Re: [redacted] /ID # [redacted] To whom it may concern, Thank you for contacting us regarding a dispute filed from Mr [redacted] I would like to clarify a few comments which were mentioned in his complaint regarding Riverview Springs and move out charges he incurred upon vacating the premises On June 3", we were contacted by Mr [redacted] who stated that he was in the process of moving things out of his apartmentApparently during this process, he moved something out of the master bedroom closet and noticed discoloration of the drywallHe reported this to usOur maintenance staff responded to this and found a faulty shower valve(The bathroom is behind the closet) Maintenance removed the affected drywall, replaced the valve and installed a dehumidifierMaintenance returned the next dayThe affected area was dryThey removed the dehumidifier and patched the wall with new drywallWhen our maintenance staff told Mr [redacted] they would return again to texture and paint the wall area where repairs were made, he told the maintenance person that he was in the process of moving out and would “prefer for them to wait until he turned in keys to do this.” Per his request, we waitedFurniture and carpet in the bedroom were not affected The carpet was replaced after Mr [redacted] moved outThis was because of several bleach stains and red stains in the carpet of both bedrooms and the hallwayHe was also charged for a full paint due to pen and crayon on several walls and a full clean of all areas inside the apartment upon vacating The apartment also had roaches when Mr [redacted] moved out Professional Pest Control treatment for general pests (such as ants, spiders, roaches, silverfish and fleas) is offered to all residents at no charge twice a monthDepending on the insect, there may be some preparation involved prior to the pest control technician's arrival to ensure maximum resultsMr [redacted] signed up for Pest Control service twice during his residency with us of one year and cancelled service both timesOn both of these occasions, Mr [redacted] reported “spiders and ants” being the insect/s he wanted to be treated for in his apartmentRoaches were never mentioned to us by Mr [redacted] Preparation for these two insects (spiders and ants) includes removing personal items from all kitchen and bathroom cabinets and drawersA resident is also requested to wipe these areas down once personal items are removed, prior to the technician's arrivalResidents are informed that they will need to be out of the apartment once treatment is rendered for a period of four hoursThis is the extent of preparation involved on behalf of the residentPreparation for roaches is exactly the same as prep for ants and spiders Disputes regarding turnover obst/scan be avoided in many cases by schedulingapre-move out and/or final inspection of the apartment prior to vacating the premisesThese inspections are offered to all residents at the time they give notice to vacateIn this case, neither inspection was requested The turnover cost/sinvolved with this matter are strictly based on the condition in which the apartment was left upon returning possession to us with the return of keys If you have any further questions, please feel free to give me a call Sincerely, [redacted] Rverview Springs Apartments Rainier Way Ooeanside, CA 760–754–

I have reviewed all photos which were taken of the apartment at the time the *** family vacated the premises, which was on 7/1/Additionally, I have reviewed the completed work order detail for the report made to us on June 3', regarding discolored drywallI have also met with our maintenance staff involved with the resolve of this incident
These are my findings:
There is only one work request for this apartment during the time the *** family lived at the address aforementioned above during their months of residency(The work request is dated June 3", for the discolored drywall.) There are no reports of mold, wet carpet, carpet discoloration or any other matter pertaining to the apartment before or after
The photos have reviewed show multiple stains in the master bedroom, guest bedroom, hallway, dining room area and living roomThese stains vary in size and Color throughoutMany of them are red stains and large bleach stains
The repair completed by maintenance was done by Cutting a hole no larger than 2' Square in the drywall at the back of the master bedroom closetThe carpet toward the back wall of the closet was somewhat wet and therefore removed completely from the closet areaThis is only a small piece of carpet which is laid down in a slider closet areaThe carpet in the closet is completely separated from the bedroom or hallway carpetIt is not attached to these other areas at any pointThe bedroom carpet and hallway area were not affected by this situation
The closet carpet was replaced once the drywall was patchedIt was completely dry when it was put back into the closet
Our maintenance and office staff are properly trained regarding mold preventionWe know the steps which need to be taken if mold is present or potentially could be presentOur last mold prevention (operations and maintenance) class was completed on May 26, Additionally, we would not have left circumstances incomplete in the apartment which could cause mold to develop at a later date
The photos taken prior to the turnover process show red crayon on many of the interior walls and an interior doorIt appears that the resident/s attempted to clean this off the walls in a few places, using a bleach solutionThis resulted in large pink smeared areas on the walls and several bleach stains in the carpet directly belowThere are multiple photos which reflect this
Turnover Costs applied to this account are strictly based on the Condition of the apartment at move outCharges incurred are from circumstances Created during residency, rather than a maintenance issue of
any kind

On June 3", 2016 we were contacted by Mr. [redacted] who stated that he was in the process of moving things out of his apartment. Apparently during this process, he moved something out of the master bedroom closet and noticed discoloration of the drywall. He reported this to us. Our maintenance staff responded to this and found a faulty shower valve. (The bathroom is behind the closet) Maintenance removed the affected drywall, replaced the valve and installed a dehumidifier. Maintenance returned the next day. The affected area was dry. They removed the dehumidifier and patched the wall with new drywall. When our maintenance staff told Mr. [redacted] they would return again to texture and paint the wall area where repairs were made, he told the maintenance person that he was in the process of moving out and would “prefer for them to wait until he turned in keys to do this.” Per his request, we waited. Furniture and carpet in the bedroom were not affected.

Depending on the insect, there may be some preparation involved prior to the pest control technician's arrival to ensure maximum results. Mr. [redacted] signed up for Pest Control service twice during his residency with us of one year and cancelled service both times. On both of these occasions, Mr. [redacted] reported “spiders and ants” being the insect/s he wanted to be treated for in his apartment. Roaches were never mentioned to us by Mr. [redacted].
Preparation for these two insects (spiders and ants) includes removing personal items from all kitchen and bathroom cabinets and drawers. A resident is also requested to wipe these areas down once personal items are removed, prior to the technician's arrival. Residents are informed that they will need to be out of the apartment once treatment is rendered for a period of four hours. This is the extent of preparation involved on behalf of the resident. Preparation for roaches is exactly the same as prep for ants and spiders.
Disputes regarding turnover obst/scan be avoided in many cases by schedulingapre-move out and/or final inspection of the apartment prior to vacating the premises. These inspections are offered to all residents at the time they give notice to vacate. In this case, neither inspection was requested.

Disputes regarding turnover obst/scan be avoided in many cases by schedulingapre-move out and/or final inspection of the apartment prior to vacating the premises. These inspections are offered to all residents at the time they give notice to vacate. In this case, neither inspection was requested.
The turnover cost/sinvolved with this matter are strictly based on the condition in which the apartment was left upon returning possession to us with the return of keys.

Riverview Springs is stating that the stains on the carpet were not caused by the water damage and mold. As stated Riverview Springs maintenance did come and fix the pipe along with dry out the apartment but they did nothing to remove the mold. The red statins that are referred to are stains on the carpet from the furniture bleeding because of the water damage that covered the carpet. Any other stains that occurred would be from cleaning the mold out of the room since I have two children under the age of two that could not live in a mold filed home.
 
The repair to the wall was not requested by me until after we moved out but I did ask for the mold to be cleaned out which they never came back to do. For the safety of my family we had to clean out the black mold ourselves. the fact that several piece of furniture across the room had to be thrown out because of the black mold should show how the water did more damage to the entire room not the single location that Riverview is trying to claim.

Review: Upon moving into Riverview Springs Apartments I made it clear I did not want to live in a unit with roaches or in a pet friendly building. Management made it very clear they did not have roaches and there would be no animals in our building. The unit I moved into has roaches and 2 dogs living next door. I contacted management the first day I moved in and my unit is currently getting sprayed for roaches every two weeks which is disgusting and a huge inconvenience. The problem is still persisting and it has been over 40 days. I also contacted management to report the two dogs next door and management continues to say they cannot do anything until they see them personally. I call every time the dogs are on the balcony and still nothing has been done. I am allergic to fleas and recently found out I am allergic to cockroaches so my health is suffering as well as my day to day living environment. I requested information to contact the owner of the complex and management refused to give me any information.Desired Settlement: My desired outcome would be a refund of $1800 to makeup for January's rent living with roaches and 2 dogs. If I was aware of these living conditions I would have never signed a lease for these apartments.

We would like to apologize for the inconveniences this Resident has experienced. We would like to first address the dog issue. Riverview Springs is not a dog friendly community, however, we do adhere to State and Federal Law. Under federal law 42 U.S.C. § 3604(f)(3)(B) it is illegal to refuse to make reasonable accommodations to impaired tenants. The Department of Housing and Urban Development declared that a landlord’s waiver of its “no pets” policy to impaired tenants with companion dogs does in fact constitute such a reasonable accommodation. Further, Section 504 of the Rehabilitation Act of 1973 and the Federal Fair Housing Amendments Act of 1988 require that disabled individuals be given equal rights to housing that is also offered to those without disabilities. With that being said, the dogs that have been seen at the property have proper documentation and must be accepted as companion animals. In regards to the pest issue, our Assistant Manager, [redacted] did inform the corporate office that the apartment has been treated multiple times and to take it a step further we are going to treat the apartments surrounding the Resident’s apartment to ensure that the issue has been resolved. Additionally, [redacted] did offer to release the Resident from her lease without penalty on February 8th. On Friday, February 12th the resident stated that she was happy with the remedy decision to have all surrounding homes treated for pests and she also informed [redacted] that she did not want to move or be transferred to another home at this time. In regards to the dog issue, I was informed by [redacted] before move in that building [redacted] was not a pet friendly building. I asked not only once, but several times. Also, the residents with the dogs were already living in the unit before I moved in and if they had the proper documentation required by Section 504 of the

Rehabilitation Act of 1973 and the Federal Fair Housing Amendments Act

of 1988 management should have been aware and informed me before moving in that dogs were living there. In regards to the cockroach issue, finally after having to contact the Revdex.com management has decided to spray the entire building, which I requested before contacting the Revdex.com and was told that was not possible. [redacted] did offer to release me from my lease but I was not offered to be transferred to another unit. Is management going to be responsible for moving all my belongings into another unit or is this something that will just be another inconvenience for me? Before contacting the Revdex.com I did request the owner of the complex's contact information to write a

formal letter and was denied any information which seems unethical after exercising every other option. Ultimately, I would not have moved into this complex if I was aware of these issues. Management at Riverview Springs is giving the public false information regarding living conditions of their complex and should be responsible for disclosing this information before tenants move in. I still feel a refund of at least one month's rent should be given in order to resolve these issues.

I spoke with [redacted] on Friday, February 26th over the phone and offered a complimentary apartment cleaning and carpet cleaning for the inconvenience or a $250.00 rent credit towards March 2016 rent. She told me she needed to discuss these options with her roommates and she would get back to me on her decision on Tuesday March 1st or Wednesday March 2nd.
