November 4, TO WHOM THIS MAY CONCERN, ON OCTOBER 22, (THURSDAY) ONE OF MY MECHANICS WAS SENT OUT ON SERVICE CALL FOR TRANSLINK SOLUTIONS TRANSPORTATION WHERE THEY HAD A TRUCK BRAKE DOWN ON THE SIDE OF ROADMY MECHANIC INSPECTED TRUCK FOUND THAT THE TRANSMISSION WAS STUCK IN GEAR AND COULD NOT TRY AND REPAIR ON THE SIDE OF ROAD WHERE HE WAS AT A REALLY BUSY INTERSECTION, SO THE COMPANY TRANSLINK HAD THE TRUCK TOWED TO OUR SHOP FOR FURTHER DIAGNOSING AND FOUND THAT THE TRANSMISSION WAS BAD SO AT THIS TIME I MYSELF (***) CALLED THE OWNER MR ( [redacted] )OF THE TRUCK TO TELL HIM WHAT WE HAD FOUND WRONG ON HIS TRUCK, I ALSO SENT HIM MR ( [redacted] )PICTURES OF THE TRANSMISSION TO SHOW HIM EXACTLY WHAT I WAS TALKING ABOUT.THE OWNER MR ( [redacted] ) THEN STATED TO ME TO GO AHEAD AND REPLACE THE TRANSMISSION,SO I HAD MY MECHANICS LOAD THE OLD TRANSMISSION IN MY TRUCK TO TAKE WITH ME TO MATCH IT TO A NEW ONESINCE I WAS UNABLE TO GET THE TRANSMISSION FIXED OR A REMANUFACTURED ONE I ENDED UP GETTING A NEW ON FOR $4,ONCE THE WORK WAS DONE I CALLED THE OWNER MR ( [redacted] ) AND LET HIM KNOW HIS TRUCK WAS READY TO BE PICKED UP AND INVOICE WAS READY FOR PAYMENT.THE OWNER AT THAT TIME STATED THAT HE DID NOT HAVE THE MONEY TO PAY THE INVOICE AND WANTED TO MAKE PAYMENT ARRANGEMENTS AND FOR ME TO RELEASE THE TRUCK TO HIS DRIVER AT THAT TIME I TOLD HIM I COULD NOT DO THAT SINCE I HAD TO PAY THE FULL PRICE ON THE TRANSMISSION AND I TOO WAS RUNNING A BUSINESSTHE OWNER ( [redacted] ) STATED HE WOULD NOT BE ABLE TO PAY INVOICE TILL THE FOLLOWING WEDNESDAY WHICH WAS 10-28-15, SO I TOLD HIM THAT WAS FINE BUT THAT HE WOULD STILL NOT BE ABLE TO TAKE HIS TRUCK TILL INVOICE WAS PAID IN FULLDAYS PASSED AND THEN ONE DAY THE OWNER ( [redacted] ) SHOWS UP TO MY SHOP STILL INTENTING ON GETTING PAYMENT ARRANGEMENTS FOR HIS TRUCK, IN WHICH I ADVISED HIM I COULD NOT DO THAT SINCE I HAD INVESTED SO MUCH MONEY IN REPAIRING HIS TRUCK.STHEN MR ( [redacted] ) STATED ONCE AGAIN THAT HE WOULD THEN PAY INVOICE BY THE FOLLOWING FRIDAY WHICH WAS OCT 30, THAT DAY CAME AND LEFT AND STILL NOTHING, MR [redacted] DIDN'T EVEN BOTHER TO CALL OR COME BY TO PAY FOR THE INVOICE, SO THE TRUCK IS STILL SITTING HERE AT MY SHOP WAITING FOR PAYMENTI APOLOGIZE BUT I CAN NOT ADJUST THE INVOICE OR TAKE ANY PAYMENT ARRANGEMENTS AT THIS TIME SINCE I MYSELF HAD TO PAY FOR THE TRANSMISSON ALL AT ONCE TO BE ABLE TO REPAIR THEIR TRUCKALSO I DON'T KNOW WHY HE IS SAYING I DID NOT HAVE APPROVAL WHEN CLEARLY I DID I ALSO HAVE THE PERMISSION PAPER THAT THE DRIVER SIGNED GIVING US PERMISSION TO COMPLETE ALL NECESSARY REPAIRS THE OWNER ALSO SIGNED THE INVOICE AGREEING TO PAY .SO I DO NOT UNDERSTAND WHY HE IS COMPLAINING ABOUT MY SERVICES WHEN I HAVE ENOUGH PROOFI AM ENCLOSING A COPY OF BOTH INVOICE AND THE PERMISSION TO REPAIR VEHICLE BOTH SIGNEDANYHOW THANK YOU FOR YOU ALLS TIME AND IF ANY QUESTIONS PLEASE FEEL FREE TO CONTACT ME [redacted] AT [redacted] RICKS DIESEL REPAIR LLC S MIDLAND DR MIDLAND TX [redacted]

I am rejecting this response because:
My Freightliner did break down and require a tow for repairsMy Emergency Roadside assistance company recommended Rick's DieselUpon their arrival my driver, *** *** requested a "check and advise"My partner, *** Harper spoke with Mr*** and asked him to find the problem and let him know what it wasIt was determined to be the transmission
Mr*** said he would take our transmission out and price it for a new and/or a rebuilt transmissionMy driver, *** *** took pictures of our current transmission and sent them to usUpon examining the pictures it did not appear to be damagedThe following day Mr*** sent pictures after I informed him that my driver had sent picturesApproximately hours after receiving pictures from Mr*** we called to see if our estimate was ready and was told that the work was done and we could pick up our truckWe were confused because we were never given a quote or estimateWe never "okayed" the work to startMr*** said that he purchased a new transmission (without giving us a quote) and put it in (without our authorization)We said we would pay the bill but had not anticipated it being that muchMr*** became upset and said he would give us the transmission for free and give us our truckThat he would not fight over moneyWe said to Mr*** that we do not conduct business in that manner and we would pay our bill, we just needed to get the money togetherWe also asked if we could make payment arrangements to pay our debtHe said he would call us back the next dayWe never heard back from himWe contacted Mr*** the following week to discuss options for getting our truck backThis time Mr*** suggested we speak with his sonHis son indicated that hsi father was "getting old & senile" and he would not accept any payment arrangementsThe truck would be released once paid in full.
Towards the end of the week my partner, *** Harper drove hours to Midland from Houston to speak with Mr***.Once again he spoke with his sonMy partner was told that he could not get the truck until paid in full"The son" stated that he would remove labor and not charge storage fees*** signed the invoice and left without the truckBefore leaving one of ***'s shop employee's told my partner that ***'s Diesel was not "making payroll" and he was planning on quittingThis shows that his business practices are unethical.
Today, November 17th I contacted ***'s Diesel to make arrangements to pick up my truckI was told by Mr*** that I caused a lot of problems with the Revdex.com and now he was charging $per day for storage along with labor & partsAt tha time I told Mr*** that I would go through the Revdex.com to resolve this matter.
We are only asking that Rick's Diesel honor the agreement of $5244.72, (which I still believe is overpriced) so we can get our truck back

Please accept my apology for the delay in response to *** ***'s complaintI would like to issue the following statement regarding the complaint filed with the Better Bush less Bureau ID #***
I received a service call on March 2, I arrived at truck location and found that the truck had a burned clutch and transmission and could not be repaired at the truck’s locationI advised the driver of the truck that it needed to be worked on further at my shop, ***'s Diesel Repair in MidlandThe driver for ** *** agreed therefore a tow truck was called which was consensual as you can see on the tow truck receiptThis service call was oil a Sunday and since the parts stores were closed we were unable to get parts until the following business day, Monday March
On Monday we called for parts for the truck which included a clutch, stop Drake, hose and bearingsThe clutch had to be ordered because they didn't have it in stock , While we were waiting for the parts the mechanic started draining fluids from the truck so that the broken parts could be removed, The mechanic showed me that the transmission had been burned out due to lack of transmission oil in the unitI witnessed about a cup of oil drained in to the bottom of a bucket which should have filled a 5gal bucketThe broken parts were then removed excluding the transmission because we wanted to contact *** *** first
The clutch arrived on March 4, So I went and picked it upI notified *** *** that the truck did in fact need a new transmission and the fly wheel resurfacedAlso I told him that we could obtain a re-manufactured transmission from a local vendor and have the flywheel resurfaced*** *** said that he could get one for a better price and would bring it to us when he got itThis was not a problem because I have a lot of customers that buy their own parts*** *** told me that he wanted me to have the flywheel resurfacedThe job was then put on hold at the point pending the arrival of the transmission to be brought in by the customer,
While we were waiting for the transmission the mechanic got the truck ready for the new partsThe flywheel was finished on March 11, in which time the customer also brought us the transmissionThe customer told me that he got it from a Salvage yard and got a "good deal on itI was happy he was able to save some money as we know that transmissions can be very costlyWork started again on this unitAfter a few hours of working to get the transmission unloaded from the customer and preparing It to be installed the mechanic noticed that the transmission that was brought in would not fit in place of the old one due to the positioning of the shifterThe pre-existing transmission's shifter position was about 1/4" further toward the front of the housingI measured it and in fact the measurement was accurate and the customer was informed of this issueThe customer asked if we could just change out the top transmission coversThe mechanic said that it would not work for two reasonsFirst that the shifter would not match up because forks inside the transmission would not be in the right place and second because we didn't want to void any warranty the customer got from the pimple he got the transmission from and that they would have to readjust the forksThe customer said they would go get the covers changed out and at that time we loaded both the pre-existing and newer transmissions in the truck, At this point I had my secretary print out the invoice and the customer signed and paid with a check and credit cardThe assumption was that the transmission would come back to us ready to install without further complicationsOnce again the job was put back on hold
The customer returned within a few days or so with the transmissionThe mechanic put the transmission, clutch, drive line and all the components back on the truckAt that time the transmission would not shiftThe mechanic told the customer that the forks were jammed either from being in the wrong position or the people who changed out the coversI told *** *** that for us to remove the transmission for the readjustment we would still have to charge for the labor of pulling the transmission and putting it back on because the issue was not our faultCustomer did not want to add anymore labor to the invoice and made the judgment call to have the truck towed on his ownAt that point I found some airlines that had gotten pinched by the transmission that needed to be fixed that's why *** *** leaving with the truck was delayed a bit longerThe customer decided to wait while we went to get the necessary parts to fix the air issueIt was getting late in the day so the customer decided to pick his truck up the next dayWhen the lines were installed the customer then paid for them and signed the invoice which did not have any additional labor
Essentially the job was not complete because the customer decided to stop work not from our lack of desire to finish the repairI did everything I could to finish the repair in a timely fashion (as you can see on the receipt dates) and as inexpensive as possibleWhen the customer brought us parts I put other jobs on hold to convenience *** ***I understand that time for these Units means money and when they aren't working the company is losing money*** *** and his guys were very helpful and got us the parts as quick as they could
Please allow me to offer my condolences to *** *** and his guys for feeling as though they needed to take this route to find resolveI sympathize with *** *** for the repairs that had to be done on his truck and for time lost when the truck was not in useIt is my wish that we could have discussed this matter while his truck was still here so that we might have been able to come to a compromise of sortsLastly l am sorry that *** *** felt I was hiding down the road from himIt is possible that he saw me pulled over to take a phone call or write down some information from a phone call although I don't recall that happening
