I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me

On April 1, 2015, [redacted] came in to give her notice to vacate. Her lease had expired on February 3rd, 2015, so she was on a month-to-month status. She signed the lease agreement on January 31, 2014 which states that a 60-day written notice is required on a month-to-month status-this...

sentence was underlined at the time of signing, and her initials are on the bottom of the page acknowledging this requirement. She filled out and signed her notice to vacate form and stated that she would vacate the apartment on May 31, 2015 per the lease requirements, therefore also financially responsible through May 31st per the lease. Her apartment was then made available for rent, and it was rented on April 7, 2015 for June 5th move in, based on her move out date listed on her notice to vacate form. [redacted] then turned her keys in on April 29th, but her apartment was rented based on her written move out date, therefore no refund would be due. Her apartment leased within 6 days of her written notice, so River Walk acted accordingly leasing it in a very timely manner based on the dates she provided to vacate per the lease. It would not have shown available online since it was already rented within 6 days of her providing written notice. In regards to the information provided for a landlord verification, we simply provided the dates she listed on her notice to vacate form as her lease responsibility dates. We cannot modify the lease for her circumstances to only accept a 30-day written notice, and require all residents to comply with the lease terms in the same manner.  At this time, River Walk stands behind the lease Ms. [redacted] signed and agreed to the terms, and will not be issuing a refund based on her acknowledgement of the lease requirements.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Policy or not it does not take 30 days to put money back onto my card from their bank to mine...they claim this because 350.00 yeild some interest when combined with how many other possible remnants...they need to immediately put my money back onto my card account....they dont have to use their PayPal account they can use their bank account...since they denied me I should not have to wait...for my money..they insist on mailing it to me then they can cut me a check today and can mail it to my local address which is [redacted]

Mr. [redacted] applied to live at the Riverwalk on 9-20-2014. On that date he put down a holding deposit for an apartment in the amount of $350 via credit card plus a $10 convenience fee. The signed application by Mr. [redacted] does state the following information "If the application is...

denied, the holding deposit will be mailed to the address provided on the front of the application within 20 days of the Riverwalk at Salem deposit of said funds." By signing the application Mr, [redacted] did acknowledge he was aware of the policy. We have issued a refund back to his credit card in the amount of $347.40 on 10-1-2014,we will be mailing a check in the amount of $12.60 to his address listed on the application. PayPal will not allow us to credit back the fees that are charged to our company. Our company clearly stated our policy to Mr. [redacted].
I have included a copy of the signed lease agreement and the PayPal refund receipts.

Review: Applied to rent an apartment here and was told everything ok,, but ended up being denied based on prior false information. They informed me that I would get my deposit of 350 dollars back but in 21 days. This is unacceptable because I was denied the apartment. Immediately they need to cut me a check or return the money to my account to plus the convenience fee.Desired Settlement: They need to refund my deposit of 360.00 which includes a convenience fee of 10 dollars, plus I believe they should also refund my application immediately not in 21 days..this policy is not posted anywhere or advertised so they need to refund my money within the next 24 hours since they have denied me access to the apartment.
