Ceiling improperly installed causing uneven surface, grout missing in certain areas, paint not touched up, job not fully completed.
Electrical was left unfinished behind the fireplace. We had to have the city inspector come out and look at it and they wrote a citation for unfinished electrical with wiring hanging behind the TV/fireplace. Unsafe and possible fire hazard. We had to hire an electrician to come out and finalize the job as well as rewiring some other components that weren't done correctly.
Recessed LED lights they installed in the garage room are defective. One had to be replaced already because the cover broke off. Now, the second light just had the cover fall off as well so we are going to have to buy new ones to have them replaced.
Added additional work of a bathroom remodel which is terrible with crooked tile, floor tiles that are not glued down properly, etc. Verbal contract with no written contract ever signed because our neighbor, who is one of the contractors, was going to perform the work under the table for us as a cash deal.
Cabinet door needs to be replaced. Ordered incorrectly twice and had to wait over a month to finally have them leave it on our front porch without notifying us they dropped it off. Now we have to hire someone to come and install the door and the hardware.
Laminate flooring they installed has a couple issues. One is that a joint is coming apart next to our island so there is about a ½" gap between the boards. There is also a joint that is not level with a jagged corner sticking up in the hallway. We have to get a flooring company to come out and repair these issues.
Still, the contractor states our job is COMPLETED?
Crown moulding we had picked during our Lowe’s design was changed without consulting us. Contractor decided the moulding we chose would be too expensive since it was hardwood so they thought it would be ok to just order something else without even discussing the change. The crown they chose had to be painted and it does not perfectly match the cabinets.
Pantry door was supposed to be ordered factory black. Contractor changed this without discussing with us and ordered it primed. Couldn’t get the paint to look right so now we have a door we are not satisfied with. We would like to have the door we chose ordered FACTORY BLACK.
We had to pay $3250 to have A/C installed in the garage room because contractor couldn’t get the ductwork supply to the room to push enough airflow into the room to cool it. They tried tying off other ducts in our house and forcing air to the garage which made our home uncomfortable and it still didn’t work. Part of our contract stated they would supply and install HVAC into this room. When we complained they told us “How cold do you want it to get in there? You want it in the 70’s?” Of course we would like to be able to have our workout room be able to be whatever temperature we like. They should reimburse us for the cost we had to pay since they did not fulfill this portion of the contract.
When installing new beams, the ceiling height slightly changed causing our master bedroom door upstairs to be taken out of level and significantly rub on the carpet. They had told us they would fix it but never did so now we have to find someone to come out and correct this issue.
Drywall repair patch in garage looks terrible and should be redone.
We don’t know if they ever fixed the a/c ductwork they had damaged when trying to install HVAC to the garage room. I know there were holes made and I don’t think they ever patched them.
Contractor took all copper piping from demolition without permission (not part of our contract)
I had to pay for landfill disposal fees of our own garbage because our contractor constantly filled up our trash and recycle bins with their own waste.
I have found numerous screws/nails in walkways that we had to pick up so we did not injure ourselves walking in our own home.
A large portion of our front lawn is damaged by them constantly trampling it and using their equipment on it.
Project was supposed to take 6 weeks and we have been dealing with hardships of living through construction for 6 months now, including having to eat out for months because we didn’t have a kitchen. One of them was constantly commenting about how they were losing money every day they were there working since this project was taking so long. Also would make comments about how he didn’t care how it looked because it “looked good from his house.” Also tried telling us the only reason the project took so long was because they had to wait for the cabinet to be replaced. However, they were there EVERY day for over 2 months waiting for the cabinet so I don’t know how the cabinet was what was holding up the project.
Contractor and his brother attempted to bully us to pay nearly 3 times the amount of our verbal contract price for the bathroom. When they didn't get their way, they began screaming and cursing at my wife and I and had to be told to leave. Completely unprofessional behavior which has now left us with an unfinished job. We will not allow them to ever come back into our home after the way we were treated. We felt threatened and very uncomfortable. They told us we had to pay them final payment immediately and they would make sure all of the touch ups and other unfinished items would be taken care of. Unfortunately for us, we paid them and now have an unfinished job with many mistakes and issues that need to be corrected.
We now have to hire another company to touch up the remodel and redo the bathroom as we do not feel safe having them in our home.
One of the contractors is also our neighbor and now likes to yell obscenities down the street at us if we are ever outside, completely immature and unprofessional.
We do not feel comfortable ever allowing them back in our house to correct these issues since we felt threatened by their aggressive behavior when they were trying to get us to pay them money.

To whom it may concern: We are responding to the complaint filed by *** on 4/24/2018. We have reviewed the complaint and will respond by providing an accurate response to each item including pictures, texts, and/or emails that correspond with each item. The final inspection was performed on 1/03/2018 and signed off by inspector ***. We requested multiple times for Mr. to provide us with a punch list to allow us to perform any work that needed touch up to be fixed if necessary. Mr. would not provide us with one. We did meet with *** and *** on February 12, 2018 to discuss Change Order #1 and any issues regarding the construction. Please review the following including the assigned attachments:

1. Mr. states that the ceiling was improperly installed which is false. The ceiling is 'A inch drywall installed over 2x10 ceiling joists that were shimmed to provide proper elevation. The finish coats and texture were performed by our subcontractor. Uneven surfaces are common with drywall installation due to the acceptance of the installation of joint compound at the edges of the drywall as they meet. The ceiling and walls were painted and the ***s were happy with the walls and ceilings. Mr. had shutters installed on his windows which created different lighting that creates different shadowing at different times throughout the day. We informed Mr. of our concern regarding this issue and asked if they would like us to have our subcontractor recoat the ceiling. *** elected to not have the ceiling redone. Please see attachment I a, lb and 1 c.

2. Mr. states that grout was missing in certain areas. He asked us to re-grout a few areas in the shower in his downstairs bathroom which was completed upon his request. Please see attachment 2 regarding tile backsplash in the kitchen.

3. Mr. states that the paint wasn't touched up. The paint was touched up multiple times. Mr. would not provide a punch list/touch up list which would have allowed us to understand if there were any additional items to be touched up. See attachments 3/a,b,c,d,e,f,g,h,I,j 4. Mr. States that the job was not completed. The job was completed and signed off on 1/03/2018 by the City of Rancho Cucamonga. See attachment

4. Warranty items were being addressed which was the oven cabinet. Per the text from Mr. on March 6, 2018 at 8:02 AM he wanted the replacement door in order for the project to be completed. That's the only issue that Mr. had with the project after our February 12, 2018 meeting. The replacement door needed to be received to do the installation. See attachment 4a.4b,4c.

5. Mr. states that the electrical behind the fireplace was incomplete. The electrical plug was installed and completed prior to installing of the fireplace. I spoke with inspector *** regarding this issue. He informed me that Mr. requested him to come out after hey already performed their final inspection on 1/03/2018. Mr. stated that as he was about to leave Mr. asked him to check behind the fireplace that he thought there might be a problem there. They had to pull the fireplace apart to get behind there. This is an item that would have been covered under warranty and/or punch list item if it had not been completed or installed. Mr. states that he hired an electrician to perform the work as well as additional items that were not installed correctly. All electrical items were installed and tested prior to receiving the final inspection which was signed off by the City or Rancho Cucamonga on 1/03/2018. All lighting and electical components had been operating since November of 2017. Broken LED lights which were approved by Mr. would also be a warranty item. If they came apart as stated then the manufacturer will replace them. ,Please see attachments 5a,b, and c showing the plug installed behind the fireplace. Please see attachments 5d and 5e showing the kitchen and fireplace completed.

6. Bathroom remodel:

A. The statement regarding crooked tile we assume is referring to the tile they decided to put on the angled ceiling within the shower after the walls and flooring were installed. He was informed on December 4 that the existing ceiling portion was not level or square. He stated to *** that he knows it is existing and that it's ok. We proceeded to complete the installation. See attachment 6a,b,c

B. Mr. states that the floor was not glued down properly, The floor was properly installed using thinset mortar. See attachments 6d,e

C. Mr. asked us to perform the bathroom remodel. He wanted us to provide additional pricing for the original contract but we were never informed of the items and finishes that he was going to want installed for the bathroom. We did not include it in the proposal or contract at that time. We were asked to track our time and that they would pay for some of the materials. They paid directly for the floor tile, shower tile, sink, faucet, light fixture and toilet. We paid for the shower system, grout, shower door, recessed lighting, countertop, vanity, shiplap, base, casing, drywall, texture, and bathroom door. *** is the neighbor who he is referring to. We do not do work "under the table". We are a small business and do not have time or can afford to perform work in that manner, *** is our Vice President. Please see attachments 6f,g,h

7. The cabinet door Mr. is referring to is a warranty item that had been replaced. The door wasn't ordered incorrectly. The manufacturer replaced the door and several others due to blemishes and imperfections. The referenced door came out again with a blemish and we were asked to replace it. The manufacturer sent the wrong door so we contacted them and they replaced it again. We were asked to place the door on the porch which we did. Mr. has a RING doorbell which contacts him when there is motion or someone rings the doorbell. We placed it on the porch as requested. The door can be installed at any time. See attachment 4b for Mr. request for the door to be left on the porch if they are not home. See attachment 7 and 7a for comments from Mr. regarding his understanding of the issue with the cabinet.

8. Mr. decided to reuse the existing flooring that he originally had in the home prior to performing the remodel. Mr. purchased additional flooring to complete the remainder of the kitchen area. We purchased the padding for the flooring. We were never informed of any issues regarding the flooring and it had all been installed by November 16, 2017. This would be a warranty/punch list item. Please see attachment Sa,b.

9. Crown Molding: Mr. and Mrs. decided prior to placing the cabinet order with Lowes Home Improvement that they wanted all of the crown molding to match. They did not want the crown molding for the cabinets to be different than the crown molding at the ceiling in the rest of the area. They chose the crown molding that they wanted from a list of them that we provided. Samples were also provided. Please see attachment 9a which is a letter from the LOWES representative Teresa Reyes who worked with the ***'s during the ordering phase. See attachment 9b, and 9d for the text from Mr.. Attachments 9c,d showing the options.

10. Pantry door: Mr. and Mrs. decided to change the type of door that was to be installed at the panty. The original door was to be a standard 6 panel door to match the existing doors. The ***'s decided that they didn't want to install that one. They elected to install a more expensive door. *** provided the ***'s with options for the door type they were requesting which was a 15 lite door. To order the door in black was an S week lead time which they weren't happy with. Mrs. informed us white or black would work. Mr. made the decision for us to order the white door. See communication with Mrs. on Attachment 10a,b,c,d. See communication with Mr. on attachment 10e,f,g,h,Ij and k where Mr. states to order white "she's not answering and making an executive decision".

11. HVAC system: Per our proposal included in the contract we were to add a duct for the added workout room in the garage. We installed the ducting. Mr. was informed that the temperature would be different due to the thermostat being in the house. They were concerned about the temperature because they wanted to use the room while the remodel was being performed. They elected to purchase a separate system for that room. We were never contracted to put in a new hvac unit. Mr. is well aware of that. Please see attachments 11a,b,c,d,e,f,g,h,I,j and proposal dated May 26, 2017.

12. Ceiling Height: The ceiling did not change when the beams were installed. The upstairs doors were checked for proper reveal before and after the installation.

13. HVAC ducting- The HVAC ducting was never damaged. We don't understand this comment. There was a hole placed in the closet upstairs where the ducting chase was in order to access it to see where the existing ducting was located. The hole in the closet was repaired.

14. Copper piping: The copper piping was thrown out with the additional debris that we constantly hauled to the dump and payed for during the construction. It is trash. Mr. had every opportunity to inform us if he wanted it.

15. Landfill/disposal fees: We constantly have a company truck removing trash and debris from our job sites including the job for Mr.. He did not incur any fees due to the construction from us on this project.

16. Nails/screws: The home was under construction and it was picked up and swept up daily.

17. Front lawn: See attachment17a,b,c. The lawn is not damaged.

18. Time of Completion: See Article 2 of the contract. The contract was scheduled for 13 weeks for the construction process. The permit was available to be pulled on 8/21/2017. The existing kitchen was dismantled on September 16,2017 and the new kitchen was completely functional by November 21, 2017. See attachment 18a.

19. Bullying: We have all text messages, emails, and contracts showing the contact between RL Payne Construction and *** and ***. We presented the original change order with itemized list to discuss with them on February 12, 2018. During our discussion the ***'s discounted the hours worked during the entire project stating that our company never worked more than 8 hours on the job. They stated that they have cameras to prove that our company was not there. RL Payne Construction welcomes the idea that video be reviewed to show the personnel working all hours to provide them with the work they were requesting. We have payroll records that can show that we were on their job performing their work. Mrs. called *** a liar about the records we kept and the conversation got heated between them. I asked *** to leave and we continued the conversation and agreed to a reduced amount of $11,000.00 which they gladly accepted. Mr. informed me that they would have payment right away. I maintained a civil relationship with ***. We spoke on two occasions briefly in person as well as text messages. I never had any contact with *** other than when she was on site at the residence which was rare due to her job. See attachments 19 a,b,c,d regarding final payment.

RL Payne Construction Inc. has tried continuously in detail to provide Mr. and Mrs. with the product that they desired. It is disheartening that the complaint has been issued to us. We maintained constant contact with Mr. in order to proceed without making any errors.

RL Payne Construction honors it's commitments and provides quality work for each and every customer that we work for. We strive to make every effort to make our customers happy. We followed through with that commitment in every step for the *** residence. RL Payne Construction Inc. will still honor the warranty work as stated in the contract. The desired settlement requested by Mr. is not acceptable. The credits provided in Change Order One were agreed on by both parties and has put us at a loss for this project.
