I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.My daughter attended this visit with me as I had just gotten out of the hospital after an almost week stayInitially I was going to cancel the apt because of my physical state, but felt by doing that it would take me months to reschedule the apptI felt, as did my daughter, that DrLee already had a preconceived notion regarding not wanting me as a patient due to my being a former DrG*** patientThis was evident when the first comment Dr Lee had made was the fact that he didn't care how DrG*** ran his office, but he, DrLee would not continue narcotics on the first appt. When my daughter scheduled this appt we had already been informed of this and understood his policyI did not feel that DrLee wanted to listen to my medical history and once I advised him that I had settled my compensation matter and pay "out of pocket" he stated that he does not accept those patientsIn my opinion, and my daughters, we felt that Dr Lee had no desire to accept me as his patient based on my current payment status I vehemently disagree with the amount of time that DrLee advises that he spent with my (and my daughter) in his office; the time discussed regarding my health history was "minimal." I brought numerous documents and filled out his required paperwork and at no time did he refer to any of these documents. As I felt like I was being pushed out of the door once the Drheard that I pay out of pocket. Also, when we first arrived at the office, the receptionist did not know how to handle my payment after I had explained to her the settlement of my worker's comp matterAt that point, she conversed with the other receptionist in the office, who also did not know the answer and contacted the billing department to determine the amount and type of payment that would be madeI was advised to "check" the box that I did and that the amount would be $130, which coincides with the amount that my daughter was informed it would cost when she called to make the initial appt. In knowing what my previous pain management doctor charged I advised the receptionist that I thought that was steep, and she stated that there is a chance that I would be "refunded" some money, but that I should not owe anything more

I received the completed and signed HIPAA authorization form allowing BuffaloMedical Group ("BMG") to provide a complete response to Mr. Joseph [redacted]'scomplaint.I've enclosed the notes of the encounter date of July 29,2016. Dr. Lee spent aconsiderable amount of time in this encounter with Mr....

[redacted]. The physicianprovided a comprehensive intake and examination of Mr. [redacted]'s complicatedmedical condition. There is nothing to demonstrate that the physician was impatient orfailed to spend the appropriate amount of time and effort at this first appointment withMr. [redacted]. Notably, some of what Mr. [redacted] disclosed fi-om his perspectivein the complaint is also logged in the medical record.The patient's appointment occurred at a time when the pain management services in ourarea were complicated by the temporary absence of a high-volume pain managementspecialist to the community. During this period, patients were anxious and fearfulregarding their treatment and medication regimes. Dr. Lee professionally offered hisservices and expertise to such patients.As a pain management specialist. Dr. Lee's treatment and services includes a multimodalapproach to comprehensive pain management; such as epidural steroid injections,cervical, thoracic and lumbar medial branch blocks and radio frequency ablation, jointinjections, occipital nerve block, peripheral nerve stimulation, and spinal cordstimulation. \\^le narcotics are utilized by Dr. Lee, they are rarely the first-lineintervention to address chronic pain. Also, in most cases. Dr. Lee does not prescribemedications on the first patient visit so that he may assess the need and the propriety ofsuch a decision. During this period many patients who were anxious to obtain narcoticsbecame frustrated. However, this was not Dr. Lee's doing.[redacted]As regards the payment concerns, Mr. [redacted] received a Workers Comp settlement(Section 32). Section 32's are voluntary which means that he elected the payout to closethe workers compensation case verses continuing to receive long-term benefits. Theelection of the payout requires Mr. [redacted] to be responsible for payment formedical services related to his compensation injury.When Mr. [redacted] checked in for his consult/office visit he signed the BMGFinancial Policy (see attached) which contains the following notification:Self Pay (No Insurance) - Patients who seek treatment without insurance will berequired to prepay an estimated amount ranging from $90-$200 for office visitservices. Procedural surgeries and drug administration quotes will be providedseparately as they are also due prior to service. Pre-collection amounts areestimates only as we are unable to determine services performed prior to being seen.You will be for any remaining amount due or refunded should you overpay.The level-of-service for patient visits/evaluation & management services cannot bepredicted prior to the actual service being rendered. The amount of $130.00 is the BMGprepayment estimate for office visits. For the services provided to Mr. [redacted], Dr.Lee elected to bill a 99244. Mr. [redacted] was ultimately charg^ the BMG self-payrate of $262.00 for a level 99244 service. The BMG usual and customary charge for thesame services is $300.00. After the $130.00 prepayment, there is a $132.00 balance. Aspart of this investigation and response, we asked two separate coders to review Dr. Lee'schoice of billing levels. Both certified coders agreed with the level of service billed byDr. Lee.Thank you for the opportunity to review and respond to this complaint. Based on ourreview, we will continue to expect payment for the medical services rendered. BMG willpursue such payment in accordance with its intemal policy.If you have any questions, please do not hesitate to contact me.
