I am rejecting this response because: I have proof there was no rigorous sanding and that there were no other painters hired to do the job Rockwell was contracted for. I have a sample board painted with the original dark brown paint with the paint I provided that was partially painted by [redacted] Sr. of Rockwell. If they refuse to refund the money I paid them I am prepared to sue in small claims court for the amount I paid ($450.00) pus treble damages under the Texas DTPA statute for a total of $1800.00 plus court costs.

customers. I learned, while on the job, that we were the third painting company to be hired for the same work. We were hired to paint windows and door frames for the house, and completed three rooms, which included 10 window frames, 3 closets and 3 door frames. After we were assured that all rooms were clear, we removed debris from each closet, which included tools and refuse from other jobs being done by the customer and other contractors. We did not agree to work over the weekend, as there were several other contractors at the house, and I advised the customer that dust and debris from their work was getting into the paint, and that we would need to come back when there were no other contractors working nearby. The customer assured us that there would be no other contractors at the house on Monday morning, which was not the case. I have pictures of debris and tools from contractors around the house after my crew and I masked the house for the paint job. Regarding the paint type, the customer admitted that he had no idea or evidence as to what paint was used on the house, but thought it was not oil-based. Due to the color, which was a reddish-brown, and the look of the paint already on the trim, we suspected that the paint used was oil-based, and a type meant for outdoor use. After rigorous sanding and cleaning, the paint the customer provided did not bond with the previous coat of paint enough to cover the original paint color. Sanding should have opened the pores enough for the new paint to cover entirely after two coats. Painting is typically the final job completed on a house after all other contract work is finished. This is due to the sensitive nature of drying paint, which will pick up any dust or other particles. When we returned Monday morning, carpenters were still cutting wood in the house, another contractor was working on the tile in the bathrooms, and other various contractors were working throughout the house. At this point, I informed The customer that we would not be able to complete his job, and that we would consider the work we already completed, three full rooms, as being paid with the $450 The customer paid at the start of the job. The total cost of labor for the hours Rockwell Painting Company put into the customer’s house was $760 at the hourly rate of each worker, which means the customer received a considerable discount off of the 36 hours of labor performed. After informing the customer, in person, that we would not be able to complete the job, we had no further contact with him, and received no phone calls, voice messages, or any other form of contact aside from a complaint to [redacted] and to the Revdex.com. We respectfully submit that the customer provided misinformation, which hampered our ability to complete the work for which he contracted us, and will offer no refund or compensation at this time. Interest on the house is not incumbent upon our completion of the work.Cordially,Rockwell Painting Company
