The guy is runing around every day Business Response I have full documentation that work was presented to a representative that was on the board of the company owned by [redacted]. This is not an unusual situation as a Marketing person is usually in charge of such matters.When I was brought into the process, I was introduced to [redacted] by an associate that was on the board and presented himself as being in charge of the marketing direction. [redacted] promptly said that I would be working with the Marketing Director. The Marketing Director was always available and communicative, so there was never the need to be in direct contact with [redacted]. Additionally, [redacted] had my information and there is no record of him reaching out or of any concern of the progress until the Marketing Director resigned from the project.The initial presentation of this potential project occurred back in 2011. I kept in touch with the Marketing Director to see how things were going. On March 20, 2012, I was told things were close. Sept 9, 2013, I was asked for my wire coordinates to move forward wight he project. I was given a price of $8000 to create the logo and some branding aspects. I was given a deadline for a presentation and we delivered numerous comps that the Marketing Director commented on and we made changes to. Fifty percent was wired into ma account.Throughout, I received positive feedback from the Marketing Director - October 4th "Great work so far, as I mentioned the icon is there." Meaning, it was complete and ready for presentation. I followed up with the Marketing Director to see how the meeting had gone and received an email on October 7 saying "Overall very positive. They all like the [redacted] (a portion of the logo) and think it is fine the way it is. They all seemed fine with the text treatment, no real preferences there, except that we need to have short and long versions: [redacted] and [redacted]On October 9, I received an email saying "Attached is the approved color palette for [redacted] Again, positive reinforcement that things were moving forward.In October 11, I told that the Marketing Director that typically 25% is due after a presentation. I received confirmation that it "should be possible."On November 4th, I received this comment from the Marketing Director - this implying that [redacted] was aware that work had been done and part of the process. In addition, the money was paid and that is typically done when work has been shown - not that nothing had been done or that it was going nowhere as now suggested.From the marketing director - "[redacted] asked me about payment, so I'll tell him to send it this week. Being the ball-buster I am, I originally told him to hold off until I did the presentation. We'll get it sorted". I was wired the full amount of money - not just 25% - but the full and final amount directly from [redacted], wired into my account.At this point, all indication was that the project was complete and that the logo was in use. I received an email in January of 2014 that the Marketing Director had made changes to the logo, but no request for additional refinements was requested.I was contacted by the marketing director around March that he had resigned - at the same time that my father's health was declining until his death in April of 2014. All matters leading up to that and right after were focused in my family - this slowed my responses to [redacted]. Again, for a project that I had received 2 voluntary payments for and though was complete. I then started to receive and have voicemails from [redacted] with threats to me and my family if I did not return the money.With this review, the consensus with me and the attorney is that no funds are due in return. However, in good faith, I offered to present one more round of revisions after a presentation of all the logos presented to the Marketing Director. With that, a [redacted] presentation template would be provided, usage of the logo on an aircraft and design of letterhead and business cards.This was refused and the demand continued for the return of the money. The marketing director then sent this email on May 20th, 2014 - "There seems to be continued miscommunication here. I just checked all my emails to [redacted] I believe it is my fault. I assumed that I did so, however, I did not discuss with [redacted] the rebuttal feedback from [redacted] that the [redacted] appeared "too aggressive". Initially the feedback on the [redacted] was positive by [redacted] and the team, however, after presenting the logo in various presentations to 3rd parties, the feedback was that the [redacted] appeared aggressive. This feedback came at a time during which we were traveling and quite busy. It appears that I did not communicate this to [redacted], so I can see now what is causing the confusion. The last email that I found regarding modification was before the "angry [redacted]" feedback. This modification discussion was regarding integrating the existing [redacted] more with the word mark. At the time [redacted] was dealing with family issues and I purposely backed off for a while - I mentioned this to [redacted] at the time. However, with things getting busy I did not submit the [redacted] change request. Instead I drafted a new origami [redacted] and paired it with a word mark following the ratio standard set by [redacted]. I did this with the intention of getting more feedback."The Marketing Director then made an offer on my request to return $4000 over time. [redacted] agreed, but wanted it all back and immediately. I am not in a position to do that and said it would take some time. He reneged and said he wanted $5000. I was barraged with calls and emails demanding the money immediately. As a soloprenuer, sales do not always allow for such payments to be made quickly, I have upped my sales activity as to be able to bring in the additional sales to return those funds back to [redacted].He has continued with threats and now is threatening to have me arrested for fraud - for work that was verified front the marketing director and that he voluntarily made payments for. Just received form him - "Dear [redacted], I did not get my money so now I am going to file a police compliant with the police fraud department. This is a case of defraud. This is going to be file in my company US office state. I have worn you and you are not taking me seriously you have scam me. You have not done your work."Again, if his complaint is that I did not do the work - it was verified and presented and he made the second payment himself.I have agreed to pay money back, but the initial amount os to steep and I can not afford it until sales increase.Consumer Response Mr. [redacted] made a agreement to pay back my company $5000 USD from the $8000 USD I have paid him. He made a agreement with with us. Please see Email I got from Mr. [redacted]. [redacted], The check depositing and being held did not have sufficient funds. I am scrambling to bring in the funds to cover. [redacted],You made it clear that you did not want stories or information other than payment information.However, people ARE stories, there are things and circumstances that everyone is dealing with that makes them who they are and how they show up at any moment.Unfortunately, you popped back into my story when there were many things going on. The death of my father, the care of my mother, the settling and transitioning of their affairs, dealing with combative siblings, the end of my marriage, the entrance of college for my son and the list goes on. I am sure you have a list as well. At this time, every item on that list has put a strain on me financially - [redacted] - but the challenges I face that create the unfortunate view that you have of me.If there has been a time when you did not feel I was giving your situation attention, I was dealing with one of the above situations. [redacted] Those are my current demons and things I am battling in these current chapters of the story.As I have stated - I want nothing more than to pay this and be done with it. [redacted] knows who I am and we have worked together for years and I have made referrals for him that have transformed his business and vice versa. He knows all that I have been through for 15 years and the work that we have done together creates a friendship where there is no judgement, but a support mechanism to help each other out. He knows my intention and also understand the things life and the universe bring up to battle through.I know you take this as a sign of disrespect. The intent is nothing of that whatsoever. My focus is to create positive things and interactions with those around me. I tend to push those that are not given with that intent. That is a bad habit and one I am working on. Obviously, if I could pay this and move on from this it would clear a lot of things for me - so you have to understand that it is what I want.I am trying to focus on bringing in the business that will allow that to happen - as fast as possible.I respect you as a successful businessman and appreciate what you are trying to create for the good of the people you will serve. That is what had me excited about your project. Know that every waking moment is working on business and proposals for payment to you. That is my commitment and I apologize it has not been on a schedule that you find appropriate. I am working on your payment.
