In response to the [redacted] response:We stand behind our warranty and will make adjustments on the work we have already doneWe are still willing to refund the $1,for the interior piers that were installedWe have done foundation work for four other houses in the same area and those people understand that, due to the movement, adjustments must be made

Complaint: [redacted] I am rejecting this response because:As stated in multiple letters and numerous personal conversations,Rite-Way Foundation Company has failed to stabilize our home's foundation.It has been a continuous process of what Rite-Way refers to as 'future adjustments" to our home's foundation since their initial start in August of These adjustments and associated work have been ongoing while resulting in additional interior cracks and foundation movement.As stated in our original Revdex.com complaint # [redacted] this started with a sticking back door that has never been fixed and hasn't been usable since January of 2013.A Professional Structural Engineer found that Rite-Way had over jacked our foundation and any attempts to level our foundation by further jacking would cause additional damages.With the engineer's finding and current conditions following Rite-Way's untold number of unsuccessful attempts to stabilize our foundation it's obvious their further attempts will only cause additional damage.To address the pier cost issue our original Rite-Way Foundation Company contract, item #specifically states as follows (See Att#1):*Owner may order work which is not described In this agreement, in which event owner and contractor shall enter Into a separate written agreement describing suchNo oral representation by anybody can change this agreementThis agreement is the entire agreement between Contractor and ownerThis was our reason for having the additional addendum agreed upon and signed by both [redacted] and a Rite-Way official (See Att#2).At no time did Rite-Way Foundation EVER discuss a difference in the cost of exterior and interior piersAs shown on Attof our September 17, letter it states in Item "ANY" additional pier support structures needed beyond those In the contract will be priced at $per each support (See Att #2), This overcharge was previously addressed to Rite-Way in my letter dated May 16, (See Att#3) and proposal dated May 4, (See Att#4)Regards, [redacted]

I am rejecting this response because:Rite-Way Foundation Company persists in ignoring their years of previous adjustment failures by the continued gesture to MAKE ADJUSTMENTS to our foundation .We have contracted with Professional Engineers paying $1,starting with Mr*** ***n prior to Rite-Way Foundation's initial contact work.As previously stated, Mr*** letter and layout diagram were not followed by Rite-WayBeginning August 9, was a continuous forty nine month period during which a multitude of adjustments were made without satisfactory lasting results.Rite-Way's spokesman in July stated that they would need to reopen our home's interior a second timeAt that time we contracted Professional Engineering firm, *** *** *** to make an overall evaluation of our home's foundationThis was done using *** *** P.Eoriginal written directions and outlined foundation diagram during an onsite inspection.*** *** *** overall findings were as stated before (September 17, 2016) Rite-Way in essence over-jacked the exterior sides and front (approximately inches)The front over jacking resulted in a significant slope to rear left and required a separate entry ramp into our garage.Mr*** ***'s statement that Rite-Way would make adjustments was relevant for the first almost yearsBut when each adjustment resulted in yet more interior and exterior damage and deterioration, a different solution was mandatedRite-Way should have followed the original engineering specifications or sought guidance at our cost as agreed upon and our home wouldn't have seen those continual unsuccessful adjustmentsHad Mr_ *** attempted to seek other qualified assistance when I first suggested prior to Rite-Way's May interior break outs, they wouldn't have continued with over jacking.Mr*** solution in to our inoperative back door was I should hire an outside carpenter to rebuild the door frame.As stated in our original Revdex.com Complaint the resolution is repay as follows, Original contract $12,(excluded $2,spread footing removal) $2,following repayment of $1,overcharge, a total of $14,810.00.Second option, pay current required engineering and stabilization costs of $14,850.00.Rite-Way's letter dated November 1, also stated their willingness to refund their over charge of $1,which has not been received.Regards,

I am rejecting this response because:This letter is the follow up on Complaint #*** we discussed during your phone call to me on November 14, 2016.Attachment #is a copy of Mr***, (Rite-Way) letter and check in the amount of $1,to me dated November 10, Mr*** letter states this is the payment for interior piers installed in our home May His statement is incorrect as the check is actually the amount that we were overcharged per our agreement dated August 4, in compliance with the original contract dated August 11, Our payment for interior work performed was $2,as previously explained.In reference to that original contract we also asked why there was a totally different and separate contract presented by Rite-Way Foundation Company in your letter dated October 4, Our original and binding contract states that a $transfer warranty fee applies to the next ownersHis letter states there will be a $transfer fee but our original contract fee supersedes this $increase.As stated in our previous extensive correspondence to both your Revdex.com and Rite-Way Foundation Company, the agreed upon leveling and stabilization of our home's foundation has never been achieved.Mr*** continually references Rite-Way will make adjustments to work already done as stated in our contractThe following is the exact wording from that contract it adjustments are required during the life of the warranty due to settling, contractor will readjust all effected piers installed by Rite-Way Foundation Co."The adjustments being made are actually due to over jacking and not settling.That statement tied in with their advertisement (AttIn our Revdex.com letter dated September 17, 2016) "Foundation Repair Problems Solved - The First Time" certainly doesn't cover our experience with Rite-WayMr*** continually states We stand behind our warranty and will continue to make adjustments as the need may arise is again stated in his November 10, letter.We've previously provided the Revdex.com with documentation relating to Rite-Way's not following our original Engineer's instructions nor did they heed our multiple requests to get outside engineering assistanceWe requested they seek outside engineering assistance after several years of their unsuccessful "adjustments" attempts. The foundation Issue started with our back door dragging but after a countless number of attempts over almost years by Rite-Way to stabilize and level our home's foundation this door was still totally unusableThis tied in with their moving Interior door hinges, which are still out of line, multiple door latch plates not matching, cabinets separating from walls, large wall cracks several feet long and the list goes on.Our original complaint to the Revdex.com included the letter with it's Attachment #sent to Mr*** ***, owner of Rite-Way Foundation Company dated September 7, This letter provided exacting details of continuous problems being caused by what's now known to be over jacking of our home's foundationHopefully the following explains why we had no confidence whatsoever in Rite-Way Foundation Company's ability to stabilize our home and sought other outside assistance.The extended over jacking of our home's foundation footing resulted in our interior concrete floor saggingConsequently Rite-Way busted large holes and installed interior piersSince these holes destroyed existing vinyl tile we were forced to purchase replacement carpet (see Attachment #2)This interior concrete work completely disrupted our house hold for over two weeks and required another two weeks to clean up dust and debris.In the following two years Rite-Way continually returned to make "adjustments", none of which provided foundation stabilizationWhen Mr*** told us after another two years (2013) that Rite-Way needed to again make interior "adjustments" to our home, it became evident other alternatives needed to be sought.After researching and talking with professional engineers, at our cost of $1,100.00, which followed Rite-Way's multiple years of continued unsuccessful ADJUSTMENTS, the following seems evidentYou must have support piers, beams or skin friction drilled structures of adequate size installed below the level of expansive soilsIt seems that Rite-Way's use of inch piers is not achieving those requirements in our case.Our Attachment #of our original complaint was the Professional Engineer report which stated as follows: "Examination of property revealed over jacking of the front of propertyIf further jacking on rear wall and interior is attempted additional damage will occur.That left me the only option of contracting with a business that has a background and equipment that can achieve these requirements.With Rite-Way's repayment of our $1,overpayment for interior piers, our settlement option is first repayment of original contact (less $2,000.00) of $12,and interior piers of $2,total of $14,810.00.Second option is pay current required engineering and stabilization costs of $14,

To Whom It May Concern,This letter is in regards to Mr. and Mrs. [redacted] of [redacted]. We were hired by the [redacted] in 2009. We have been in contact with the homeowners several times since the hire date, trying to resolve the issue. We have made several adjustments...

over time. This area has a problem with the soil heaving. We have explained several times that a house will need to be readjusted from time to time, due to the soil in this area. This house was not built properly, there were no support beams under walls where there should have been. There was a pre-existing problem when we first got on the job that was from a previous company. We state in our contracts that we are not liable for any damage that may occur during the leveling process. The [redacted] signed our contracts and understood the terms at the time. We have gone out of our way to hire other contractors to take care of patching the sheetrock. We are more than willing to make future adjustments to this house. We are not responsible for replacing the carpet. We will not pay another foundation company to do the same job we have already done. There is no way another foundation company can say that the foundation is worse now than before, when they have never seen it before. The same issues will keep occurring due to the soil. This house is not the only house we have to readjust. All of our customers know this process is not a permanent fix, but to help minimize the movement. Mr. [redacted] will not let us do what we need to inside the house; therefore, the job will never be completed. We feel this is an unfortunate event; we have tried diligently to resolve this issue and to explain to the homeowners the leveling process. We value our customers and do what we can to keep them satisfied. We have always honored our lifetime warranty. We are including the last letter that we sent to Mr. [redacted] in May of 2016.Sincerely,

In response to the [redacted] response:We stand behind our warranty and will make adjustments on the work we have already done. We are still willing to refund the $1,200 for the interior piers that were installed. We have done foundation work for four other houses in the same area and those people understand that, due to the movement, adjustments must be made.

Rite-Way Foundation does not agree with Mr. [redacted] assessment of the situation. We stand behind our contracts and have no problem making future adjustments to his house. Rite-Way has decided to refund $1,200 back to Mr. [redacted]. This is the difference in price between the exterior and interior piers that were installed in the home. The cost of interior and exterior piers differs. Rite-Way is concerned Mr. [redacted] doesn't remember being told the price difference and therefore; we are willing to cut our losses and refund the $1,200. We will wait to hear a response before we mail a check. We are including a copy of our Proposal and Contract form as well as our Warranty.We fix hundreds of homes a year. We have never had a problem with a customer before. We are under the impression there may be bad intentions here.
