Complaint: [redacted] I am rejecting this response because: I don't feel the need to pay for a car when the can't find the issueI was advised from [redacted] to pay for the car and take it somewhere else to get it looked at then bring it back to them to fix itI asked him why he would give me a car back if they can't find the issue and he had no explanationI never said I couldn't pay for MayI told him I could I just don't think it's far that I'm paying for a car they can't seem to repairHe has not once gave me a loaner car or is willing to trade in the carI refuse to continue to pay for a car that cannot be fixed by the dealership that sold it to meI've had this problem since I got the car and each time I picked it up they lied and said they fixed itI was told they drove it in the rain too which was a lie because all this week it rained at 10pm to 2am and they aren't open at that time Regards, Monnarae Martin

Complaint: [redacted] I am rejecting this response because the information that has been provided in defense for this case is incorrectThe majority of the repairs were covered under warranty that is correct, however you forgot to mention with those warranted repairs comes a $deductible for customer payStating that I have only paid for two repairs is completely incorrectI am not quite sure where that information is coming from, but I will be more then willing to send all repair orders in for documentation purposesOut of the different visits to the dealership there have been over several repairs on each occasionMy total out of pocket expense is well over $for this vehicleTo state that $is all that was paid is a complete insult to my knowledgeMy total in deductibles increased past $1,200.00; I know because I signed paper work for that stating this which had been added to my loan/monthly paymentsWhen attempting to re-finance my vehicle at UFCU I could not do so because at the time there was an extra $that needed to be paid to Texas Auto Center for the previous vehicle repairsSo this $estimate that was brought up is completely false I am aware when purchasing a used vehicle certain future repairs may arise due to wear and tear, however repeated repairs to the same conformity, repeated visits to the dealership, missing time from work, repeated deductible payments without fixing the mentioned concern is not standing by your "warranty." I did mention breach of warranty previously, because my vehicle is not being repairedWhy would it take over different visits within months for proper repairs to be completed? I just got my vehicle back from the dealership today after another $3,in repairsThe repair order states "the vehicle ignited" which means vehicle caught fire and had to be towed to the dealershipMy engine just went through a rebuild and the complete steering assembly and system had to be replacedFinally the warranty did cover the "complete" repairs without a deductible since this is my 5th visit for the steering system on the vehicleOther repair orders stated the steering concern could "not be duplicated" which means the vehicle was "operating as designed." If the vehicle was operating as its intended to it would not have "ignited" catching fire in the bank parking lotThe fire department had to be called to the scene because of the excessive smoke and the fire hazardLike I have stated this vehicle is no longer safe for me and my family to drive and I will not accept the response to my complaintYou did not deliver a resolution regarding my request for a release of lien and a refund of my down payment Regarding my visit with the [redacted] on 3/24/If this is the "best he can do" it explains exactly why I am in the predicament I am in nowMocking a customer who has been nothing but completely professional regarding the matter is not "doing the best he can do." We regret that we have been unable to satisfy Mr [redacted] A refund remains impossible since he has no equity in the vehicle; however, since Mr [redacted] remains unsatisfied we are willing to purchase the vehicle from the finance company for the payoff balance in spite of the lack of equity on the noteIn doing that Mr [redacted] 's credit will not be impacted negatively in any wayIf that option is of interest to Mr [redacted] please have him contact TAC Acceptance at [redacted] to coordinate the return of the vehicleOtherwise, as stated in our previous response we must stand by our warranty and will do our best if/when any additional repairs or maintenance are necessary

I am rejecting this response because the dealer still has yet to assist me regarding my requestYes, I did purchase a used Buick LaCrosse CXL with approximately 87,miles on March 15, A Carfax report was received and there was no information on the reportEven then the CarFax report can only show what is submitted to the insurance company to show the previous recordsVehicle was test driven for a limited amount of miles since the dealer leaves all vehicles under a quarter tank of gas therefore only a certain distance can be drivenVehicle started exhibiting concerns shortly after purchase and came back before the day period for major repairs. I want Texas Auto Center to know that I understand the warranty that applies to my vehicle is a great benefitThe warranty was the main reason I purchased the vehicle since certain components would be covered during the loan parametersI am also aware that when repairs are completed on a vehicle "under warranty" a consumer should not have to return to the service department to times within a year for the same concernAt that point the warranty is now "breached" and no longer relevant since the repairs that are being done and deductibles that are being paid is not rectifying the issueAgain my vehicle has returned to the service department EVERY month if not TWICE in one monthI am not for sure what else to say to express that this vehicle is not safe, will continue to break down, and should not be on the road. I am not concerned about the case being discussed with the staff and I do not care for your apologiesI picked my vehicle up on 4/15/and the dealer stated on the last review that the vehicle would be returned in "perfectly working condition." Unfortunately once again the dealer is not standing by their word, and the vehicle is rattling, shaking and vibrating down the highway even after the $3,in repairsI do not drive over 65MPH because the vehicle feels as if the new axle that was repaired is going to fall off at any momentI do not have the time to drop the vehicle back off to the dlr since I have lost so much time out of work due to the last 15+ repairs and visits.
I do not believe that you do not understand what I mean by the request for a refundI will like my money back for the down payment that was placed on the vehicle and for the "loan" to be released from my nameI am aware that Texas Auto Center can do this since it was done previously for other vehiclesI have paid on my vehicle for year and months and have paid over $5,on payments not considering the $2,down and the deductibles I have paidHow much "equity" does the dealer need to assist a consumer who does not feel safe in a vehicle which "ignited" on the previous repair. I will not be returning the vehicle for a "payment forgiveness" because that means a repossession will be on my credit and I will NOT allow that to happen.

Ms***'s vehicle is at our San Marcos lotWe have been unable to replicate the problem she describedWe have experimented with both high pressure water spray and low pressure spray and low pressure spray left of for an extended period of timeThe car was purposely left outside during this
past week's rain stormsWe have even contracted an outside glass repair company to inspect the carAll attempts have failed to cause leaks into the cabin of the vehicleWe have been in touch with Ms*** about the status of her vehicle and will perform any repair we can identify, but so far none appear necessaryUnfortunately, and of particular concern is that Ms***'s note is in significant defaultShe has not made April's payment and indicates she cannot make that payment or the upcoming payment for MayWe regret that we are unable to release Ms***'s vehicle back into her possession until such default is cured with the finance company

I am rejecting this response because:No one from Texas Auto Center has contacted either Patsy, nor myself, concerning this offer from the businessAfter talking with the towing company, I understand the vehicle is still in MichiganI also understand that after speaking with ***, the person making the repairs and towed the vehicle, that repairs would cost $with an additional $for impound fees and towing and that the insurance company had already taken the vehicle and repaired the damage to be sold at auction*** has already overpaid for the vehicle with this bogus insurance scam for over $This means the car company has made 1: The down payment and all subsequent payments since May 2, 2: All bogus insurance payments since May 2, 3: Proceeds from auction4:Insurance money for totalling vehicle from on-site insurance companyI do not think it is fair to *** who has not missed a payment since May 2, to pay anything except her regular $monthly payment and WE will get the insurance for the vehicleSince there was no obvious benefit from having the vehicle "insured" though TACIf the vehicle was "properly insured", all the money I spent getting home from Michigan and subsequent additional rental vehicle costs would have been reimbursed with no problems.

We regret *** *** has had an unpleasant experience with our dealershipHe is correct, we have performed a series of identical repairs on his vehicleUnfortunately, the "check engine" problem persists"Check engine" sensors in late model General Motors vehicles can be troublesome on occasion
All repairs thus far have been covered under the warranty at no cost to *** ***Additionally, he has been provided a "loaner" vehicle to minimize any inconvenienceAt this point we have reached out to *** *** and have forgiven the note on the Chevy EquinoxHe has selected and purchased a different vehicleEvery effort has been made to accommodate *** *** and we trust that he is now satisfied with the new vehicle

Ms*** vehicle was wrecked in Michigan as Mr*** points outShe has been paying on single interest collateral protection coverage for some timeThis coverage is purchased by the lien holder when a customer does not have the vehicle covered by standard property coverageThis coverage
does not include impound or transport feesWe cannot file a claim and fix the car if it cannot be returned to our areaWe originally asked that Ms*** cover the cost of the impound and subsequent transportIt seems that this is not possible for themWe value Ms*** business and have offered a compromiseif she can reimburse the impound fees and cover the deductible we will sell her another vehicle and dispose of the wreck at an auction in MichiganShe has agreed and we expect all to be well at this time

note. A copy of that contract would have been provided to him; however,
we are more than happy to provide

This is in further response to Ms*** and Mr***'s complaint regarding their wrecked car and the CPI coverage we purchasedWe regret if we were unclearThe coverage has been purchased by the lien holder in lieu of conventional property coverage, comprehensive and collision, colloquially known as "full coverage"The contract Ms*** and Mr*** signed at the date of purchase provides for the cost of such CPI coverage to be transferred to the buyer(s) can purchase "full coverage" and the CPI would be removedThe CPI coverage is limited to only protecting the lien holder's interest in the vehicleIt has no provisions for towing, impound, rentals, or liabilityWe recognize this situation has left Ms*** and Mr*** in a difficult situation and we are willing to compromise and allow them to purchase a new vehicle if they can cover 50% of the sales taxA minimum of $down will enable them to purchaseWe have spoken to Ms*** on several occasions and she is aware of this offer."

Ms. [redacted] purchased the 2003 Infinity G35 on 4/18/2015. The sales price was $12,999 not $19,000 as she attests. The confusion may be in the finance charge. Finance charge/interest is a function of time and yes the total sum of payments, including the finance charge over the 3.5 year term is...

$18,418. At any point Ms. [redacted] can pay the note off early or seek refinancing  elsewhere at a lower rate and avoid much or all of the interest. Ms. [redacted] executed the contract at point of sale with all terms fully disclosed. We do not understand why she would submit a complaint 5 months later when we have no opportunity to to undo the sale. While there is no applicable right of rescission on the purchase, had she said something on or about April 18th we would have been open to unwinding the deal. Additionally, Ms. [redacted] has purchased several cars from us, all sold under the same business model. It is unclear why she is taking exception to this purchase only. With regards to Ms. [redacted]'s comments about Kelly Blue Book, Kelly Blue Book is merely an appraisal tool for consumers and has no regulatory authority over the market. I am rejecting this response because: once again I did not purchase a fuel cap from you and you stated you don't have my signature but yet you know I came and got it?that makes no sense, why would I drive 120 miles round trip to get something I can get down the street? 2nd what I do and how I drive my vehicles has no bearing on what I should do. Truth be told I have 4 vehicles and thats the only 1 I had problems with. When I tried to drive it out of town that is when I actually noticed the severity of the problem. You wouldn't notice major problems with in town driving because the vehicle wouldn't be on long enough. This whole mess started when TAC refused to look at the vehicle when I started to notice things, that is also documented. While you refute it happened the way I stated I know that you record such calls. I was on the phone twice with 2 different reps from seperate facilities that relayed the same message.Someone has to stand up for the consumer and that is me, I have had it with the consumer being stepped on with red tape, I will not be silent on the matter. I don't care if I don't win ie: (my down payment back). News outlets and the newspapers are awaiting my story and the stories of others that I have on standby.All I hear is excuses and finagling. Like you said I had a 2yr 24k warranty, I signed a 1yr 12K. At any time you could have told me I was still under warranty and you say I was 710 over the 12k, why does that matter if it's 24k, what is the reason being of bringing that to the forefront. I am looking at my papers now, and it was a $2000 down payment. I thought $2500. My bank paid you 16k for a vehicle worth $6500, you made 10k on the deal in lieu of the 2k I gave you. That's 12k profit and you don't see fit to give me back my 2k? I am not a valued customer, I wasn't afforded that respect. I'm tired of the back and forth, what are you going to do? I will proceed if you do not give me my money back. I still have bigger problems ahead trying to salvage my credit behind this deal. It's not even a fair deal for me, I am trying to settle so I can move on. This isn't extortion or blackmail, help me move on or I will go public about your practices. My patience and reasonable goodwill has expired, that we certainly agree on

Mr. [redacted] purchased a 2008 Honda from our sister dealership TAC Autogroup in December 2013. TAC Autogroup only sells cash or outside finance deals. It seems that the original paperwork was prepared as a cash transaction when in fact Mr. [redacted]'s check was from a bank which would need a lien...

holder listed on the title. The title had to be corrected in the months following the sale. We regret the error. The [redacted] of TAC Autogroup has reached out to Mr. [redacted] this week and offered reimbursement for the fees associated with correcting that error. Mr. [redacted] agreed to receiving a $70.00 refund check to cover the re-titling fees. With respect to Mr. [redacted]'s concerns about the condition of the car upon delivery, TAC Autogroup prides itself on providing a high quality sales experience we regret that may not have been the case in this circumstance. They will be providing an oil change free of charge at Mr. [redacted]'s convenience. At this time we believe all concerns have been addressed.

To state that $600.00 is all that was paid is a complete insult to my knowledge. My total in deductibles increased past $1,200.00; I know because I signed paper work for that stating this which had been added to my loan/monthly payments. When attempting to re-finance my vehicle at UFCU I could not do so because at the time there was an extra $980.00 that needed to be paid to Texas Auto Center for the previous vehicle repairs.
