grass, weedeating  grass, cutting down trees, removing shrubs, removing trees by the roots.There were also xtra jobs that [redacted] asked if I had time to get done like cutting back her yucca tree which I did.  I told [redacted] that I charge 65 dollars per hour plus tax and she told me that she only had a 500 dollar budget. The state of Washington requires sales tax for any clean up labor. This gave me a time range of 7 hours of labor. I worked until my 7 hours were up and I was finished. [redacted] called me and asked me about two shrubs that weren’t removed and I drove out to her house and showed her that I did remove them. I than told her that I worked till my 7 hours were up. She showed me a patch of grass in her backyard that she wanted mowed. She told me that she would pay me more money to come back and mow it and cut back one extra tree. Just by [redacted] telling me this statement confirmed that my job was complete. I told her not to worry about it and that I would come back for free and take care of her two wishes. I did come back and took care of [redacted]’s two extra jobs even when she asked if I wanted more money. About a week later [redacted] started getting out of control and wanted me to come back to her house and do all kinds of extra work past my 7 hours for free. She was trying to change our agreement. Now she wants me to give her $400 dollars back. I made an hourly rate because its hard to tell how long a job with various assignments will take. Now [redacted] is writing me up on Yelp on other sites and wanting me to give her money back for a whole days worth of work. I was so tired I had to sleep the whole next day. If she was so unhappy with the job than why did she pay me the day I was finished? She could of told me this is not going to work and cancel her check that she gave me. Why was it a week later after she paid me that she starting going hysterical and writing me up on Yelp trying to defame me. I have 100’s of customers that are happy with my work. They know I don’t try to cheat people. I have about 1000 jobs per year and have been in business for 6 years. Why are so many people happy with my work.

I am rejecting this response because:04/05/2017 at 6:04 PM:  I called and spoke with Mr. P[redacted] about obtaining an estimate for lawn work and possible junk removal.  I requested an appointment with him to come to my home. During this conversation, I informed Mr. P[redacted] my budget was $500.00. During this conversation, we scheduled to meet at my home on 04/06/2017 between 5-5:30 PM.  04/06/2017 about 5- 5:15 PM: Mr. P[redacted] arrived at my home to do the estimate as requested.  I explained that I needed yardwork/winter clean up done due to my mother was coming from out of state to visit later that month. I walked Mr. P[redacted] around my yard to show him exactly what I was requesting and pointed out everything I was requesting to complete.I explained to Mr. P[redacted] I only had a budget of $500.00 and could not go over that amount.  I informed Mr. P[redacted] that I would need to hold off on the junk removal since my first priority was my lawn and did not feel I could get both services within my budget. The following is what I was requesting to have completed:-Mow the front, side, and small back strip yards -Trim/edge lawn the front, side, and small back yards-Removal of three small shrubs that were dead and dying in the front yard-Removal of a branch on a young Aspen tree that was broken due to previous snowstorm this year: (When showed this Mr. P[redacted] the both tree branches he stated that it would take five minutes to remove and it would be easy to remove)-Removal of a young Vine Maple tree branch that was broken due to previous snowstorm this year: When showed this Mr. P[redacted] the both tree branches he stated that it would take five minutes to remove and it would be easy to remove)-Removal of tree less than three feet tall that fell over to previous snowstorm this year: (I had cut back all of three feet of this tree. When showed this tree Mr. P[redacted] kicked it with his foot and stated that it would be easy to remove since it was almost out of the ground)-Blow off the leaves off the back patio -Removal of the dead hop vines on the side shed-Rack out flower beds located in front yard of house only-Trim only the branches of a tree that was on the corner of my driveway in order to pull in without scraping the top of my car. (Note: The branches I requested to be trimmed were less than ¼ inch wide, hung over the corner of driveway by no less than one foot)-Cut down two ornamental White Pompas Grass plants (not Yucca trees as Mr. P[redacted] indicated in his response and previously to me)During this walk through Mr. P[redacted] noticed the moss on my shed's roof and stated that he had moss killer at his home and could apply that to my shed's roof. (I assumed this was a courtesy and included in my job/estimate request. I did not request this but he stated that he would do this for me.) I informed Mr. P[redacted] that he could dump all the yard waste in an area behind my shed in order to avoid additional dumping and transportation fees.  I asked Mr. P[redacted] if he could do the requested job on the budget I had of $500.00. Mr. P[redacted] gave me all indications that he could do the within my budget. He stated that he could out the next day (04/07/2017) to do this job. He did not mention any time limitation. Before he left I informed Mr. P[redacted] that the following day (04/07/2017) that the forecast was a bad wind, rain storm, and indicated to Mr. P[redacted] that he could come out the following week when it was forecasted to be better weather and he would not have to work in the rain/wind storm. Per Mr. P[redacted] he would check the forecast and call me later that evening to let me know if he would be able to make it the following day (04/07/2017). I informed Mr. P[redacted] that I could not be home when he did the yard work due to my work scheduled I asked how to make payment. Per Mr. P[redacted] he could take checks or credit card payments.  I informed him that I would write a check and he agreed to that form of payment.  He requested I leave the check on the day he would come out to do the job since I would not be available for payment to him in person. I agreed and stated that I would leave it under my front door's welcome mat.  At the time of this estimate appointment Mr. P[redacted] did not offer or give me a written estimate. 04/06/2017 at 8:27 PM: Mr. P[redacted] called to inform me that he would come despite the forecasted wind/rain storm on 04/07/2017.  I again stated to him that he could wait until the following week since it was forecasted better weather and he again stated that the next day would be fine. 04/07/2017 at 7:37 AM: I called to Mr. P[redacted] to verify that he was going to come out to my home and he stated that he was and was currently loading his vehicle as we spoke. 04/07/2017 at about 5:30 PM: I returned home that evening and saw that Mr. P[redacted] did not complete all of the job he agreed to do on 04/06/2017 during our estimate appointment. Mr. P[redacted] did not complete on 04/07/2017:-Mow small back yard strip-Trim/edge lawn the front, side, and small back yards-Removal of three small shrubs that were dead and dying in the front yard-Remove the leaves he blew from the back patio onto the small back yard strip and left them there-Removal of the dead hop vines on the side shed-Rack out flower beds located in front of house only-Trim only the branches of a tree that was on the corner of my driveway-He did not add the moss killer to the shed’s roof as stated he would The jobs Mr. P[redacted] did complete on 04/07/2017:-Mowing of the front/side yards-Blew the leaves from the back patio (however he blew them on the small strip of yard in the back and left them there)-Removal of a branch on Aspen tree -Removal of the Vine Maple tree branch -Removal of tree less than 3 feet tall -Cut down two ornamental White Pompas Grass plants (not Yucca trees as Mr. P[redacted] previously indicated to me eariler and in his response)The receipt that Mr. P[redacted] left indicated that he worked for seven hours.  I was confused since he did not inform that I would be paying by the hour with a time limit.  Also, listed on this receipt were jobs I did not request (Junk removal, yard waste removal, pressure washing, painting, gutter cleaning, moss removal, fence repair, moving, window washing).   04/07/2017 at 6:20 PM: I called and spoke with Mr. P[redacted] asking why he did not finish the job he agreed to do and paid to do. I informed him of the things (listed above) not completed as he agreed to do.  He indicated that he would be right over.  Mr. P[redacted] arrived at my home within 10-15 minutes of my call.  When Mr. P[redacted] arrived, I showed him the missed jobs he agreed to do on 04/06/2017. As we were doing the walk through he stated that he did not have the time within the seven-hour budget to get everything completed. I informed him that he agreed to this job within my budget and that he did not mention there was a time limit and hourly wage.  He stated that he would need more money since he completed his seven hours in order to complete the job he originally agreed to do. I again informed him that my budget was $500.00 and nothing more.   When I showed him the back yard with all the leaves he blew onto it as well as he did not mow it he stated to me that he “forgot” since I was asking for a lot for him to do. I showed him the three small shrubs he was to remove. He then showed me that he cut them out of the ground but put them back in place in their original spots. He stated that they were still alive and thought I may want to keep them even though I requested them removed.  I again explained to him that this was a part of the job we had spoken about and he agreed to do on 04/06/2017.   He gave me the impression that he would come back out to complete what he did not do. He then indicated to me that he would return on Tuesday 04/11/2017 since the weather forecasted to be sunny.  I agreed.   I never offer Mr. P[redacted] more money to do the work he did not complete as I had told him on numerous occasions that my budget was $500.00 and nothing more as I was on a very strict budget and could not afford any more than he agreed to do.   However, as Mr. P[redacted]  was leaving I did state to him that if he comes back out and completes this job as he originally agreed to on Tuesday (04/11/2017) that it may be possible later this year (after Summer) I may hire him again to do other work.  Never did I indicate or state in any form or fashion that I would give him more money to do this job he was hired to do on 04/07/2017.       04/10/2017: My check for $500.00 payable to RJP (check number 6079) processed on this date 04/11/2017 at 8:50 AM: I called Mr. P[redacted] to verify when he was going to go my home that day to complete the work.  He stated to me that he had already been out to my home and the job was completed.  I was surprised that he completed all that work so quickly. 04/11/2017 at about 6:00 PM: I arrived home and noticed that Mr. P[redacted] did not complete anything but trimmed the branches of a tree that was on the corner of my driveway. Nothing else done as he indicated earlier on the telephone with me that morning.  04/11/2017 at 6:53 PM: I called and spoke with Mr. P[redacted] asking why he did not complete the job. He stated that he had that he had come out and did what I asked.  I informed him that the only thing he did was trim the small branches over the driveway and nothing else.  He indicated that he used his weed eater and did the backyard.  I informed him it looked same as it did on 04/07/2017. All the same spots where he blew them and the grass not mowed. He then asked me if there was many leaves left in the back yard.  At that point and by that comment it indicated to me he never went into the back yard and he did not do what he stated that he did he did. I stated to him that in fact there was and that during our conversation I was currently raking those leaves into piles.He again stated he wanted more money to complete this job and again I informed him that was not going to happen. I informed him that he was paid $500 and that would be all he would get. I told him $500 is a lot of money and that I did not receive $500 worth of yard work he agreed to do. I had to end the call due to my frustration and that he was not being honest with me. 04/12/2017 at 7:12 AM: After the last night conversation, I again called and left a voicemail requesting a call back and that I was demanding that he complete the job he I paid him to do. 04/12/2017 at 8:30 AM: Mr. P[redacted] returned my call as requested.  Mr. P[redacted] was somewhat flippant and arrogant during this conversation. He stated several times that he reached his seven-hour limit and would require more money to do the job. I again stated to him as I had in all our previous conversations that my budget was for $500.00 and that he agreed to this budget as well as all that I had requested he do on 04/12/2017.   I again stated to him that I was not aware of the time limit until after 04/07/2017  (per the receipt he left).  I also told him that he did not call to inform me that he was not able to complete the job base on this time limit.   During this 21-minute conversation, I informed him that I was not satisfied with the job and that he did not do the job he agreed to and paid to do. He stated that I was like one of his other customers that was not satisfied with his work and kept calling him out to re-mow his lawn shorter. I informed him that it may be his job practices and not customer complaints the as the reason they are not satisfied with his work. I again reminded him that he agreed to take this job and for the amount offered. I again requested he complete the job. He stated he would only complete the job if I paid more money due since reached his time limit.  I again told him I would not pay more. I again informed him that I was not aware nor did I agree to the time limit he set in place after he agreed to do the job on my budget. He stated he would only complete the job for more money since he reached his time limit. At that time, I ended the call. 04/12/2017 at about 5:00 PM:  I created reviews with photos Mr. P[redacted] and his business regarding the poor job he did on my yard. I posted the same review with the same pictures on the following websites: Yelp, Angie’s List, and Yellowpages.com. I did this so that the next customer will be aware of his business practices. 04/12/2017 at 6:40 PM: Mr. P[redacted] sent the following text:(1/3) U need to remember the first day when I went back over u looked at the back and u offered to pay me more money to finish since I hit the 7 hours. U offere(2/3) d. Now a couple of days later u get angry and write me up on yelp. U need to tell the truth and say I gave him a list of things to do and he did what he c(3/3) ould within his time limit. Tomorrow im going to take pictures of the jobs I finished and have my attorney examine your review for defamation. My text response:1. Not sure where you got the idea that I’d pay you more because as I have said to you today & Friday I had a budget of $500 & nothing more. I have told you more times I had a budget of $500!! You are lying that I’d offered more money because if I had you’d be at my house Tuesday doing the work YOU agreed to do on the budget I set. Yes I am upset because you did not follow through on what you promised to do & what you were paid to do!  Everything I wrote is true & I am sorry you can’t handle it. But You did not do as promised, agreed to & paid for. Very poor business practice.  I asked you today to complete the work YOU agreed to & YOU wanted more money.I do not want others to go through what I have had & not get what they paid for. You never gave me a list. As a matter of fact the receipt you gave me have erroneous things you claimed you did as a part of your 7 hours. I informed you of this when we spoke this more (morning). You sir are the dishonest one. That’s fine. Please have your attorney take a look. I too have pictures of the job you did as well. 04/14/2017 at 10:37 PM: Mr. P[redacted] sent the following text:Alright if u want just take off your reviews and ill return your 500 dollars tomorrow. All that work for nothing but oh well. 04/15/2017 at 11:23 AM: My follow-up text response:You can do one of the two following options:Come back on Monday 04/17/2017. Make the yards look nice and do the job you were originally paid to do:-Rake out & clean up the flowerbeds in front of the house & around the front yard to the Palm tree-Remove the leaves from both yards-Mow/edge backyard-Remove the moss on shed roof-Remove the dead hop vines on the side of the shedI will then replace the negative reviews with updated positive reviews along with pictures of the work you have done. OR You refund $400 of what I paid in cash only. You keep $100 for mowed front yard, leaves blown from back patio, 2 limbs from trees removed, cut down of the 2 Yucca plants, removal of small tree & 3 small shrubs, & trimmed tree on the driveway.  I will then update those reviews that you refunded me for the work not done as you had agreed to do originally. But I will not remove those reviews only update about the refund you gave. 04/15/2017 at 9:23 PM: Mr. P[redacted] text response:Na forget it than. My follow-up text response:Ok then. I did not cancel the check since I was given the impression by Mr. P[redacted] that he was going to return and complete the job on 04/11/2017. I did not think to do this as I took Mr. P[redacted] at his word that he would finish the job. Also, note that the check processed on 04/10/2017 and would be unable to cancel it on 04/11/2017 as it was processed.In addition, as you can see that I had tried several times to over the course of 12 days to get Mr. P[redacted] to do his job that he agreed to do and what I paid him to do. I did not wait a week as he stated in his response to this complaint and as Mr. P[redacted] indicated in his hostile response to this complaint as well as his earlier texts to me.
