This customer sent a reservation request for one of our properties through the website www.***.comThe property she tried to reserve, River Run Estate, was listed for $1,per night, however, due to an error on the website with the weekly pricing, she was able to reserve for $per night
The reservation request email was sent to us at 3:pmUpon realizing what had happened, we immediately cancelled it at 3:pm, issued a full refund and then contacted *** *** to let her knowI contacted her at 3:23, moments after cancelling her reservation and issuing a full refundI never threatened nor did I ask for more moneyI had already fully refunded her money before I picked up the phone to apologize for the error on the *** websiteAttached you will find the emails that were sentIn addition, you will find a copy of my phone records from *** showing that I called her on 11/at 3:pm and spoke to her for minutesNote that her husband called me back at 3:pm and we spoke for an additional minutesI spoke with both *** and her husband at length and explained to them repeatedly that it was simply an error with the *** website

I am rejecting this response because:Title 6Article 1Colorado Consumer Protection Act6-1-DECEPTIVE TRADE PRACTICES(1) A person engages in a deceptive trade practice when, in the course of such person's business, vocation, or occupation, such a person: (l) Makes or misleading statements of fact concerning the price of goods, services, or property.On the website, the Terms and Conditions Applicable to Online Booking State: "By utilizing a rental agreement as part of the reservation services or otherwise displaying terms relating to the rental as part of the online booking process (including such terms that we may require), the traveler and member each agree to the terms and conditions set forth in the rental agreement or other such terms displayed in the booking process (including without limitation the cancellation refund policy) effective as of the date that the user indicates acceptance of the booking or rental agreement, as applicable.I made a purchase based on a price advertised by River Ridge Rentals and received a confirmation.Regards,*** ***

[redacted]One additional fact I’d like to add for this case is that a week after [redacted] attempted to reserve the home for the incorrect price of $1,242.50 for 7 nights, someone else did reserve it for the correct price of $12,425.00 for 7 nights. Attached you will find a copy of [redacted]’s booking request as well as the one that came a week later which was booked for the correct amount. I add this information because it confirms that the home is worth the $12,425.00 price and it’s unrealistic to think that the price of $1,242.50 would be correct. To be frank, you can’t even rent a one bedroom condo for the price of $1,242.50 for a week, it’s completely unrealistic to think you could rent a 7-bedroom house for that price, particularly when the nightly rate is listed as $1,900/night. I haven’t been able to find a legal reference (I’m not a lawyer like [redacted]), however, I’ve found many articles online that make it clear that if an advertised price is a mistake, the company does not have to honor it. Here is one such example:[redacted] Lastly, please note that we manage the home for the owner and we are contractually obligated to him to charge certain prices for his home. We would be in breach of contract if we had honored [redacted]’s booking and, as a small business, we simply cannot afford to cover the price difference of $11,182.50. We did make a typographical error but we refunded the customer 14 minutes after she made the booking/payment and after the refund was processed, we notified and apologized to her.  Mistakes happen unfortunately, but we worked swiftly to correct it to the best of our ability. Thank you for your time and consideration.
