The customer rented a John Deere 550 bulldozer.  This machine is designed to clear brush and push dirt.  It has an enclosed cab along with a protective roll cage so that the glass and operator can be protected while clearing brush.  The machine is not designed to...

be run with the doors opened.  There are latches located on the sides and you can open the roll cage only and latch to the side of the tractor.  However, when you do this the door is to remain shut but the glass will be exposed to limbs if the customer chooses to open the roll cage.  In this situation, the customer rented the machine on a Tuesday and had his Uncle operating the bulldozer.  On Friday the customer called and claimed the latch broke and the door flew into a tree limb causing window to break.  Upon questioning, the customer said the operator had opened the door and roll cage together when the weather got pretty to run the machine.  Now as I said earlier, these machines are not designed to be run with the door open for safety purposes.  The machine also has cab and air conditioning so there is no need to open the door due to heat.  The air conditioning was working properly.  The customer claimed that his operator was dozing down a steep hill and the door flew shut and hit a limb because of the latch.  However, on Thursday when his Uncle ran the dozer he had the door open and latched and the door never flew shut.  It appears that the window and latch were broken when the operator was dozing down hill and hit a limb.  If the operator would have had the door and roll cage shut, which is how the dozer is intended to be used, then the damages would not have occurred.  As for the lights on the dozer, that was never spoken of until he filed this complaint.  The bulldozer is not intended to be used at night for safety purposes.  The customer continued to use the dozer with the broken windshield therefore he was never down for an extended period of time.  I have tried to be fair with the customer by only charging him for the glass window.  I did not charge him for the installation of the window, the service call out to the machine, the dented roll cage, or the latch in an effort to please the customer.
