Riverbend Landscape

We paid a 50% down payment to have a subsurface drainage system installed. The installation was initially scheduled to start the following week but no work has ever been performed and the company has held our deposit for almost 2 months now. Riverbank cashed our deposit and never returned to our property to perform any work or deliver materials. There was intermittent text communication throughout the first month - It was very difficult to speak to anyone on the phone after paying the deposit. New start dates were provided, missed, and rescheduled for later dates. Several excuses were provided to explain why the project was being delayed. We are now past the due date for the project which was established in the contract and no work has been performed. Riverbank was notified that our service agreement was terminated due to breach of contract (due date) and we have requested to have our deposit refunded. We have received no response from Riverbank and are now taking the necessary steps to retrieve our deposit.

I am a homeowner who has recently embarked on renovating my home and I reached out to Riverbank Outdoor Landscaping. After multiple failed attempts with other contractors Riverbank Outdoor Landscaping in specifically Derek A reassured me that his company would not only get the job done but would be clear and communicative of the entire process. In doing so I did research on the LLC. I found they had a website and they even emailed me previous projects to ensure their capabilities. I proceeded to sign the contract and begin the renovations because there were ample signs of a bright and healthy relationship with the future contractor. The contract date was Jan 30th 2020. Upon signing the agreement I then payed a $1,000 cash to Derek A. He then assured me he would start the project date on Feb 10 2020. On the date projected to start is when the issues began. He stated on Feb 10th he had an emergency with his son and was not going to be able to make it till the following week of Feb 10th. On the next scheduled day upon calling him multiple times he replied with a text message saying he was an emergency dental surgery and would not be able to make it til the following week. On the third attempt which was of course enabled by me he said he was not able to make it do to health reasons again. Throughout the entire time of rescheduling I made apparent attempts to vocalize his lack of communication and seeking out to talk to me about his failure of showing up was an issue that needed to change. Each time Derek would reassure me that it was not normal and that he'd show up on the scheduled date. After 3 failed scheduled dates I contacted Derek via text saying I would like a refund and to end this contract on the date of Feb 29 2020 an entire month later. I have yet to receive a response.

My problem is failure to deliver on contracted services for the installation of a patio, turf putting green and related landscaping work at ***. On 10/25/19 I paid a 50% deposit of $5068 to Riverbank (d.b.a. Riverbend) Landscaping to grade, install drainage, a new patio and turf lawn at my home. It was verbally agreed that work would start the following week (week of 10/28), but they could not get materials. There were intermittent text communications through November, with Riverbank repeatedly committing to new start-dates which were then missed and rescheduled for later, which went on until Riverbank firmly committed to starting work the week of 12/9. There was then no communication for 2 weeks, at which point they again pushed to 12/26 (2 months after initial agreement) and we scheduled a phone call on 12/18/19 to discuss specific project timelines and parameters. Riverbank blew off the scheduled meeting, at which point I communicated via email, text and voicemail that we are cancelling the project and requesting our deposit back. As of 1/3/20, there has still been no effort to reach out to me and try and start the project, nor any returned communication other than excuses for why they cant return my deposit. I have given them multiple opportunities to commit to a start-date and complete the project, and they have failed to respond to voicemails and texts in a remotely professional manner. They have held my deposit since October, have not done ANY work and have missed all agreed-upon deadlines and commitments to communicate, and now I am taking steps to retrieve my $5,000 deposit back.
