please do. Lied about the pricing of vehicle and about what was included in the price.On August 26, 2014, went to Rick Hill to purchase a 2004 [redacted] for $1900 cash. Car was previously wrecked and had cosmetic damage as well as damage to radiator. This was all known at time of purchase. The dealer [redacted] asked what we would offer and my father told him $1500. [redacted] proceeded to explain that we had to pay taxes and license fees and tags at the car lot that we could not buy outright because they were not private party. We agreed on the price of $1900. [redacted] specifically stated that this covered the price of car, taxes for car, license fees, and title fees and included the tags for the vehicle. I then asked how would I receive my tags and he said they would either mail them to me or call me when they came in. I asked if here would make sure because I wanted to know before I left. He went back and brought me an envelope with a white bill of sale and the title and told me to take it to the court house and they would mail me my tags. When we left I told my dad I was going to the court house the next day. When I went to the court clerks office they told me I owed them $97 and I told them I had paid for tags at the carlot. They told me that the carlot would have to give me a check. I called my father and explained to him and so he called [redacted] and [redacted] told my father that they wrote checks on Tuesdays or Wednesday and he would try to get a check to me that day. He told my dad that he would call Saturday morning and if he didn't for dad to call him. So on Saturday Dad called [redacted] and [redacted] said he was too busy and just could not get to it. So we all drove down to the carlot and after finding [redacted] and asking what was up with the tags he started to yell at us and say it is not his fault. Then he told us that we went out of state which we did not. He says he won'd do anything for and and because hateful with us. My father asked him what the $299 fee for title and license was for and he said it was all our fault that we bought the car like it was and we will have to buy the tags. This is not how it was explained to us. We were told that we were paying for the tags when we bought the car or I would have done something else. Not only did [redacted] lie to us, he disrespected and embarrased us in front of many people inside of the building. I feel he lied to us in order to secure the sale and now that it is paid for he doesn't want to do anything else. We ask several other sales people to help us and everyone said they were not getting in the middle of [redacted]'s deal. I feel that they should hold to there end of the deal and pay for the tags or refund my $299 dollars that no one could explain to me what it was for. I have the bill of sale and proof from my mother and father of what was said and phone records from the calls. The customer came into dealership looking for a cash car under $2000 and the salesperson showed them this unit. They where allowed to drive and inspect vehicle before purchase. The customer agreed to purchase the vehicle for $1500 plus taxes and fees. The confusion came when[redacted] stated that we where charging them for tags.[redacted] is not a full time salesperson for the dealership and is employed with the sales company that put on the event. We do not collect for tags on cash deals and let the customer handle that themselves. I think[redacted] should have gotten with management about the confusion so that this matter could of been resolved. He should of never mislead the customer in telling them that the dealership was going to mail a check nor should he had disrespected them. I am forwarding the complaint to his boss. The other issue of the $299 doc fee which is charged on every deal for handling the transaction and processing the paperwork. I apologize for the confusion to Mrs[redacted] but she was never charged for the $97 tags that she had to buy at the clerks office. The "contract" that was agreed upon was that we were to pay 1500 for the car but taxes, license fee, and registration, which included tags, would total 1900. This issue was restated 4 times to my father, my mother, and myself. I specifically asked for him to find out for sure before I signed any papers.[redacted] walked away and came back and said that it my registration would be mailed to me. So I signed the paper. After 5 calls between[redacted] and my father, we were told we had to come pick up a check for my tags. I live 45 minutes away so I drove to the car lot only to be screamed at in front of several people. I left the car lot in tears because everyone at the car lot except a sales man named Jim made us feel stupid. If all this had been explained the day of purchase I would not have purchased this car because like I told[redacted] I was looking at another car. Now that I have purchased the car and put all my money into fixing the car I cannot afford to buy tags. Had[redacted] not intentionally lied to make a deal I could took one of many different routes to insure I would have a vehicle that would have tags on it. As it stands now, I have a title in my house with someone else's name on it. I feel that by[redacted] lying and misleading me into the contract that Rick Hill should stand by there "sales person" regardless if was full time or not. To register my car is 97 dollars. I have had to fix a wiring issue which cost $300, have had to replace the radiator support which cost $188, and had to had axles fixed which cost over $500. I am not complaining about having to fix the car. I understand that any 10 year old car will have problems. But Rick Hill should stand by the contract that was made by a person selling cars for their benefit regardless of fulltime or not. I have 3 witnesses to this contract and have 7 witnesses to the way I was treated by[redacted] and the emotional damage it did to my father and I to be screamed at in front of people for no reason.[redacted] also made us feel stupid in front of everyone for believing him. I have purchased a 2003 Nissan Altima from Rick Hill Nissan the salesman with Jim he said nothing was wrong with it now it is smoking and want to die The 2003 Nissan Altima that I purchase from Rick Hill Nissan the salesman said there was nothing wrong with it it is now smoking it acts like it wants to die I took it to Rick Hill Nissan they said they looked at it and said nothing was wrong with it I took it to two mechanics both of them said it was a head gasket and heater core Rick Hill Nissan after they don't want to do nothing about it I am a disabled person only draw so much money a month and they want to do this to me very bad businessDesired SettlementI want a different car one that will run and not break downBusiness Response We spoke with Mr [redacted] on Friday May 13th and set an appointment to see what the problem is. He had previously had the car in for service and we could not duplicate the problem that he described. The car was not smoking. Our conversation with him on Friday did not indicate that he had spoke with a licensed mechanic that actually diagnosed the vehicle. We are working with Mr [redacted]. His appointment is on Wednesday, May the 18th.

Rick hill Nissan sold me a Nissan Murano that had frame damage as a certified pre owned. We bought the murano on 6/7/14. Had a clean car fax. Went to trade it in and auto pulled up structural damage during trade in. After comparing car fax and auto check, Rick hill bought the murano announced with structure damage on 3-6-14 according to auto check and on 3-7-14 it was listed for sale. I called and asked Blake [redacted] to make it right by taking the car back and he said no get with car fax they should buy it. I have lost all trade in value and can't seem to dos anything.Desired SettlementI just want to be reimbursed Business Response Upon receiving the complaint from Mr [redacted], I am trying to research the issue at hand. We agreed to give the customer the amount that he wanted as trade. Mr [redacted] then indicated that he would rather us buy the vehicle and he would put the difference with it to pay it off. I did not say we would not do that but that I would have to talk to other managers. He never mentioned a 15K amount. I also indicated that the amount could change. He indicated he wanted 10-12k as trade and we agreed. Mr [redacted] then ended our conversation by saying let me call you right back and I have not heard from him since then. The vehicle is still a Nissan certified pre-owned vehicle which comes with a 100k powertrain warranty and a carfax buyback gurantee if certain issues were not reported by Carfax. That buyback would have to be initiated by the customer and go through carfax. Nissan uses Carfax only when certifying vehicles. Again, we would be happy to give him full NADA trade-in value assuming the vehicle has no other concerns since the customers have owned it for over 1 & 1/2 years. We are willing to work with the customers and since my conversation with him last we were willing to give what he wanted. We were still waiting for the contact from the customer.

I purchased [redacted] (VIN [redacted] which had structural damage and electrical problems. I traded but I want 1500 loss My name is [redacted] and I purchased [redacted] (VIN [redacted]) on June 24,2015. I had a [redacted] that was taken in on trade for the [redacted] and financed the additional 8,500 dollars for the vehicle. During the negotiation of the sales process for the [redacted] a car fax was never provided to me showing the structural damage of the vehicle and also the reported accidents that were involved.During the 1st month of ownership of the vehicle, it had been in the possession of [redacted] for the repair of the sound coming from the engine and also the center console was repaired. The second month of ownership has not been good since I have checked the car fax and it revealed structural damaged and accidents, which was never disclosed to me. I have since traded the car to another dealer and had to take a loss of 1,500 dollars in negative equity to get rid of the car. My purpose of this letter is to contact [redacted] Nissan directly and try to recoup the 1,500 dollar loss because of this damage. I would like you to pay this money back to me without involving and legal matters or reporting [redacted] to the Revdex.com to resolve this matter. [redacted] brought the vehicle for repairs and had another complaint after the fact. We fixed the center console and replaced a bracket on the exhaust at no charge. We feel we went above and beyond for this customer. Rick Hill Nissan always supplies a customer with a Car Fax at their request.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The console was broke before the purchase of the vehicle and also the rattle was there before the purchase. The problem with that pertains to this issue includes the structural damage of the [redacted] that Rick Hill Nissan did not disclose at the time of purchase. The vehicle was damaged and paint flaking with additional wear on the tires because of structural damage on the front end of vehicle. Most dealers will not sell wrecked vehicle if it has been wrecked. I had to trade the vehicle and took a loss as I suggested. The car fax for this vehicle shows the structural damage. [redacted]Document Attached[redacted]I have uploaded a copy of the [redacted] where structural damage exists on the car. This was never disclosed to me from the dealer and this car was still having difficulties which is why I had to trade and take a loss.Final Business Response All vehicles are sold as/is.
