k the car to check it at Sunburst Automotive and we have a copy of report showing no real issues We have been very professional in working with you Most dealerships would not give such personal service especially when exceeding the implied warranty the dealership gave youe want totally out of our way to help you regardless of you taking the car to different shops to be repaired without asking us then come back to us asking for help to make us responsible After we repaired you car, I personally drove your car for days everyday for several hours a day I did not see any codes or issues These problems seem to only happen after I delivered the car to you TwiceAs you know BMW engines are incredibly complicated and over engineered We brought in a BMW electrical specialist to look at your vehicle at our lot He said it might be the TKO motors, so we switched them out, also at great expense When you called us last time, we informed this specialist of the issue and gave his number to you to schedule him to come to your house to diagnose and repair your vehicle This was going to be done at our expense As to date the Specialist has not reported to us that you contacted him We are trying to resolve this matter and you've been more than patient but please stay in contact and contact the specialist to help repair your vehicle

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. In all fairness to them, I was informed that the emissions issue was preventing the sale to become complete.  But their story never changed and after 6 business days, they still couldn't get it taken care of.  I asked that I be kept in the loop but instead, I found myself constantly calling them for information concerning any progress.  I was told that it was a priority but after 6 days...I became skeptical of that too.  The business in question leaves out some key issues.  I had to request my deposit nine (9) times before a check was cut and I could depart their office.  With so many times my request being seemingly ignored, my frustration grew and yes...the tone in my request became more stern so as to indicate the serious manner I wished to convey.  The salesperson's condescending manner both during my visit the previous day and the day that I requested my deposit was not appreciated. The owner kept asking me the same question over and over, "What's the problem?" as if to suggest that he was either hard of hearing or was simply ignoring the inconvenience he and his salesperson had caused me from May, 27th through June 2nd.  The guy even offered to buy me a drink.  After which I replied that I didn't want to be in his office any longer than I had to be and that all I wanted was my deposit.After the owner stated that he would have to keep the paperwork with all of my personal information on file and as I grew to distrust these people through the experience that I encountered, I am not comfortable with the idea of them keeping said information.  This distrust has not wavered and I still want all of the paperwork regarding the potential sale to be turned over to me.  There is no reason, legal or otherwise that they should keep this personal information when no sales transaction ever officially took place.  I am especially sensitive to my personal information being compromised having already gone through this experience just recently (April 2014).This company has some very interesting business practices of which I do not endorse.  That in itself doesn't make them wrong...just different.  They had the opportunity to handle this experience differently and they didn't.  They also have some pretty selective memories with regard to defending their position concerning my complaint. I e-mailed them 5 hours before filing this complaint on 06/05/14 out of courtesy, affording them the opportunity to respond with a suitable compromise.  They failed to do so. Consequently I filed the complaint in order to spare any other potential customers from the sort of experience that I encountered dealing with this company.I want no additional contact with these people as they have already lost my business.  If it is not possible to secure the aforementioned paperwork with all of my personal information due to some legal binding, then I would like to have that in writing from someone other than a representative of this business.

Mr. [redacted] came to our lot looking for a BMW.  The one he came to look at was not ready for sale as it had not passed emission.  We informed him of this as we expected it to pass emissions the next day.  We also informed him that the vehicle needed some reconditioning before it...

would be ready like minor repairs and cleaning.  He test drove the car and wanted it. He left a $500 deposit on the car knowing that the sale was contingent on it passing emissions and going through reconditioning.  Mr. [redacted] filled out a credit application for financing and we informed him that we will get back to him next day on the status of his financing.  Given his credit rating, we knew it would not be an issue.After several attempts the car would not pass emissions because the computer was showing that the car had not been driven long enough to clear out any codes. Luxury German vehicles are very sensitive to these types of drive cycles.Mr. [redacted] was anxious to get the vehicle but we could not release it to him unless it passed emissions.  He came on the lot very angry that we were lying to him about the emissions and didn't want to sell him the vehicle. We showed the emission papers from the state taken that same day that stated that the vehicle was not ready.The vehicle finally passed emissions late the next day.  Attached all the emissions papers to show how many times we try , and the drive cycle steps .We called Mr. [redacted] but there was not answer and just then some other clients walked in and we decided to help them and contact Mr. [redacted] later, not knowing his level of anger and frustration.The notion of us not wanting to sell the car to him, or wanting a higher price, or bait and switch are ridiculous.  The vehicle is still on sale for the same amount we offered to sell to Mr. [redacted].  Unlike clientele or customers, we don't fall in love with the vehicles.  We do our best the give our clients the best possible vehicles we can.  Sometimes things are beyond our control like the clients needs, temperament of the vehicles, laws and regulation, and time.Mr. [redacted] walked onto the lot very angry and spouting expletives.  We informed him that the BMW was ready but he said he wanted his deposit back.  Mr. Hussein told his office manager immediately to cut him a check.  While she was writing the check Mr. Hussein tried to calm Mr. [redacted] down and ask why he was so angry.  We did everything we could to get the vehicle ready for him but sometimes things like this happen.  He just said "I want my f! deposit!".  He also wanted his credit application he filled out.Dealerships are obligated by law once we pull customer credit either complete or incomplete transaction to keep all of our clients information in a secure location for 2 years and then destroy them, we also conform that with our lawyers.We here at Car Mix Motor fully comply with all City, State, & Federal laws and we fully cooperate with all legal authority such the State Attorney General and Finance banking department, M.V.D  There are other issues at play with Mr. [redacted] other than the purchase of this vehicle.  His level of anger and hostility are not normal in regards to this situation.We will be happy to sell the vehicle to Mr. [redacted] as well as sell him an extended warranty at our cost.
