Gentlemen, I am responding to a complaint filed against me by a Ms*** ***My contact with Ms*** was through a beneficiary of a trust that I prepared the tax return forThe final year of the trust was and the beneficiary approached me about preparing his individual income
tax returns for that yearHe and Ms*** had been recently married ad in they were required to file as married individualsAfter some discussion with him they elected to file jointlyI had no contact with Ms*** while preparing that return and all the information for that year was provided by her now ex-spouseHer ex-spouse requested that I prepare his individual returnsSince they were married at the end of their tax fortunes were tied together due to the community property rules in the State of NevadaAfter some discussion they decided to file jointly for as well. They were involved in antagonistic divorce during the first part of which made communication somewhat difficultMy impression was that there was very little communication between my two clientsMs*** was adamant that her personal information not be disclosed to her ex-spouse which was a request that I went to great lengths to respectThe return was put on extension mainly due to issues with the husband's brokerage accounts and were filed later in the spring of 2017. In the summer of her ex-husband received a billing from the State of CA for CA income taxes which came as a surprise since neither were CA residents nor did they have CA incomeThe billing was due to an error on the part of CA Franchise Tax Board but required extensive discussions and correspondence to the matter correctedI wasn't notified of the billing until after several notices had been sent her husbandMs*** wasn't aware of this billing because it related to her ex-spouses' interest in a trustAround that same time Ms*** was sent a billing by the IRS related to the returnThis billing would have been only after several notices being issued by the IRS which were not brought to my attentionThe issues related to this billing involved an error on my part and a larger issue with an item related to her ex-spouseIn order to respond to this billing it was necessary to get information from Ms***, which she promptly provided, and information from her ex-spouse which took some time and several telephone calls to getI did express to Ms*** that I was waiting on information from her ex-spouse before I could respond to her issueBy the time I had received all the information I was deep into the heavy part of my second filing season and couldn't properly complete my response until only recentlyI am waiting to hear back from the IRS on that correspondence. Neither Ms*** nor her ex-spouse are being billed for the time involved in settling these matters even though only a small part resulted from my errorWhen all of this is done neither Ms*** nor her ex-spouse will be out of pocket any more than the small amount of tax that will due which was not a result of error on my part

I am rejecting this response because: I would first like to correct some facts in Mr [redacted]'s response.- I was married in 2014, not 2015.- I handled the taxes for the year 2015. This can be proven by the handwriting on Mr [redacted]'s tax organizer.- I handled the taxes for the year 2016. This can be proven by the handwriting on Mr [redacted]'s tax organizer.- For 2016, I filled "married filing separately" in order to protect myself from my abusive ex-husband.- As soon as I received the notice from the IRS in July, I informed [redacted] at RWS. I do not know how many previous notices my abusive ex-husband had received and merely thrown away. I am thankful the steps Mr [redacted] went through to protect my personal information from my abusive ex-husband. However, I still would like Mr [redacted] to follow through with his other commitments. On a phone call with him on October 30th he stated that he would mail me a copy of the IRS correspondence for my own personal records. He stated that he had my current address and it would not be an issue to send me a copy. He would do it soon. Gentlemen, it is November 20th. I have yet to receive that letter. Once I receive that letter, I will consider this issue closed. Kind Regards,[redacted]
