I am rejecting this response because:I don't believe we are able to see this concern in the same perspectiveI am attaching the contract and my letter originally sent to Rock Solid and in an attachment sent to Revdex.comI can only go over my same concerns from the letter and it doesn't seem to be received by you with understandingI don't want to repeat the details and continue this dialog that is not moving at all.This complaint is not resolved. Yes, I did get the letter you sent a day after my last response (which was the same as was submitted to Revdex.com)Thank you for sending itThank you for also removing the bathtub which you mentionedIt was part of the original landscape and used as a planterYou agreed to remove it as part of the $10,I paid for your work

In response to Ms. [redacted]'s response:Paragraph #1..I have sent her a letter, as she requested in the 1 week time frame she requestedParagraph #2.... All underground lines not marked by Gopher One must be located by the homeowner is in our contract, as stated before. Eric told her we cut a line, it was the cable line. We did not know  we had cut any other line. Rock Solid is certainly not in the business of causing harm and /or damage to our customers property intentionally. If we were, this would be a regular exercise for me. This is our first Revdex.com compliant in regards to the landscape installation EVER! Paragraph #3..... We are professionals and that is why we have never had a complaint. We just don't have x-ray vision that would allow us to see what is buried in the ground. As a side note, we also found a bathtub buried in Ms, [redacted]'s yard as we were doing the dig out, which we disposed of for free for Ms. [redacted]Paragraph #4...Ms. [redacted] states that my statement of her having knowledge is FALSE. Why would you not tell someone if you had knowledge? Is Ms. [redacted] saying if she knew we were going to cut her wire she would have known where they were?. Again Rock Solid is not in the business of causing harm to our customers property.Paragraph #5-7...Rock Solid was not notified for 15 days after the final inspection and payment was made (a lot can happen in 15 days).  Rock Solid did respond to Ms [redacted]'s request for a response in writing directly to her in the 1 week time frame she requested.As I have stated many times in this back and forth process. This was an unfortunate circumstance which could have been prevented if we would have know about the wires. But that is simply not the case. We did not know and Ms [redacted] did not know! We ALWAYS hand dig around wires for the safety of my employees!!

In response to the complaint filed, Rock Solid Landscape & Irrigation would like to convey our position on the matter and to reiterate the fact that our our signed contract from Ms [redacted] clearly states that the homeowner is responsible for anything buried in the lawn that is not located by...

Gopher One Call. (Contract Attached)On May 25th 2016 Ms [redacted] signed a contract with us to install a paver brick patio behind her house, as well as various other items such as landscape edging, plants, boulders and mulch. The work was scheduled to begin 6/22/2016. On June 15th, prior to starting the work, Gopher One Call was contacted to mark the utilities at Ms [redacted] address, [redacted] Andover, MN 55304. Our installation crew started the work on 6/21/2016, per approval from Ms [redacted]. There were no utility markings in the area of excavation. The area where the paver brick patio was to be installed was excavated to 9.5" down from the existing grade to allow for our base material.We were notified by Ms [redacted] later in that day that her internet was not working. After we were notifed we began looking around the excavated area and it was determined that a cable had been cut. (Again, not properly marked by the utility company) The cable company was notified and the line was repaired.The landscape was completed on 6/24/2016 and upon customers satisfaction, the final payment was made on that date.On 7/15/2016 (15 days after the work was completed) Rock Solid was notified by Ms [redacted] that she was having issues with her septic system backing up, and she determined that an electrical line running out to the septic system had beed disrupted somewhere, and since a new patio was installed it was assumed by the spetic company that we had cut the wire.We had no knowledge of any electrical line being cut, or any markings or notification from Ms [redacted] to indicate there were line running through her back yard. Since we only excavated 9.5" of soil, it seemed unlikely that we would have cut any electrical lines. ( code is 18" buried in conduit). Upon further review by an electrician, we were notified by Ms [redacted] that there was a cut line near the patio.This is a very unfortunate circumstance, but in no way the fault of Rock Solid. The homeowner states that she had no knowledge of these lines. It seems quite unreasonable and unrealistic for an outside party to know what is buried on their propertyThis is why we have in our contract for the homeowner to notify us of any potential lines buried on there property, not marked  the utility companies.
