Dear Ms***,I recieved the formal complaint letter over the weekend in regards to [redacted] There are two issues at hand that need to be addressed This is the first letter I have gotton in regards to this complaint I only knew about the complaint because the customers wife (not the actual customer who signed the contract blasted negative things all over our [redacted] account. We were contracted to do several projects in the yard All those projects were completed not to customer satisfaction on the patioI will explain later When the estimator originally started the contract, it was determined that the extension part of the yard could not be completed as we would have to pull permits and the cost would entail much more than the consumer was willing to spendThe price originallly quote was for metal culvert pipe but upon further inspection it would call for three foot heavy concrete pipe It was also determined that the area that the customer wanted us to work was infested with copperhead snake nests.I spoke with husband (never met the wife) walked around the yard with him, etc he was okay with not doing the additioinal part of the contract which was cancel via verbal agreement.I sent a crew a few days later to clean up any left over debris The crew went back out (our 7th or 8th time) to install the fence portions that unfortunaltly took several months to arriveThe first two times they arrived they were damaged and had to wait for [redacted] to reorder and finally got the correct fence panels, in which we replaced and installed at no cost to the customerThe reason the panels were damaged was the tree we took down was completely rottedIt was too dangerous to climb and the climber advised the customer of the circumstancesWe had to throw the treeDead trees are unpredicable and the top dropped out of the tree onto the fence panelsThe guys did forget to haul off one of the damaged fence panels we replacedIt was behind the new fence and probably why it was overlookedI felt so bad about everything that happened that I gave the customer a refund of $850, in which was inadvertadly left out of the complaintThey recieved alot of work for little money We could not do any more with the patio because everytime it rained the rock dust would settle and sink one spot in the middle of the patioThe appeared to be the runoff spot for the deck above and we advised the customer several times that this was going to be an issue unless he addressed the drainage issueHowever, in good faith, we fixed it for him three times I lost several thousand of dollars in labor costs trying to please this customer I am empathic to their complaints and tried to compensate and correct as much as I could. The $we recieved as an intial deposit for equipment rental and material not for labor costsThe customer required heavy duty equipment and material All of which was used up between patio pavers, rock dust, bobcat rental, and other vairous material as needed A refund of $seems excessive considering the work is completed and the fence doesn't look bad at all, in fact it was put up better than originally I have already refunded them *** See attached cashed check as proofThe husband was texting my phone and calling and harrassing me daily and I told him that we do have other customers that we would be back out there as soon as the fence panels came in.The other issue at hand was a noticed recieved about a not having a contractors liscense I worked alot with [redacted] in which I was told that he was a liscense contractor, under futher review, I was told that his liscense had laspedI was confused on how the $contract worksI thought that the $was per day not including materials and equipment renta. However, I was misinformed and have since educated myself and currently working on getting a class C contractors liscense I would never do anything illegal or thought I wasI run a clean, honest business and try to do right by my customersEvery once in a while you will run into customers who will try to get you to do work for free or try to do insurance scamsI am working on my contractors liscense right now and hope to have that shortly after the first of the year.I have advised my estimator of the correct way the contract works it is a $per contract including material In the meantime, as not to cause any problems, I am willing to cancel my Revdex.com account and remove any logos from any advertising material until I get that liscenseBut we are not doing any contracts over a thousand dollars at one time now that we have a clear understanding of how it worksI have been in business for years and have had only customers complainedUsually its they use the Revdex.com as a way to get more free work out of the companyThank you for your attention to this matter and let me know if you need anything more from me

To whom it may concern: We performed all the services as per the contract. The mulch was never purchased from a "dump" yard. All our mulch is high quality double shredded hardwood mulch from a nursery or other bulk mulch contractor. We have had several problems with... Ms. ***. We would fix something and should would complain about it, so we would come back and "fix" it again. The contract never stated seamless gutters. We sealed the leak. As a courtesy, I tried to purchase a seamless gutter to make her happy. But I was having a hard time finding a company to fabricate the gutter even after we fixed the leak. After several harassing texts and emails every other day, I terminated the relationship with this customer. As far as the AC/Heating system, my crew member who worked HVAC for over 20 years prior than working for my company noted that the pilot light was out. He relit it and the system came on fine. He noted that the system was very old and probably needed replacement soon. The return condensation pipe that was covered by her husbands request and then was uncovered at her request. We asked the customer what the pipe was for and he told it was nothing just a overflow valve sticking out of the ground. We sealed her gutter so it would not leak. It seemed no matter what we did, she found something else for us to do just to have the crew out there. After the 6th trip, we figured out that she was taking advantage of us and my staff and time. We had already replaced her crype mrytles once for free because she failed to maintain them and they died. She was advised that after we initially do the installation, she has the responsibility of maintaining the landscaping including watering the plants and weeding the grounds. The weed barrier only controls so many weeds. She even threatened me to get more out of me by telling me she was filing a BBB complaint. No refunds. She got more than work than $2700 worth and I did not even charge her for my crew member relighting her pilot light.

completed as we would have to pull permits and the cost would entail much more
than the consumer was willing to spendThe price originallly quote was for
metal culvert pipe but upon further inspection it would call for three foot
heavy concrete pipe. It was also
determined that the area that the customer wanted us to work was infested with
copperhead snake nests.I spoke with husband (never met the wife) walked

Good evening,

I did not see the initial response from the company until now and would like to have it addressed.

1. The company never did return to fix the leak. I do have text messages from the company agreeing to replace the gutter. I also had two representatives from the company who came to my residence and confirmed that the gutter should be replaced. The last representative confirmed that a new gutter needed to be ordered. Nothing was ever fixed. The company has not performed any work on my property since November 2015. The gutter is still leaking.

2. The company was not hired to inspect or work on my furnace. It is a landscaping company and not a HVAC system repair company. I am stunned that they claim that one of their service guys relit the pilot light. That is unbelievable. If indeed the work was done, her crew member entered my house unauthorized and pampered with my furnace. Destin M[redacted] entered the property one time to take a look at piping for an outside faucet. No other crew member received authorized access to the inside of my house. I will need to reiterate that if Mrs. M[redacted]'s claims are true, it was unauthorized entry and that unauthorized work was completed! In addition, the HVAC system was in perfect operating condition at the time the work was being done by the company on my property. I had no need for them to inspect or work on my HVAC system.

4. The work that was completed in the yard, was work that was recommended by Destin M[redacted]. We were told by him that the pipe in question was a condensation pipe from the HVAC system and that it should be routed into the ground.  It was not a pipe sticking out of the ground, as Mrs. M[redacted] claims, it was a pipe coming directly out of the house. Destin explained that was the same type of pipe that is located in the back of the house and it was his recommendation to also route it into the ground.

3. All conversations with the company have been saved. There has been no harassment. Emails were never sent. Several text messages were sent, back and forth with Mrs. M[redacted]. I usually checked on the status of having the leak fixed two to three times a month, as they continued to promised that it would be done that week or within a few days. I did inform Mrs. M[redacted] that a Revdex.com complaint will be filed, because no action was taken by the company and that was in June 2016. I then even waited longer to allow more time for the company to take action.

4. The gutter should have never leaked within that short period of time of installation. I provided the company with ample time to fix the problem, but either did not receive a response or was told that it would be done by a certain date, which then never happened. When the company responds with "I can have the new one up this Friday" (5/3/2016) and prior to that they had 3 months to take care of the issue, faith is lost. Also, Mrs. M[redacted] has told me several times that the company did do unacceptable at work at my house, because her employee did not do his job and was therefore fired. In a text she wrote: "Well, then I will send the second crew or Mike to do it and he did not supervise the first crew that was Donnie and he was fired because of your job" (2/9/2016).

5. The gutter should have been installed with a slight slow to allow for proper drainage, which it was not.

6. I do have pictures of the crape myrtle trees when they were installed. The pictures are dated. It is impossible to kill three trees that have discount stickers on them when they are only in your yard for one day.

The company's response is unacceptable. I would like to have it further addressed. Thank you in advance for providing additional guidance.

the contract works it is a $1000 per contract including material.  In the meantime, as not to cause any
problems, I am willing to cancel my Revdex.com account and remove any logos from any
advertising material until I get that liscense. But we are not doing any
contracts over a thousand dollars at one time now that we have a clear
understanding of how it works. I have been in business for 4 years and have had
only 3 customers complained. Usually its they use the Revdex.com as a way to get more
free work out of the company. Thank you for your attention to this matter and
let me know if you need anything more from me.

Review: In October 2015 the company was hired to take care of several issues on my property. None of the work was done correctly and after some back and forth with the business owner, they came back out to fix the issues we noticed right away. For example, they sold us mulch and used the grind of the tree stump they removed. After a complaint, new mulch from the local dump was brought in, which after a few month has left nothing but weeds and looks nothing like professional landscaping.

In November 2015 my gas heating system stopped working. After an AC company came out, they noticed that the gas exhaust pipe was routed into the ground, which was part of the work Robert J M[redacted] Tree and Landscaping had completed. They had dug in the pipe claiming it was a water drainage pipe. After I called the owner, someone came to my property and cut the pipe and I was told that my heating system broke due to it's age, and they had nothing to do with it.

In January 2016, I contacted them because the gutter they installed leaks due to the way it was installed. It was installed in two pieces, which should have been one piece, but because Lowes didn't sell a piece long enough at the time of the install, they opted to use two pieces, which caused the leak. Someone from the company came out to take a look at it and agreed that it should be replaced. It then took another month for someone else to come back out to measure it, which was at the end of March. I have since been waiting and I have heard all excuses possible from the owner, from - I was sick, to it was raining, to the gutter just hasn't been made yet, to now - no response at all. I have not receive a response from the owner since April 2016.

I since had another company assess the work and damage of the leaking gutter. According to their assessment, the gutter was installed incorrectly, as it was not installed with a slope. On top of it, it should have never been installed in two pieces. Replacement is requireDesired Settlement: I request a refund, as the company has not been responsive and shown with their work that they are not reliable. All of the work that was completed on my property had to be redone or still needs to be fixed, which went as far as a broken AC system.

Response:

To whom it may concern: We performed all the services as per the contract. The mulch was never purchased from a "dump" yard. All our mulch is high quality double shredded hardwood mulch from a nursery or other bulk mulch contractor. We have had several problems with Ms. [redacted]. She even threatened me to get more out of me by telling me she was filing a Revdex.com complaint. No refunds. She got more than work than $2700 worth and I did not even charge her for my crew member relighting her pilot light.

Response:

Good evening, I did not see the initial response from the company until now and would like to have it addressed. [redacted]

This company is a joke! waited two weeks past the scheduled work date before calling to get a new date. Was informed at 11am that they were on the way and waited until 6pm before they showed. worked 1 hour and was told they would be back first thing in the morning. They showed up at 3pm the next day. they left a cut tree in my front yard saying the bar on the saw was bad and they would be back in a day or two to cut it up and get it moved. again weeks went by so I called the owner again. I was told that the person that came to my place was fired for such work as what was provided to me. the owner informed me that they would make things right and send a crew out to cut up the tree and finish the stump grinding. again two weeks past and I called again but now I am sent to voice mail. I left a message and got no return call. My son goes out front and decided he would play on this great new toy "THEY" left in the front yard and snaps his arm in half. I again call and again sent to voice mail. I left another message letting them know that this tree has now resulted in my sons broken arm. No return call. I called again and again voice mail so I called from another number and they answered the phone. I informed them that it was me calling and was told that it was not their problem. I was informed that any work done by their employees is between the employees and me and is not the companies responsibility. Spend a bit more and get a real company to do the work.
