Initial Business Response / [redacted] (1000, 6, 2015/12/15) */ We have looked into this issue and the bills of $and $were in fact paid and all charges for the disconnect notice have been reimbursedThe letters sent are computer generated and are not meant to be a personal threatOur online payment center is eGov and they did not send us a report on November 9th which is when [redacted] paid his bill onlineWe sent out disconnection notices on November 25th and one was sent to this consumer because we did not receive the eGov report from November 9th and had no record of his paymentOn November 30th we received a phone call from him and he told us that he had made online payments and should not have received the disconnection noticeWe then called eGov and requested a report for November 9th and asked why it was not sent originallyThey explained there was an error and sent the reportWe spoke with [redacted] on November 30th and explained to him what happenedWe assured him that there was no pending disconnection and we apologized to himWe have put measures into place to avoid any future errorsAt the end of each week we now go back and make sure that we have received all reports necessary so this will not happen again Initial Consumer Rebuttal / [redacted] (2000, 8, 2015/12/15) */ (The consumer indicated he/she ACCEPTED the response from the business.) The District has received your correspondence from Mr. *** and we have the following comments regarding "Customer's Statement of the Problem."1. The curb that Mr*** is referring to is illustrated in photos labeled and 2. These photos were taken before construction
commenced. The curb, or lack of curb, hasn't changed from the after photos, if anything; the curb is in better condition as shown on photo (after). I have talked with Mr*** in regard to reviewing before and after photos and he declined to view photos and told me that the curb wasn't a big deal after I mentioned the photos.2. In regard to the three sections of foot fencing that were allegedly stolen: First, as indicated on photo number 5, the fencing in Mr***'s yard is on the District's property; therefore, the fencing shouldn't even be encroaching on our property. Second, ***l Contracting consulted with Mr*** in regard to purchasing him new sections of fence, in which he declined. Third, there is no motive to steal this section of fence, as indicated in picture 8, which the District finds very offensive Mr*** would file a written complaint of theft accusations.3. This is the first I have heard of a damaged fire pit. I have included a photo of the alleged damaged fire pit. I have consulted with *** Contracting and they have indicated no damage was done to the fire pit and no work was even in the vicinity of the fire pit.4. We are not sure what tree Mr*** is referrin to; however, if trees are located within our sewer utility easement, they are removed without question. To conclude, the District and our subcontractors take every measure to assure we work with homeowners and restore property back, as close as possible, to the original condition. From my experience with construction projects, I find complaints are more substantiated when the problem occurs and immediately reported, rather than filing a complaint when the work is complete. I had never heard of any issues regarding Mr*** throughout this entire project until the project was complete. Accusations of theft and damage to personal property are items that should've been addresssed, if and whe, they occurred

I am rejecting this response because:
Dear Rock Creek,I understand that you are not in the customer service business, and therefore are unlikely to take any action to this issue I do, however, feel I must respond to the claims and blatant lies that you have responded with I do not personally have any pictures of the damaged curb beforehand, but your pictures show the damage perfectly The third picture you attached shows the giant chunk taken out due to your machinery being parked on it over the months of construction This is where the rainwater runs down the hill and now into my yard The curb looks much better and in one piece in the before picture Here is what I know about the fence: Before this project, I owned three more sections of fence than I do now I don't know if it was stolen, destroyed, etc, but they are no longer in my yard According to my records, the fence was on my property Even if the fence was on your property (which it wasn't), I don't know how legal it is for you to claim them as your own It certainly isn't the right thing to do Also, *** NEVER consulted with me about purchasing new fencing. The fire pit is made of decorative and expensive stones Before the project, the stone were all new Now at least four of the stones are cracked and broken in half The tree was removed without question Poor communication if nothing else, and a waste of purchasing that tree.When I brought these issue up with ***, they told me they would restore everything to original condition, including the specified items After a few weeks went by, I called *** about this issues Their response was, "Rock Creek already signed off on it, there is nothing we can do."I have attached a before picture of the fence and firepit Notice how there are three more sections of fencing, and the firepit is in presitine condition.

We sent out disconnection notices on November 25th and one was sent to this consumer because we did not receive the eGov report from November 9th and had no record of his payment. We then called eGov and requested a report for November 9th and asked why it was not sent originally. They explained there was an error and sent the report. We spoke with [redacted] on November 30th and explained to him what happened. We assured him that there was no pending disconnection and we apologized to him. We have put measures into place to avoid any future errors. At the end of each week we now go back and make sure that we have received all reports necessary so this will not happen again.
