We
are in receipt of your correspondence regarding the complaint filed against Post Brothers Apartments by *** ***Ms*** signed a lease with Post Brothers Apartments on March 1, to lease apartment number ***, located at *** ** *** Street, Philadelphia, PA 19144. The lease begin at noon on March 13, 2013 and ended at noon on March 31, (two year term)
The rent amount was $1,365.00, per month and a security deposit was paid in the amount of $1,365.00. Ms*** received a monthly concession of $($1,total for term of lease) along with a parking concession of $monthly for a six month periodIn accordance to the terms of the concession addendum's (see attached) should the lease holder violate any term and/or condition of the Lease, the lease holder is responsible to pay back all concessions utilized and/or received to date
On July 3, 2014, Ms*** provided Management with a day notice to vacate the premises. Keys were turned into the Management office on September 9, 2014.
Pursuant to Lease Agreement, paragraph # Early Termination states the following: Resident may terminate this Agreement and be relieved of further liability for rent for any unexpired portion of the lease by (a) Giving Management at least days prior written notice; plus (b) paying all monies due through the date of termination; plus (c) paying two month's rent as "liquidated damages" and forfeit security deposit and last months rentResident election for early termination shall not relieve Resident of his/her obligations and liability for damage to the Apartment or Apartment Community.
Ms*** was charged for Early Termination in accordance with her lease agreement, along with concession "charge back" (per the concession addendum) final utility charges (per lease) and for a pro-rated costs for repainting the apartmentAn allowance was given to Ms*** for wear and tear usage.
The security deposit disposition was mailed to Ms***, to the last known address of
1* *** *** *** *** ***, Revere, MA 02151, on September 30,
The letter was not returned by the US Postal system
No attempt was made by Ms*** to pay the balance due, therefore in January her account was turned over to a collection agencyOnce an account has been turned over to our collections, all communications must go through the collection agency We have received communication from *** regarding Ms***, to which we have responded as this is a requirement of the agency
We have received multiple communications directly from Ms***, to which MsS*** has responded.
On May 6, 2016; we received an additional communication from *** regarding Ms***. We have advised *** they are to continue the collection activity on this account.
