Through our attorney it appears a settlement has been reachedHowever, the settlement papers have not yet been exchanged, and the terms of the settlement require MrS [redacted] to make several payments, final payment October 1, Only when all payments have been made will the complaint be resolved.? I feel that Mr***'s estimates are quite high for this project I will submit my own break down of what I feel that this project should be worth what I should pay.My source is Homewyse.com This gives you the average costs for projects such as these According to Homewyse (which is what I use to quote most projects), the cost to remove all tiles, mud pan, green board, hardi board and dispose of all debris Install green board halfway up toilet area walls X3, install hardi board in shower area, and toilet area flooring Install 134+ square feet of tiles, which takes in the shower, toilet area and flooring in both areas Install mortar bed in shower area (sq ft) This should not take more that hours I have given hours for any extra labor that may be involved This comes to a total of: $6,
Mr*** (Prestige Tile) has predicted that it should take approximately days to complete.I have predicted days tops They have doubled the average time it takes to do this job correctly.The materials cost is not in dispute, only the ridiculous amount of labor.This is my response to your correspondence and I feel that I am being extremely fair with this amount.Now, I do also understand that Mr*** is pursuing my Bond Since I do have an arbitration clause in my contract, he cannot do this without breaking the contract If he pursues this he has indeed broken the contract and he (Mr***) is liable for the full amount

I received a letter from a client (*** ***) at *** ** *** ***in SpokaneI would like at this time to respond to Mr***’s complaint
First, Mr***’s bathroom remodel did not cost him $ 16,724.00. His bathroom was much smaller than the average sized bathroomThe number he gave you is an ‘average only’ and consists of many differences when it comes to remodeling a bathroomSuch as; actual size of bathroom, are we replacing a sink, bathtub, vanity, mirror, lighting, etc. When it comes to actual numbers, size is extremely importantMr***’s bathroom was only sqftIncluded a small vanity/sink, and a toiletThe shower area was 43”x42” and the tiles ran up the wall only inches
There were two openings for soap, cleaning products, etc
What I am trying to say at this point is that the cost of this bathroom remodel was nowhere near the cost Mr*** brought to you
Now with that said, I would like to address the complaint
I have been in the construction business for overyears. I have been in electrical construction as a Lineman, have had my own Handyman Business as well as my own Construction Business. I am a General Contractor, not a Specialty Contractor. I never portrayed myself as such with Mr*** at any time
I gave Mr*** an honest quote based on the work to be done at his residence. I did so in Good Faith and with every intention of doing a professional job for Mr***Up to the bathroom tile portion of the job, both Mrand Mrs*** were both 100% satisfied with my work and the way the projects were turning out
I built Mr*** a wood and composite deck with stairs that could withstand a small Hurricane. Mr*** was installing a hot tub and sauna on the deck and I did everything within my power and knowledge to build Mr*** a deck that could withstand the weight of these items plus a live load (people)
Not was the Building Inspector amazed, but so was the hot tub and sauna installer at the time they delivered these items and placed them on the deck. Their response was something like, “this is the sturdiest deck I have ever been on” or something along those lines
When we did the demo on the interior we did so in a very professional mannerDisposing of all debris and keeping out as much dust from his residence as possible
The interior bathroom walls, ceiling, lighting, fan, painting, etcwere all completed in a professional manner and to the satisfaction of Mr***
The interior bedroom walls, ceiling, trim work, interior door to the bathroom, exterior door the deck, painting, etcwere all completed in a professional manner and to the satisfaction of Mr***
The first time the LVT flooring was laid in the bedroom, I admit it was done when we were still using the bedroom as a pass through and the floor spacing of the tiles were not completed to the satisfaction of Mr***. I told Mr*** that anything that was not done to his satisfaction, I would re do at my expense
I purchased new LVT tiles and re-laid the flooringI spaced them to Mr***’s satisfaction and grouted the tilesThe grout did shrink somewhat after the first installation and so we cleaned the grouting and was going to finish the grout after the bathroom was completed. Mr*** did not allow me to finish this portion of the project. If Mr*** had allowed me to finish the flooring, it would have been completed in a professional manner and to his satisfactionWe will never know this now since I was not allowed to complete this work
As for the interior bathroom tile work. I will admit I have never installed subway tilesI have installed pretty much all other sizes, such as; 6x6, 12x12, 6x12, etc
I had in the beginning recommended that Mr*** choose one of these sizes, but he chose the subway tiles instead
Hine-site, I should have hired a sub-contractor to finish this portion of the job and not attempted myself
But I did and here we are
We had agreed that the shower tiles were to be used and not removed. They did however have to cleaned of all grouting, etc
The bathroom wall tiles (in Mr***’s opinion) all should be replaced. I do dis agree with this. There was one wall where the tiles were installed improperly and needed to be replaced
The floor tiles were 90% completed in a professional manner. There were a few tiles near the entry door and to the shower that needed to be removed and re set or replaced. I was in the process of doing this when according to Mr***, I ran out of time
The tiles surrounding the shower entry did have to be removed and replaced. The shower floor tiles also, needed to be removed and re set so that the shower would drain properly
Again, I did not have time to get to these items, as according to Mr***, my time had ran out
I was never misleading, I was up front and honest in all of the dealings with Mr*** in everything I did
I was going on a family re union the week that I was trying to make everything right
with Mr***. If I had more time and was not so rushed(I felt terribly rushed at this point in time and under a lot of stress from Mr***) I would have been able to make all of the corrections, even if it meant hiring someone more knowledgeable with subway tiles to assist me
I did sign what I told Mr*** was a gentleman’s agreement to allow him to hire another contractor to finish the bathroom tiles at my cost, as long as the work is completed at a reasonable cost. This is the same thing that my Contract allows for
My contract also allows for Mediation should we not be able to come to an agreement on pricing, etc
As for the other complaints from Mr***. I would have had all the debris and any other mess cleaned up at the end of the project
I also told Mr*** that I would demo any tiles in the bathroom vanity area and floor tiles in the shower at my cost
Again, Mr*** sent me an email stating the I cannot demo anything in the bathroom
I am a very fair, honest and forthcoming person. I will however, not give up recourse for mediation should Mr*** and myself not come to an agreement. I feel that mediation is the only fair way to settle any disagreements
However, should Mr*** seek another professional to replace the tiles that need replacing, I will pay a FAIR amount for these services, less the amount owed on the original contract of $ 2,000.00. This amount will go towards the contractor performing the work
When I say a fair amount this job should be exceed any way more than, $4,including labor and materials
The LVT in the bedroom only needs to be cleaned and re grouted, NOT replaced in its entirety
With this said, the Desired Settlement portion of the letter sent me will be as followsI do accept responsibility for some of the tile work in the bathroom and shower area
I will commit to payment to another professional contractor doing the work, as long as the payment does not exceed $ 4,
I will not give up recourse for mediation. That would not be in either of our best interest

I never portrayed myself as such with Mr*** at any time.” I disagree, MrS*** claimed to be a professional tiler, competent to do a bathroom remodel, and he claims such competence on his web pagesWe expected that he would do a professional job, and entered the contract with that expectationHe admits in his response to Revdex.com, “I will admit I have never installed subway tiles.”, but he never told us that
If he knew he was not a specialist in tiling (i.e., “not a Specialty Contractor”) he should have hired a sub-contractor to do the work, and made it part of the contract
The fact that he could not do a professional tiling job in the first try, (we’re not talking minor problems, but major problems throughout the job), and could not do professional work when given a second chance, indicates that he misrepresented his abilities in order to get us to sign the original contract
MrS*** wrote, “Hine-site, I should have hired a sub-contractor to finish this portion of the job and not attempted myself.” In fact, he clearly should have known that he could not do a professional job after he failed on the first try, and should have hired someone to finish the jobHe was given that opportunity in the new contract, “Tiling options: Do it yourself; you hire a professional tiler; …”He chose to do it himself.
MrS*** seems to think he could have finished the job professionally if we had just given him more time
More time would not have helpedHe selected his own completion date for his second attempt, and could not meet itOn his second try, he could not: Amaintain straight grout-lines in the new tiles, Bkeep the grout from cracking, Cmaintain a consistent style throughout the project (e.g., offsets vary from 1.5” to over 3”), D, E, F…the list of problems goes on
It is reasonable to say, “Enough is enough.” Once it was clear that MrS*** could not do the job professionally I wrote, in an e-mail, after his second deadline passed, “There is no sense in you continuing to work on the projectYou have missed your deadline for completion of the work, and the work you have done has neither remedied the problems nor achieved a professional standardI have made only a brief walk through, but that was enough to show me that it needs to be torn out and redone by someone else of our choosing at your expense, as you agreed.”
Regarding how the job would turn out, MrS*** claims, “We will never know this now since I was not allowed to complete this work.” YES, WE DO KNOW; we know that the tile work would NEVER have been good because now we know, thanks to the new remodelers, that the preparation was inadequateFor example, there is only a wood backer for the shower door tiling, meaning that the grout must fail (even the Ceramic Tile Institute says, “The practice of bonding tile to wood, plywood and particle board has been a questioned installation by the Ceramic Tile InstituteCTI considers it to be a high risk for failure installation.”); and the mudpan was destined to fail (see below)And there are other preparation inadequacies
We just went through a new process of hiring someone to fix MrS*** unprofessional jobIt will cost in excess of $9,to fix his messAll the tiling and other problems need to be demoed and started overAll four remodelers told us this

The claim that we were 100% satisfied up to a certain point in time is not demonstrableNo one knows how satisfied they are until the job is overFor example, I didn’t know there were problems constructing the deck until I was under it working on the skirtingI noticed that some of the joists were cut too short, and the problem was covered up by adding shims to the ends, the end the hot tub is onI don’t know if that’s a problem; I’ll have to talk to an expertThere are cosmetic problems, too, like a visible hole in a board on the deck, unpainted wood by the doors in the bedroom, etcI just hadn’t had a chance to check everythingAnd I’m focused on getting fixed what needs to be done to make the space usable
