Review: Im currently divorced, I have tried to contact the lawyer that handled my case in 2010. I have custody of my children and there father has not been present for any visitation in the fours years we have been divorced. It states he can see his children but he doesnt follow the divorce documentation. I have a recentley became an American Citizen 2010 and work with Child Youth Service on Fort Hood for the past 5yrs. Im trying to go on vaction to my home which is in Philipines and now my husband is trying to say I cant leave, and I have full custody. Im trying to understand my divorce decree and people that are assisting me are stating I dont have an accual nortized final copy. No seal or signature from the judge. Ive never signed anything at the time I was ill in the hospital and my lawyer [redacted] procedeed with my divorce. I tried to contact my lawer [redacted] and was told he had a heart attack and no one could help. Also he does not practice family law. I stated to [redacted] who was very rude and unproffessional that I dont have a complete copy and would like [redacted] or someone that is representing him to explain the final outcome of my divorce. She became angry and said do I think that they didnt help me. I continue to say to the lady that I was never explained my legeal rights . [redacted] said she will send me a new copy of all information. That they can set up a meeting with [redacted] and I said I thought he doesnt practice law now. I did pay for my services of a $1,000. I was shocked when [redacted] just hung up on me. Im not impressed and appalled by the treatment that I received from my attornies company. I plan to see Jag for assistance on explaining my rights and I should not have to do this. All I want to know is what my legeal rights are, I want the orginial divorce decree. I deserve that since I paid for [redacted] services. I hope to get this matter handled properly and professionally. English is my second language and that is why I want to understand my legeal rights. Thank you for your services.Desired Settlement: I would like to understand my Divorce Decree and have a Legeal Notarized copy since I paid for it. I should also be able to speak with [redacted] or the person who has stepped into his position until he is well. I should not be told to seek another lawyer to get this information because I will have to pay another lawyer.

Response to consumers complaint:

[redacted] contacted our office and when we first spoke she stated that she was a prior client of [redacted]’ and that she wanted to change some of the things that were ordered in her divorce decree. I explained to [redacted] that [redacted] had a heart attack about a year ago where he underwent quadruple by-pass surgery and that he is no longer handling any family law matters and if she wanted to modify her divorce decree she would have to contact another attorney to do so. At this time she said ok and the conversation was terminated.

[redacted] then called a second time and spoke with [redacted] another [redacted] at the office where she asked for a copy of her order. I told [redacted] to tell her to hold while we look and see if we even had the file in our possession due to [redacted] moving offices in January of 2013 to our location in Belton, TX. When [redacted] moved he did not bring all of his files to our location but left some files in his closed storage in Killeen, Texas. We put [redacted] on hold and looked for her file; we did not have her file. [redacted] then began to tell [redacted] that we did not have her file here at the office and that because we have no way of knowing if she received a copy of the order or not(which is given to the parties at the time of the hearing) we would get with the Bell County District Clerk’s Office and forward her a copy and to know that it would take us a few days to do so. I overheard [redacted] having difficulty with the person on the phone and so I told her to put them on hold and I would speak with her. When I picked up the phone it was not [redacted] it was a third party person and I do not remember her name. When I got on the phone the lady stated that she did not understand why we were being so rude and not letting [redacted] meet with [redacted]. I again stated that [redacted] is no longer doing family law due to health issues and that if [redacted] wants to modify her order as she previously stated that she would have to hire a new attorney. The lady then said that was obscured and that [redacted] is [redacted]’s attorney and that [redacted] should be able to speak with [redacted] whenever she wanted. I explained to the lady that once a case is final [redacted] is no longer that persons attorney of record and when orders need to be modified, then people have to either re-hire the attorney that handled the matter originally or they hire a new attorney. Seeing that [redacted] is no longer doing family law, [redacted] will need new counsel. The lady then said that’s fine but she, [redacted] just needs to be explained the order. I then said, Oh, that is not what she told me at the beginning and informed the lady that she, [redacted] can come in and meet with [redacted] to go over her divorce decree. The lady then started going off about how [redacted] didn’t do his job and that we are incompetent and should apologize to [redacted] for never giving her a copy. I said Ma’am, you are not [redacted]’ client nor where you or I there the day of the hearing, but 80% of the time, all parties are given a copy of the order by the Clerk’s office the day of the final hearing. I do not have the file due to [redacted]’ relocation to prove that [redacted] received a copy and I told [redacted] that I would get her a copy, and that to me it seemed as though she had a copy due to the fact she is claiming that the ex-husband is not doing things as he should in accordance with the order and how would she know is was not doing what he should be if she did not have a copy of the order. I then stated to the lady that I am willing to help but if you are going to be rude and disrespectful then you and [redacted] can go to the Bell County District Clerk’s office located at [redacted] and request a copy from the clerk like everyone else y. I then informed the lady that I do not have to listen to you yell and be rude especially since I had just became [redacted]’ assistant in January of 2013 and had no prior knowledge of [redacted] or her case. I told the third party lady that [redacted] can set up an appointment time to meet with [redacted]. The lady began yelling at me again stating that [redacted] did not do his job, etc. I asked her to stop yelling at me, she did not…at that time I terminated the call.

The other assistant at the office was sitting right next to me the whole time and can verify that conversation. I did not speak with [redacted] at all during the second call, I only spoke with the third person lady to whom I do not remember her name. [redacted] never once told me that she paid [redacted] $1,000.00. I did not hang up on [redacted], I did hang up on the third party lady due to the constant yelling and the fact that she was not even the client of [redacted]. There was clearly at first a misunderstanding of what [redacted] was needing, seeing that at first she claimed to want to modify the order and not that she just wanted to sit with [redacted] to have some of the terms of the order explained to her. (this may be due to the language barrier) [redacted] never told me she needed to be explained the terms of the order it was the third party lady that informed me of that fact well into the second conversation.

I am rejecting this response because:Due to the situation, the bottom line is I only want to understand my legal rights. I can not go to another attorney because they will charge me fees just to go over my divorce rights. I was told that I could meet with [redacted] so he could go over them. Which should have been reviewed to me at the time of my divorce. I paid my fees for services that were incomplete.

I want the Official Copy, I only have a draft. There are no legal seals on my Divorce Decree. No judge signature, or my legal signature. Im not asking for any legal services. I don't want to modify any thing. I was in the hospital and [redacted] proceeded with my divorce. So Im available for an appointment to discuss my Divorce Decree.

Regardless, how the [redacted] behaved unprofessional no one was yelling but her. She is the one who hung up, she was offended that we were questioning the prota-call. The third party person also had a room full of bystanders around and was never rude. It was very obvious that there was a language barrier and whether I paid for legal fees, you have to pay something for legal services.
