On May 31, *** *** was a tenant living in one of Rivendell Real Estate’s managed properties located at *** *** *** in Edgewater. In discussions leading up to the sale of the home on June 1, 2016, the previous owner gave the new owners the $security deposit in case the
home was not returned to the new owners in moready condition My final conversation with the tenant’s wife *** *** was that the home was fully cleaned but due to the broken lawn mower and time constraints, they were not able to mow the lawn or pull the weeds in the yard I conducted a walk-through of the home on/about June 1, 2016. During the routine inspection, I noted several items that were in need of repair to include blinds, garbage removal, paint touch up etc. The new owners agreed to not charge the tenants these charges. I contacted my lawn mowing company to bring the yard back to moready condition. They charged me $to mow, pull weeds and disposal of the clippings. I therefore withheld $from the $security deposit to pay this vendor. I provided the tenants with the receiptMy justification for withholding the security deposit was the following. Although *** *** did not have a lease agreement with the previous owner to my knowledge, they still were required to return the home to rent ready condition The home was completely renovated prior to their move-in. I walked this home previous times during construction. A moinspection form was not available to my knowledge, however, this has historically been the responsibility of the tenant to complete to protect any damage that may have existed upon move-inWe provide these forms to each one of our tenants at moand if it not returned, it is assumed that the home was in perfect conditionAdditionally, I contacted the Colorado Association of Realtors legal department and confirmed that legally funds can be withheld for this type of negligenceAfter the tenant received the refund less the $70, we spoke via phone for over minutes about the charge. A few days after that, I received a text message claiming he was going to go to small claims court to recoup his security deposit. I discussed this with the owners of the property and in the spirit of moving forward, they agreed to return the $to him.
