I do
not accept the business’s response because it does not provide resolution for
any of the items within our Revdex.com complaint.
The items from our complaint that MrS*** has not resolved are
covered under the BIA Home Warranty Section and Section 5D. No items within our complaint are degradation
or wear and tear maintenance issues. I’ve
attached our email correspondence with MrS*** from the time we issued our punch list (8/19/14)
through 9/1/when we mailed MrS*** our certified letter (included in initial complaint),
which clearly indicates our struggles with MrS*** and his subcontractors at
resolving issues with our homeNumbered
items below correspond to the outstanding items within our initial complaint and explain each item in greater detail including the history and/or current status
The
following items are covered under Section 5D of the BIA home warranty, but have
not been resolved:

and #6. Drywall cracking, cracking along
stair wall and nail pops throughout house
MrS***
arranged for only the painting subcontractor to address drywall issues and did
not arrange for both the drywall and painting subcontractors (***). Painting subcontractor was unable to
correctly fix drywall cracking, cracking along stairs and nail pops causing all
areas to crack again. Also large area in
bedroom was started but not completed by painting subcontractorMrS*** attempted to contact a second
subcontractor (***) to fix these issues but gave up after being unsuccessful
The
following items are covered under Section of the BIA home warranty which are
related to construction defects, but have not been resolved

and #11. Severe floor squeak.
Mr
S***, *** *** (flooring subcontractor), ** *** (*** Engineering
Woods) and *** *** were present during inspection where the manufacturing
representative stated that subflooring (***) should be glued and screwed
down but only screws were used during installation and was not installed
to manufacturer installation proceduresMrS***’s flooring
subcontractor installed additional screws but didn't fix squeak. In
addition, the severe floor squeak issue was identified early in the building
process, prior to carpet installation and during final walk-through but never
properly fixed
Moisture around exterior windows
Concern
not investigated by MrS*** or subcontractors. No visible caulk applied between stucco/trim
or between stucco and exterior windows/doors

Master shower base not supported adequately
Weeks
Plumbing inspected shower base and stated that the base is not supported sufficiently
causing excessive base flexing and caulk cracking*** Plumbing did not fix
because the repair would involve additional subcontractors, which MrS*** did
not arrange.
5. Front door side light exterior trim cracking
Exterior
trim parts were covered under warranty and delivered to the house. Manufacturer recommends not painting a dark
color but was originally painted black.
MrS*** or subcontractors have not returned to install and/or paint a
lighter color as recommend by the manufacturer
7.
Carpet fraying
Mr
S*** and *** *** (flooring subcontractor) agreed to fix by binding
carpet. We gave *** *** an extra piece of carpet but *** has
not returned with the bound piece of carpet to install.
Tile crack
Mr
S*** and *** *** (flooring subcontractor) agreed to replace the broken
tile. We supplied *** *** with an extra tile to cut to size but
he has not returned to replace
9.
Vent hoods not installed on exterior vents.
Concern
not investigated by MrS*** or subcontractors. Exterior vents constantly opens and
closes anytime the wind blows causing banging noise throughout house. Exterior vents are not hooded or shielded to
reduce opening and closing
Toilet water leak
Concern
not investigated by MrS*** or subcontractors. Dripping noise can be heard on 1st floor
ceiling after flushing toilet.
12.
Laundry sink spits water when not in use
Concern
not investigated by Mr S*** or subcontractor and root cause is not determined
Pantry door interferes with floor
Door
frame was not install level causing bottom edge of door to contact floor and
will not open fully
Shingles lifting and causing banging noise with wind speed over mph
When
we contacted MrS*** about this issue he stated it was not a warranty issue
and said it may be covered under our Home Insurance if the shingles were torn
off and was inspected by the Union County Inspectors and was approved. We than contacted the Building Department to understand
our options and who is accountable to fix this issue. The Building Department contacted MrS***
directly because he was unwilling to fix or even investigate our concern. After that MrS*** and the roof
subcontractor inspected the shingles from the ground stating no concern was
found. No inspection was done from the
roof or during a windy day. Our neighbor
also noticed our concern during a windy day and took a picture of the shingles
lifting which was provided to MrS***.
Since no action was taken by MrS*** and we did not want shingles to
be torn off and cause a water leak, we hired *** Roof of Plain City, Ohio to
investigate and fix the concern. *** Roof investigated the roof and shingles and determined that some shingles were
installed overlapping, causing the asphalt to not adhere
properly. Shingles were cut to remove overlap and adhesive applied to shingles
All concern items above are warranted by the BIA Home Warranty (Section related to manufacturing defects and Section 5D related to drywall) that MrS*** has indicated in his response he will stand behind but MrS*** and his subcontractors have taken no physical action to resolve the issues above in a timely manner

I have been in the business for almost 40 years, and this is my customer from hell. Everything in his complaint is invalid or is not a warranty issue. His realtor was provided the warranty at closing which was issued by the BIA of Columbus. He refuses to acknowledge its existence as it pertains to...

this house. An example during a 70mph wind storm, he took a picture of a shingle lifting and flapping. After the wind, there was no issue. I sent a roofer up on the roof and he found no damage. During a rain storm, the stucco did not dry fast enough for him and he claims a water issue. I have had subcontractors in there to investigate, but they are either too busy or request that they do maintenance issues not related to their trade. They called the Union County Building Dept about the roof and they told him since the roof was new and the weather was cold it would take a while for the asphalt backing on the roof to reset. I have built multiple homes in their subdivision and have taken care of any issues that may arise. I have even written letters advising them to bypass their sump pump last winter, as the weather was so cold the drain tiles froze solid. This is the kind of person I am. I would honor any item on the BIA warranty within the one year issuances but they refuse to accept that. They want a full time maintenance man. They both have engineering backgrounds and they claim to be experts in the field. They are a handful!!!
