On July 20, 2015, Rod Robertson Enterprises (RRE) received an email from [redacted] stating the vehicle that he purchased at the auction cannot be registered in the U.Sbecause it does not comply with the U.SFederal regulationOn July 22, 2015, RRE brought the matter to Customs & Border Protection's (CBP) attention for further researchOn August 7, 2015, CBP instructed RRE to contact Mr [redacted] and advise him to petition for refundOn August 12, 2015, the refund package was completed and submitted to CBP for consideration and approvalOnce the refund package is submitted, RRE being only a medium between CBP and the buyer no longer controls the processRRE follow up with CBP to get the status of the refund and that's why RRE has been advising the purchaser to contact our office so that we could follow up with CBP accordingly for refund statusAs a matter of fact, in this situation, Mr [redacted] has been contacting our office for status update and we have been diligently sending follow up emails to the appropriate personnel to obtain an updateRRE have always been told that the refund is in process, and that the refund package must go through several layers of review via upper managementWe were also informed that, after it has been approved by management, and depending on available funds allocated, the package will then be forwarded to appropriate DHS departmentHowever, if there isn't sufficient funds available to payout the refund, then the purchaser will have to wait for the next allotment to be issuedTreasury department does not receive the entire budget all at once (budget is issued quarterly) and has no control over how long it will take to process the paymentThis is why time frame of days or more is given to all purchasers who wish to petition for refundsThank you , Respectfully yours, [redacted]

my reply is;
RRE clearly disguised and deceived me as a buyer 'telling me'' oh the veh runs great.!! In which clearly they knew, and hid , a major transmission problemThey know'' I could not ' test drive itAgain ripping off the public buyersI had to spend addition $plus to get it running the way it should of run as they indicatedReimburse me the repair fee or the total cost of vehicle n I give it back to the crooks.!!!!!

Plan simple and clear on their response they are not willing and not realistic about doing the right ethical and moral thing to be done and will continue to deceive, and rip off the unsuspecting public unless they are held to state and local fraud laws.!!!!

Even with all the ''We are not responsible '' advertisement does not give the right to KNOWINGLY hide, deceive wht they very well knew was wrong with the vehicle yet sold it as it ran great. And nio we can not test drive the vehicles as they state.

RRE does not inspect public consignments prior to offering for auction which is one of the reasons we hold preview the day ahead and morning of the auction.  While you are correct in stating that we do not allow bidders to test drive vehicles, we do encourage people to bring their own mechanic to inspect vehicles, listen to the motors run, and "kick the tires".  We want bidders to know what they are bidding on and feel confident in their bid.
 
We value our customers and do our very best to be clear in our terms and conditions to prevent bidder remorse.  While we can sympathize with your dissatisfaction with the vehicle you bid on, we did nothing to coerse or mislead you.  As you previously mentioned, you found paperwork within the consigned vehicles that documents possible issues with the vehicle.  Had you previewed the vehicle as we encourage, you probably would have came across those papers and known about potential concerns.  As you can tell by the fact that the papers were left in the vehicle, we didn't try to deceive or hide anything.  We have numerous repeat customers and pride ourselves in operating a respectable business, run on honesty and integrity.

Good afternoon Mr. [redacted],  Here is the information you requested for [redacted].  Mrs [redacted] did purchase two lots in our Feb 21st McAllen public sale and paid for the vehicles in full.  The online deposit was carried over so she could bid again in our next sale...

which was on Feb 28, 2015 San Antonio public sale.  Ms. [redacted] bid and later forfeit on those bids loosing her $200 deposit (please see attachment "capture"). Since Ms. [redacted] did not have a deposit, she placed another deposit on March 4th's sale.  Again, Ms. [redacted] bid on the sale and later forfeit loosing the $200 deposit and getting blacklisted from participating again.      Since Ms. [redacted] was no longer allowed to bid she had her husband register for her under the name who had a deposit to participated in the March 14 San Antonio Public Sale and forfeited vehicles on that sale and lost his deposit which we then made the decision to blacklist the husband as well.  If you take a look at all the attachments, Mr. [redacted] tried to re-register under different alies names with the same driver's license number but different addresses.        The deposit Ms. [redacted] is talking about is a deposit they made for the Tx sale in April which we did not let her participate any longer. The deposit was made under her husbands name which he used under false name and information:   Name: [redacted] Email: [redacted] Address:  [redacted]   Please note, the physical address does not exist, the zip code is a [redacted], TX zip code and the country they added is Mexico.  After verifying the information RRE has already refunded the money on 4/22/2015 to the name [redacted], not [redacted] which we already let them know.  No other deposits under the name [redacted] were submitted.   Thank you,   [redacted]
