Please be advised that I represent Dan Young Chevrolet, 875 E. [redacted] Street, Tipton, IN in regards to the aforementioned complaint. Mr. [redacted], a resident of Minnesota, purchased a 2007 Acura MDX from Dan Young, 875 E. Jefferson Street, Tipton, IN on April 21, 2015. I have enclosed a copy of the bill of sale for your review. The third-party licensor to this transaction was cargurus.com. My client affirms it did not mislead Mr. [redacted] and complied with all state, federal and commercial laws in the sale. [redacted] First, Cars.com is the site that I used to view and purchase the vehicle. You ( Dan Young ) conveniently are suggesting that CarGurus is the site that supports there claim of no wrong doing, because CarGurus destroyed or removed the info from online and or is conveniently not supplying the info. Once again, the dealership and their representative is ignoring the evidence presented from Cars.com indicating in writing from the options list that the vehicle had a navigation system. Also, the pictures that I submitted showing an obstruction in the area where the navigation is located clearly indicates deception. Terry Click specifically responded to my telephone inquiry about the navigation system, but, again is conveniently denying it. Dan Young GM also requested that I pay them directly the Minnesota sales tax on this vehicle , in which I did, which it is clearly stated in the amount of $904.00 on the bill of sale, and to this date, I have not received that money so that I can pay Minnesota state taxes and register the car in Minnesota.  Are you going to deny this also. It's obvious that Dan Young Gm and its associates are accustomed and very well versed in this type of deception. I expect a full refund, plus shipping cost and insurance premiums that I have paid to date for their deception.  If need be, we can take this to the next level and I will be asking for extensive and punitive damages, as well as posting this ordeal on social media to expose Dan Young GM and its associates in this deceptive scheme and cover up.  I also see that there is no mention of the deceptive picture I presented or Cars.com options list referencing a navigation system. I didn't just make this up, the pictures are actual photos taken by Dan Young GM and the options list(from Terry Click) clearly states the presence of a navigation system. What is your response to these to items in defending Dan Young GM doing nothing wrong?? I am simply asking for a refund and return of the vehicle at Dan Young's expense, so that closure can be had and we can move on.

I spoke with [redacted] or [redacted] on Friday morning, May 8, 2015 and around 4pm and was told that the advertisement never had any documentation that listed a navigation system and that if I could provide them with such documentation that they would refund my money.  At the time I did not...

have the proof, but I recalled seeing it and I had asked Terry Click at least three times over three conversations about the nav system and he indicated that the vehicle indeed had a nav system.  I asked T.C. this because there was something obstructing the view of the nav system, as is clearly indicated by the photos on row two, second picture from the left. Also, my bank sent the money on April 24, 2015 to the dealership, they insisted that the check didn't get there until May4, 2015.  It is my belief this was done to allow ample time for them to remove the add from Cars.com or any other site that they had their ad on, not allowing me access to the information I needed to defend myself. So I contacted Cars.com and they provided me with exactly what I needed and knew for fact that the vehicle in question was listed as having a nav system. The vehicle shipped to my daughter did not have a nav system, therefore I conclude that this is false advertising and a full refund is forthcoming, including the shipping cost that I incurred shipping the car to my daughter.
