At the time that Ms***’s business line of credit was originated, she signed an authorization for automatic loan payment form which included the following verbiage: “I hereby authorize Rockland Trust Company to automatically charge the Checking or Savings Account listed above for my monthly installment, commercial or mortgage loan paymentI agree to the assessment of an Overdraft Charge for any failed attempt to deduct the amount of my monthly loan payment from my Rockland Trust Company checking or savings account pursuant to this Authorization, due to an insufficient or uncollected available balance in my Rockland Trust Company checking or savings accountI understand that Rockland Trust Company may make multiple attempts to successfully debit the amount of my designated monthly loan payment.” The account from which Ms [redacted] authorized this automatic payment was from her personal checking accountMs [redacted] missed both her December and January payments, and Rockland Trust did not debit her checking account until the grace periods for both December and January had expiredAt this time, Ms***’s personal checking account is currently overdrawn and payment is due immediatelyRockland Trust considers this matter to be closed, and will not respond to any further inquiries received from Ms [redacted] through the Revdex.com

On August 10, 2016, correspondence with *** *** indicated that he was still using a general contractor to manage his project, though he was trying set up an agreement with his contractor that would allow him to manage the majority of the projectHe was informed prior to this that
Rockland Trust does not allow the borrower to be their own general contractor, and that if he wanted to proceed in this manner, an exception would have to be grantedAs he still had a general contractor at the time, his appraisal inspection was ordered on August 18thOn August 22nd, *** *** informed Rockland Trust that his plans with his general contractor were not going as he expected, and he would be managing the project himselfRockland Trust attempted to cancel the appraisal on 8/23, but was unable to, as it had already taken placeA copy of this appraisal was mailed to *** *** on August 25thOnce the mortgage application was declined, *** *** was informed that Rockland Trust would release the appraisal certification and the original appraisal to a new lender if he so requested.*** *** paid for an appraisal that was conductedHe has also received a copy of the appraisal and the mortgage lending team has offered to release the appraisal certification to a new lender at his requestAs such, Rockland Trust will not refund the appraisal feeRockland Trust considers this matter closed, and will not respond to further correspondence regarding it through the Revdex.com

available in the checking account was applied to the delinquent amount on the business line of creditMs*** stated she mailed December and January paymentThose payments have not been received as of February 5, Rockland Trust spoke with Ms*** on January 29th in which she promised to pay all three payments before February 5thNo payments have been madeMs*** has failed to stop her *** payments or deposit funds to cover such preauthorized agreements, therefore has incurred overdraft fees as a result of non-sufficient funds

Hello, Ms*** has rejected our response, however, she has not provided a reason as to whyAs previously stated, there have been no fees charged by Rockland Trust on Ms***'s accountBank staff have attempted to contact her by phone, but the information on file is outdatedWe cannot use the phone number supplied to the Revdex.com, as we must take proper security measures to identify Ms*** confirm the accuracy of her contact informationOnce again, Ms*** is strongly encouraged to visit the Rockland Trust branch in ***, or to contact our Customer Information Center by phone at *** for additional assistanceRockland Trust will not continue correspondence with Ms*** through the Revdex.com website, and considers this complaint closed Thank you

My account became overdrawn owing to Rockland's irresponsible behavior regarding proper due process. MAGL Chapter 167B, SS states: "Where a preauthorized electronic fund transfer from the consumer's account varies in amount from the previous transfer relating to the same authorization or the preauthorized amount,the financial institution or the designated payee shall mail or deliver at least ten days before the scheduled transfer date, a written notice of the amount and scheduled date of transferIf the financial or designated payee informs the consumer of the right to receive notice of all varying transfers, the consumer may elect to receive notice only when a transfer does not fall within a specified range of amounts or, alternatively, only when a transfer differs from the most recent transfer by more than an agreed-upon amount."This refers to electronic banking in general, there are laws regarding debt collectors as wellAs I indicated, debtors have to follow due process, because there would be chaos if every debtor freely reached into a consumer's account whenever and for however much they want.

The communication on 8/10 was clearly that I did not have a contractor but that I was attempting to proceed in that direction.  Below is the exact e-mail sent on 8/10 to RTC.  [redacted].  No where in the reply is it an affirmation that I had a general contractor, only that I was attempting to work around the issue.  The very next e-mail to [redacted] is provided in the 2nd response and it clearly states that the discussions with the GC fell through. Hi [redacted],  Thank you for the help.  I also have a meeting with [redacted] of Cayting construction.  He provided one of the quotes that I gave  to you.  He and I may be able to work out a sharing arrangement whereby he is the GC but I get more decisions in the process.  If you’d like to wait until Monday to have your discussion?  I think you said you were on vacation.  My question to you would be this.  If [redacted] is the GC and I happen to hire separately with a kitchen design and installation company  does the bank only pay [redacted] or can I submit a voucher for a payment to the 3rd company.
 Hi [redacted],  Unfortunately my conversations with [redacted] didn’t go as well as I had hoped. We are back to our original plan and I will be managing the project.  As you requested I have attached our 401K quarterly statements.     Regards,

Rockland Trust has no right to willy-nilly deduct from my account without proper due process. What would happen if all creditors can reach into people's accounts and deduct what they believe they are owed? There is nothing on the authorization form that states Rockland Trust has the right to disregard due process in collecting.
