Signed a contract with *** and *** ***As with every contract we sign, they were told of the challenges we are at times faced with, with the weather, sub-contractors, materials, etcThe *** went on vacation to Florida the week
of contract signingAt that time I informed them that we were working on another job, as we always are, and that we would start as soon as that job was completed, which would be weeks at the earliest as long as there were no delays for the above mentioned reasonsI kept in contact with *** *** as often as was neededAfter contacting several excavation guys, and all of them being very busy, the *** provided a name and a number to a guy they knew, *** that could do the excavation as soon as possibleI talked to him which he stated he would go look at the job that day "thursday" and call me that day with a price and scheduled timeI didnt hear from him, and attempted to call/text him multiple times with no contactAs always I informed the *** which they stated they would get ahold of himThat didnt pan out eitherAt this point *** *** had called and said they wanted to cancel the contract and would like to receive a full refund of their depositI explained to them that every profession gets paid for their time spent, and that I would be calculating my time, visits to their residents to meet contractors, phone calls made, etcand would refund them the balanceThis is common practice for law offices, contractors, any business that operates on timeIf thry were to hire an attorney, that would be charged for every phone call, email, drive time to court, etcas is common practiceThis is my 2nd complaint in years of this business, and only our 4th cancelled contract in the same time frameWe are a professional company that goes out of our way to satisfy customersWe have hundreds of happy customers all over the state of Missouri from real estate companies, home owners, other contractors, judges, etcso the *** statement about us keeping peoples money must be a business for us is about as backwards as calling the daytime sky blackWe advised them that we would be sending out a contract cancellation form which will be mailed out friday, and after returning the signed form, I will be sending their balance of their deposit

We have text from *** *** NUMEROUS times stating project was startingNO START from JUNE through AUGUST is unacceptableThere was ALWAYS an excuse and a promise to have someone there "next week" or "two weeks"Again he FAILED to start the project in months when we were told he would start in weeksHe lied and told us he had already acquired a business license for the City of Willard, none on file for Diamond L Contracting or *** *** - so I therefore don't believe he had any intention of doing the jobIt is not right that he "retains" part of our deposit when he FAILED to turn one spade of dirt or drive one nail! I would not put Mr*** and his business ethics in the same category as a profession that retains feesFor him to only have had two complaints/contract cancellations he is very well versed on "have been through this before and knows what's acceptable within the legal realm" - his response in text
I fully understand construction delays (worked in construction accounting for years) but with a project start date to be weeks from April 29- which he then said it would be two weeks so mid June to August with nothing? Retaining fees is unacceptable in this situationDidn't wait two weeks to cash my check but waits two weeks from receiving FAILURE TO PERFORM and request to cancel contract and he has yet to mail anything outI suppose he will bill me for his time to answer this complaint as well*** *** stated that he tried to call *** *** would believe him over *** *** because of the pattern and business ethics that *** *** has displayedWe also texted *** the price the day after *** was at our house*** told me that *** was about times the price of his excavator that he couldn't ever get to show up on the jobAgain months of NO PERFORMANCE is unacceptable and defiantly not professional...this isn't months of having to "wait our turn" this was months of continually being told the project was going to start and continually have no shows or some excuse as to why it didn't start

The complaint has no meritI am the 2nd builder that *** hired to do the jobThe initial contact from *** was for me to give him
an estimate on a separate jobWhile speaking on the initial visit he was complaining about the current guy "Robs Portable Buildings" taking to long to get started "months he stated, which I later found out was not accurate" and that he wanted me to give him an estimateI provided an estimate and prior to him signing the contract, he was advised that I had jobs in front of his, and it would be days minimum before work would be startedThe first week I ordered trusses and paid for themThe next weeks we had solid rain and where his location was, it was impossible to get equipment inI contacted him several times to update him on truss delivery date, which he cancelled due to being to wetWe also staked out the building site, and spent a few occasions with the building inspectorHe notified me saying that the ground was to wet and that he had decided to wait until spring to build the shopHis money has been returned via certified money order " # XXXXXXXXXX"I have owned this business for years and this is our first complaint, not only from the Revdex.com, but from anyoneWe go out of our way to provide a great service, but people like *** will always have issuesAs of this date,he has ran multiple Craigslist ads bashing our businessWe have had multiple homeowners contact us wanting his phone number or address so they can contact him letting him know of our high standardsI have since learned that he has done this similar situation on a few occasionsOur business will continue to flourish even with his childish behavior
