[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:UPDATE on Complaint: [redacted] Hi, I apologize for the delay on getting back to you all regarding the complaint aboveI had to wait until I went to the Endodontic to get an estimate of the damageAfter filing the complaint originally, I received a letter from DrZebrowski's office regarding my complaintIn the letter, I requested my full records, dental notes, and x-rays to be able to provide to the EndodonticHowever, I only received the records from February onward (not including the previous years I have been with their office and the work completed/records reflecting)Additionally, I received a letter stating that they would refund/reimburse me $(unsure if accurate), BUT under the condition I would not pursue legal action against them for negligenceI attached the letter below for your reviewI have not responded because I had to wait until my Endondotic appointment on 9/which totaled $It was determined that I have an infection down to the bone due to the root canal being started, but left untreatedThe temporary filling put on by DrZebrowski had leaked and caused bacteria to leak down to the tooth/bone causing a concerning amount of swellingThe Endo office is also concerned about the other root canal on the right, which appears to have similar damage and may need extraction due to the carelessness of DrZebrowski's officeI contacted a lawyer, but will need to take the case to small claims court since DrZebrowski's office has refused to refund me until I sign the document attached stating that I would not hold them accountable for damageAs a result, I had to come out of pocket again to cover the cost of the Endo and am unsure if I can afford the cost of the second canal without the funds DrZebrowski is holdingI would prefer not to seek legal help, for it's been extremely disheartening and distressing having to suffer with the pain and discomfort since FebAny help and assistance is always appreciated and I am so grateful for you all thus far.If possible, I would like to be able to receive my refund/reimbursement of services not rendered without having to sign the documentation stating that I would not seek legal assistance for I am unsure of the total damage caused by their office and refusal/dismissiveness to complete the work; despite multiple attemptsI was able to get the left side completed by the Endo within an hour and am on heavy antibiotics for the infection and swelling (all which I have had to pay out of pocket) Regards, [redacted]

As to the statement made that [redacted]'s insurance was charged for the second procedure...that is false. The insurance has not paid for the second procedure. As to the statement that we were unresponsive to [redacted]'s needs that is also false as we have documentation of...

responses to her calls. When the initial estimate was given we were under the impression that [redacted] was still covered by her previous insurance carrier. As to the statement that she was told to bring an insurance check that she received to our office, that is false. My billing person worked for [redacted], and is very familiar with their policies, and knows that in order to correct a claim the subscriber would have to return the check to [redacted]. We would not be able to deposit or cash a check made out to the member.[redacted] presented to our office for the first time on 07/21/2015 with extensive dental needs. We presented all of the issues as we are ethically required to do, and it was then left up to [redacted] to determine what she wanted to do to address the issues at hand.. We also have documentation that we tried to follow up with [redacted] to make sure she was going to follow through with treatment. As to the financial aspect, the estimate that we give our patient's is just that an estimate. We do our absolute best to make the treatment that our patients need affordable. The procedure that was started on 02/14/2017 was completed on 05/12/2017, and paid for by insurance. The procedure that was started on 02/24/2017 was not completed, and not paid for by insurance. We attempted to complete the second procedure but were unable to due to [redacted]'s anesthesia wearing off and difficulty staying numb. We set another appointment for the completion of which the patient did not keep. As to the records, we sent them return receipt, and have received the signed receipt. With the documentation we sent a release form that [redacted] has yet to return. We will be happy to issue a refund to the patient via [redacted]. I asked her if she would like me to credit her [redacted] account as we are required to do when there is an over payment, but have not received the above mentioned release. We are sorry that [redacted] is dissatisfied, and are willing to work with her to resolve this issue.

In the letter, I requested my full records, dental notes, and x-rays to be able to provide to the Endodontic. However, I only received the records from February 2017 onward (not including the previous years I have been with their office and the work completed/records reflecting). Additionally, I received a letter stating that they would refund/reimburse me $1200 (unsure if accurate), BUT under the condition I would not pursue legal action against them for negligence. I attached the letter below for your review. I have not responded because I had to wait until my Endondotic appointment on 9/14 which totaled $900. It was determined that I have an infection down to the bone due to the root canal being started, but left untreated.
