Real Estate failed to deliver leased property in good condition on the date of lease.
On XX-XX-XXXX I, ***, entered in a lease agreement with *** Real Estate with agent Gerry Broussard for 3459 LA 8 located in Pollock. I put a $550 deposit along with $550 for the first months rent down in good faith that the location was ready for occupancy. When an inspection was done initially on the property, and there was no way to inspect the function of any electrical equipment in the residence. I had power restored on or around 06-15-2017, and the Air Conditioning was turned on. On XX-XX-XXXX I located a leak coming from the ceiling from the Air Handler. Photographs were taken of the initial damage to the flooring where I observed cement laid over the wood flooring. This appeared to be previous attempted repairs for moisture coming from the same location in the ceiling.
On XX-XX-XXXX there was supposed to be an appointment with the property owner at 1500 HRS set up by Gerry *** an agent of Ritchie Real Properties. The property owner never made an appearance despite me waiting for 45 minutes after the appointment. I arrived at the property on XX-XX-XXXX to see if any work was being done to have the residence ready for occupancy. A man named Johnny Qualls was doing some repairs. While on scene Mr. Qualls advised that the residence would not be ready for occupancy for several weeks.
I made contact with Gerry *** who was advised of the situation, and let her know that I would not be able to occupy the property. Gerry was also told that I had not been able to move any of my property into the residence since 06-08-2017, the date the property was promised, due to the persisting problems. Photographs were taken on a few occasions, but on XX-XX-XXXX I observed how the moisture was able to allow mold to grow on the plywood on under the flooring in the bathroom. Gerry did not seem alarmed about the health concerns that this may cause. From the conversation my concern to replace the mold infected areas would not be addressed in the repairs.
I attempted to ask Gerry Broussard for a resolution to the property that would allow me to move into a residence in a timely manner. Gerry responded by advising that I could move into the residence leased while construction was finished, and without addressing the obvious health concerns prior to doing so. Gerry told me that I could either move into the property or lose my $1100 down along with service connection fees from utilities.

Desired Outcome

It is my complaint that *** Real Properties violated several Articles of Louisiana Civil Code. First Article 2682 under Lessor's Obligations the Lessor is to deliver the thing, and protect peaceful possession. Under Article 2684 delivery of thing should be at the agreed time, and in good condition. Ownership of the property was never obtained due to the problems from a leaking unit. Lessor failed to allow me to peacefully occupy the property by failing to properly address health concerns from the mold allowed to grow in the flooring of the property due to the moisture. I believe the Lessor also violated Article 2696 by failing to provide a warranty, and returning earnest money for a property that had defects that were no fault of the lessee. While I believe the property had the same maintenance problems prior to the lease due to attempted repairs, I understand that fault may not be proven that the Lessor knew prior to the lease was signed. However I think it is evidence that the issue was previously known, and the Lessor failed to properly address then inspect the issue. I believe that I am entitled not only to a return of my earnest money for a deposit along with rent, but also damages. Under Article 2715 the property was substantially impaired due to poor maintenance on behalf of the landlord, and I am also entitled to damages. Damages will include, but not limited to, money spent to have utilities established at the property. In short Genny *** failed to have the property habitable on the date of the lease on 06-08-2017. Genny then failed to negotiate any favorable alternatives other than occupying a residence at 3459 LA 8 in Pollock. I believe that photographs, that can be provided with this complaint, will show that the property was not good condition even after the lease was signed. I never moved any property into the property taking ownership of the property due to the aforementioned issues. I am attempting to handle this problem outside of civil litigation if possible. I am seeking the return of my $1100 in payments to Ritchie Real Estate along with fees received from utilities. From Pollock Area Water Systems a connection fee of $50 plus a minimum fee for service of $22.50 for the month was received. I have not yet received the bill for transferring services with *** at this time. However any electrical utilities used were used by contractors making repairs. So as of right now I seek to recover a total of $1172.50 from Ritchie Real Estate for failure to deliver a leased property in good condition on the agreed date of 06-08-2017.
