Right Way Fence

Mr.[redacted] agreed to build a small fence per our contract (content pasted below)on 5.19.2014. A check for a 50% deposit was deposited by Mr.[redacted] on 5.27.2014, and I received a verbal agreement to begin the work the week of June the second. After several emails and phone calls over several weeks, no work had yet to be completed. After repeatedly being told that work would have begun, the last time via email on June 25th, I fired Mr.[redacted] on July the third.After discussing the matter with Mr.[redacted] and learning that $442.35 of our deposit would be lost due to incurred expenses, I rehired him to complete the work on July 17th. This was under the condition that the work begin the week of the 21st and be completed the week of the the 28th. To this date, no work has been completed. Mr.[redacted] cited the utility company not marking our underground utilities as the reason for the delay. But as of today (the 4th), per [redacted]Call, no request to identify utilities has been made on our property, going back a month. Contract entered into 06/09/2014. Paid in full upon completion. Roof continued to leak. No response.I had a roof built over my deck - $2000 -It leaked. Contractor couldn't fix it. Hired Rightway Fence to repair the roof $3100. Contractor provided guarantee and claimed to be an honorable man.After completion of work by Rightway, the roof still leaked as before. Project was completed in June and contractor has still not come to successfully repair the leaks even after several requests. Deck is not useful if it rains. Contract date: 06/09/2014.Warranty - 1 year from completion. I do not consider the project completed. Desired SettlementI want the leaks successfully repaired. If this contractor is unable to complete the work, I would like to receive sufficient funds to hire someone else to do it. I want the contractor to honor the contract/warranty asap.
