The customer joined my gym in August of and signed up for a month membership. He then trained for several months. The member several months later came in and was thinking of quitting the gym. We talked to him about it and tried to get him motivated to continue training. Then in January the member called us and wanted to cancel. We explained to him that he was still under contract till November 1st 2014 with a remaining balance of $1,150.00. It clearly states in our contracts that after the initial grace period of days that the contract can not be cancelledAs a courtesy we offered him a $buy out which he agreed to pay. We then billed his card for that amount.
I have been in business since and have never had a single complaint filed against me or my business. I feel we acted in good faith with this member and that this complaint is frivolous.
I have included a signed copy of our membership agreement for your review. Please contact me back at your earliest convenience to let me know you received this and what your determination is.

To Whom it May Concern,
We attempted numerous times to speak with [redacted] about her issues but she wouldn't return our calls.  I feel her complaints are unfounded and inaccurate.  Having said that if she dismisses the complaint I will take her out of collections....

 Please advice me on the next step.

Review: I entered a contract with Roccos Mixed Martial Arts, Inc. The contract clearly states that the company "obligates itself to furnish you with trained instructors and suitable facilities...... class sessions are supervised by qualified personnel trained in the procedures and tradition of Rocco Mixed Martial Arts Inc."

There was mold dripping down the walls with a strong odor, the mats were not clean and the classes were taught by other students. I feel that my contract was breached and that my sons' health was in danger. One of my sons has asthma and cannot breath in the mold. He also has eczema and cannot have his skin exposed to the unclean surfaces of the mat, such negligence can easily lead to an infection. Other than the unsafe, filthy conditions of the gym, they closed due to flooding on numerous occasions without any adjustments made to my payments. Over the course of six months I made several attempts to speak to the manager; my concerns and my attempts were unaddressed and unsuccessful. I feel that Rocco Mixed Martial Arts breached the contract that I originally signed and made no efforts to address my concerns.Desired Settlement: I made my payments for the six months while I attempted to have the issues resolved and have six months remaining on my contract. I would just like to be let out of any further commitments that Rocco's Mixed Martial Arts, Inc. feels that I may have to them, as I do not feel that they made any commitment to me.

Review: I signed up with Rocco's on 8/9/13 for martial arts classes. I went there in october and tried to cancel. They kept telling me to keep coming and I would like it. It was hard to cancel. I had no cooperation with trying to quit. I tried to cancel in january and they told me there was a $300.00 charge. I did not see any $300. charge on the contract. I asked them for that back since it was not on the contract. They refused and said I could have 3 mos extra for free. I said no, I wanted the $300.00 back they charged on my credit card since it was not in the contract they had charged me unknowingly. It does not appear legal that a company can charge a fee that is not written on the contract. I would appriciate any help. I would like the $300.00 back they charged on my credit card. thank you.Desired Settlement: $300.00 back on credit card.
