I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.The breeder did not offer a resolution, yet provided an exhaustive denial of the facts The breeder advertised that, "The applicable health screens have been performed on the sire and dam as recommended by the (AKC) Parent Club for this breed" The AKC Parent Club for Golden Retrievers requires the following tests: a Hip Evaluation b Elbow Evaluation c Cardiac Exam d Ophthalmologist Evaluation According to the small breed cardiologist at [redacted] ***l upon examination of the puppy, the defective condition would have been detected with a proper Cardiac Exam of the sire and dam as represented on the AKC website The buyer relied on the representations of the breeder and the reputation of the AKC to ensure the quality of the product The breeder's representations were false Regards, [redacted]

customer was orally briefed on the health guarantee making it specifically clear that if asituation arose regarding puppy health, liability was limited to refund of purchase price orproviding the purchaser with a new puppy with return of the original puppyThe purchasersagreed to this guaranteeWe met for approximately one hour discussing care of the puppy andresponsibilities of the purchaser and breeder.The purchaser was offered a refund on 12/11/with return of the puppy as soon as theynotified me that their vet thought the puppy had a heart murmurI notified them that I wouldnot cover addition testing but would take the puppy back and refund their purchase priceTheowner declined my offer and decided to have expensive testing done at their own expense.The puppy purchase's complaint misrepresents and misstates the AKC advertisementTheadvertisement on the AKC web site never stated that certain health screens were performed nordid it specifically state the other information the purchaser stipulated was present in the ad.Enclosed is a copy of the advertisement as it appeared on the AKC web site.Contracts outlining puppy purchaser and breeder responsibilities can be provided on request.This purchaser did not request a contractStandard puppy purchaser contracts typically limitbreeder responsibility to refund of purchase price or providing another puppy with return of theoriginal purchased puppy within a certain length of time.Sincerely,Steven Milauskas

I notified them that Iwould not cover additional testing but would take the puppy back and refund their purchaseprice. The owner declined my offer and decided to have further expensive testing done at theirown expense. The puppy purchase's complaint misrepresents and misstates the American Kennel Club (AKC)listing. The listing as it appeared on the AKC website was previously sent in to the Revdex.com inresponse to the original complaint. The litter listing on the AKC web site never stated norimplied that certain health certain were performed.  I cannot speak for the AKC but, AKC doesnot require the health screens mentioned by the complainant. AKC simply verifies that puppieslisted are true-to-breed. The "Bred with Heart" program cited by the complainant is an optionalprogram that in no way is required by AKC nor was cited in the AKC listing.Standard puppy purchaser contracts (universally) typically limit breeder responsibility to refundof purchase price or providing another puppy with return of the original purchased puppy withina certain length of time depending on circumstances and verification.
