I am rejecting this response because:Revdex.com, In response to case ID [redacted]: First, let me start by saying that [redacted] broke the contract.  I have an email that he states due to us being unhappy that he will remove his materials and refund us our money.  I responded back to his email (which I have copies of all) stating we want him to do the job but he needs to show up and work. In almost 4 weeks he only worked 1 partial day. My neighbor called on 11/27/16 to say [redacted] had picked up his materials and left the site.  That was him breaking the contract. He never returned to the job site or contacted me.  There were 3 patios and 2 retaining walls.  He could have from day 1 worked two of the patios and 1 retaining wall that were never effected by the water but he refused.  When [redacted] said we changed the upper patio placement what happened was we wanted the patio 5 feet from the existing concrete and we asked him if it were a problem to make it 7 feet instead.  He said it was not a problem since he hadn’t dug the dirt yet.  I also have a picture of the couple of skid marks from his tractor and he was several feet away from the river so there was never any danger as he states by the river.   Second, the materials that were on the property belonged to us even though [redacted] is accusing us of stealing them from the previous contractor.   The lumber and rebar were stacked out of the way and I know this because my husband and I had stacked it ourselves prior to signing the contract with [redacted].  He was asked to use our materials (lumber and rebar) so he didn’t need to bring as much.  I was there the 45 minutes it took [redacted]s guys to drop off the lumber and rebar and they left prior to me.  The boards he brought were not new, they were covered in concrete from other jobs so I don’t see why this is even brought up and besides he removed them at the end and they never got used.  Third, when [redacted] said he would be there Monday he was talking about 11/21/16 that Monday which is the partial day he worked (I have pictures of what he did).  Knowing that we were in a time crunch due to weather, [redacted] said not to worry that he and his crew would work all Thanksgiving week if needed to get the job done. Instead, we found out that he had taken our money and gone on a 5 day vacation.  If we had known that he would be gone all week we wouldn’t have left messages or texts for him to respond.  We are reasonable people until we feel we are being scammed.  Again, we were told he would be there that entire week.  Fourth, [redacted] never mentioned that he charges for consultation fees nor does it state that on the contract, his website or business card.  I guess if he is going to charge us then my next door neighbor should be getting a bill as well because he was going to do work for him along with our job but never did that either. My neighbor agrees that he never said he charges for consulting.  I’m sure [redacted] wants to be fair with all his customers so I’m sure as a business man of many years he wouldn’t charge 1 customer and not others because that would be bad business. If [redacted] is a good man like he claims then I’m not understanding why he hasn’t refunded any of our money and put this behind him like he states he wants to.  What is he waiting for?  I have told him if he give us our money back less the 3-4 hours of work he had done (I have a picture of what he’s done) that I would remove the bad review.  That was weeks ago.   I wrote a bad review because he is not responding to us and at this point keeping our money intentionally is theft.  We work hard for our money and are not in any position to give it away, especially 10K.  It took [redacted] 1 day to meet us and draw up a bid but it’s now been almost a month and a half and he hasn’t even returned a dime.   The bottom line is we feel [redacted] spent our money and didn’t have the funds to come and get our job done so he ignored us. I’m sure the intentions were there but no money to move forward as he cashed our check the same day he received it.  I have a copy of every email and text to prove what I am saying is correct.  Also, from what the Revdex.com told us, [redacted] has never paid his dues but is advertising that he has an A+ rating with you.  It seems that is deceptive advertising and that is the main reason we chose his company. We will close this complaint when we receive our money from [redacted], dba ROC Concrete Contractor.  He stated to you he did approximately $2,000 in work then where is my $8,500.  We would be happy to get that back and let the courts settle the $2,000 dispute.  We hired a backhoe company to excavate prior to [redacted] doing his work with 3 days and 2 large machines it only cost us $1,920 (I have the bill).  If [redacted] is an honest and professional man then why doesn’t he do the right thing and return our money. Again, at any time he could have worked on the other 2 patios and retaining wall but he chose not to.   Since [redacted] broke our contract we hired another concrete company and once again the LCRA released water flooding the 1 area by the river.  They managed to work from the upper patio letting the bottom dry out as we asked [redacted] to do, then down to the 2 bottom patios by the river.  They completed in just over 1 week with no problems.   Thank You,[redacted] and [redacted]

I'm [redacted] owner of Roc concrete contractor after signing a contract with the [redacted]s we began to howl our materials there and clear the previous contractors material so as to where we had room to store our material after that 3 days of 1 day delivered lumber, and gone over the revised scope of...

due to customer had changed your mind about placement top pad the second day we brang the amount of rebar that job required and laid out the markings for the slab again down by the river and on the top area so after that we bring equipment for the excavation of areas but the day we had our materials bear and dirt work was beginning to proceed the following day however it had rained that evening and overnight and created conditions vet we could not operate the equipment 2 do the dirt work so we waited until it was going to dry out but prior to the time it was drying out someone had released the floodgates at Longhorn Dam on the Eastside of Austin that controls the Colorado River and the water was 223 foot over the area in which we were to work so we cannot be responsible for Action God or someone who controls the flow of water on the Colorado River 2 cease allowing water to come down stream it took a week or better - has the water subsided however the water had created an unstable embankment along the edge of the work site and the whole area was very muddy against my better judgement I attempted to drive the equipment in that area butt barely was able to exit the dark area so I knew it needed to drive further at that point that was before of our efforts to do the work then we went again to operate the equipment on the area and it was so slippery that we almost ended up toppling the machine a Kubota Skid Steer into the river at a depth of 4 foot at that area so at that point I told [redacted] that this must be thoroughly dry to ensure that we don't drown from slipping down into the river area and that if it doesn't rain anymore after the holidays that we were planning coming back Monday following Thanksgiving well I have two lines and we were running late going out of town I left my business phone at the office and upon my return Sunday evening I could not believe my eyes or ears that I must have had 15 to 20 text messages and voicemails each call and text escalated intone and threaten that I was not there on Thanksgiving deyor the day leading up to Thanksgiving and the weekend after Thanksgiving so I called and let her know that we have you on the schedule for today Monday the Monday following Thanksgiving holiday but she told me that we will not be needing your services anymore because you did not communicate with me I expressed to her how important it was for us to have safe working conditions to proceed with the job and that we were prepared to take care of the job everything was I ready to work on I even offered to cut the dirt back and do some modifications that was not included in the contract for no charge so told my helpers to go and retrieve the lumber and rebar sense she was quite adamant about not allowing us to continue 2 do the job I was afraid she was going to keep are materials perhaps as she did with the prior contractor that left a healthy amount of materials there at that job so after the threatening messages and talk of attorneys and threatening to take me to court when I thought there was no issue whatsoever in US doing the job the following day Tuesday I noticed on my advertisement that [redacted] had wrote a scathing review about how terrible of a business man I was and was blown away by fact vet it went from everything's fine 2 you're fired all because I had to been unavailable through the holiday so at this point [redacted] seems to think that the work that we had done over there and everything that it took to prepare to be ready to do the work and was worth practically nothing as I told her that we will adjust the price and send her a refund butt it won't happen in a matter of a day or a week I would have my financial bookkeeping to account for monies paid out for labor and delivery of equipment as well as unrefundable material, as well as equipment that sat on her job for the better part of two weeks Wright Express to [redacted] that what we had done there added up to roughly $2,000 [redacted] estimated r time was worth $500 and I am not the one who broke the contract I was fully prepared and ready to do the job I do my best work under conditions of not being threatened with attorneys as you can imagine so defamation of character for the viewing public to see created a situation that my continuous ability to get work from my advertising was impacted so bad that I had the slowest December I've ever had in my life and December's are slow as they are I understand that it's difficult for a contractor to sue for defamation of character or assassination of character and for [redacted] to write a review assassinating my character like that one day after we parted ways at her request the review took a devastating hit to my ability to earn money so I m in the process of sending a bill for my consultation fees from the beginning of the job and the labor that we had done there and it may be best to take her to court on this due to the defamation of character needlessly She Wrote prematurely but I plan on resolving the issue as soon as possible birthday review stay there permanently from what I understand and the damage is done if the customer would not have wrote this review that has nothing at all to do with the quality of my workmanship just a hateful get you back type of review then the salt water turned out better in her favor and I would have been happy to take care of the situation sooner out of 35 years of doing concrete work I haven't came across a person such as this person but the Lord has taught me that everyone deserves forgiveness I do not hate this person I have no ill feelings towards this person anymore and just I'm looking forward to putting  this issue in the past ASAP without it costing me a good deal of money thank you for your time and interest in knowing about the job in reference to [redacted] and me [redacted] Roc concrete contractor I am a professional concrete contractor that strives to do excellent work 4 everyone we work for as my father taught me through his long life I began working for him at the age of 15 sorry I know there are people who don't understand the development the conditions of a job that is sensitive to weather or River's rising out of their Banks I believe this customer was just frustrated that things were happening on her job at that period of time
