Complaint: [redacted] I am rejecting this response because: They are not telling the truth based on the evidence in the document that I attached to the complaintI was also told by Ken that the horse was sound when I picked him up, and he is not soundThey are not telling the truth about the pictures either, the ones they posted were the ones that they posted from the last seller, not new ones that I was paying for which was advertised as suchThey didn't stand behind the horse and get him sound like Ken said he would more than onceI also have a statement from Ken himself stating that the horse looks good, but the horse was groomed for who knows how long and his mane was a tangled messHe was also not risen three times a week due to the fact the horse was in pasture and un groomedThe untruthful comments/actions need to stop before they cheat another person out of $10,People need to know about their untrustworthy business and they way they use profanity to try and belittle clients Regards, [redacted] ***

I don't know what was said between yourself and Ken, the horse wasn't at my place, nor have I ever even met you in person or been there for any conversation you did or did not have with himI've never had a cross or unpolite conversation with youYou are contacting me through this site which is fine, but you are referencing conversations with another party (yes, he is my business partner) but I was not there to witness nor address any comments between the two of youYou had a right to a pre purchase agreement which you did not exercise, per the conversations you've had with Ken, the issue was a poor farrier in your areaAgain, It's hard for me to respond as all the communications you are referencing did not involve me not was I present at any of themThe horse was advertised, I am sorry you didn't see or couldn't locate all the ads on **Not every horse is listed in every ad or post, but the albums are sharedIt should also be noted, that until recently I was using only my personal account, then due to *** requirments I had to change to only using my business page, as it was being considered spamSo all albums were deleted from my personal page, and since you and I were never "friend" on there, you also may have missed seeing the ads from that page, which is the page that's been used solely for the last yrs for my businessAnd when I was told the horse was going home, I removed all ads, which is my standard practiceHad you inquired through me as to the status of the ads, prior to removing the horse, I'd have gladly forwarded them to you, but I never heard from youIn fact I did try calling you several times, left you a messageBut that was only recently after you removed the horseI had all but no communication with you that you were unhappy with anything prior to removing the horseI am still happy to chat with you, you obviously have my number, but again, my trying to respond to communications that took place between two people when I wasn't even present, is not realistic nor accurate

If he wasn't sound when you bought him, why did you buy him him? And why did you send me photos of you riding and roping on him and how much you liked him, and that your kids rode him months after you bought himIncluding messages saying you wanted to buy another horse from us You bought him, your farrier ruined his feet with incorrect trimming, as you've stated in earlier notesWhich I understand isn't your fault, nor is it oursHorses feet grow at an average of 1/inch a month, some less, some more, less in cold weather months (winter) and horses hooves are an average of 4-inches longTherefore for corrective trimming to work after a farrier has incorrectly trimmed them, you must re-grow a hoof, so at 1/inch average growth a month (and your horse may grow slower or faster, different climate and weather conditions and the horses own structure impact that), that means it takes between 12-months to grow a new hoof

because: They are not telling the truth based on the evidence in the document that I attached to the complaint. I was also told by Ken that the horse was sound when I picked him up, and he is not sound. They are not telling the truth about the pictures either, the ones they posted were the ones that they posted from the last seller, not new ones that I was paying for which was advertised as such. They didn't stand behind the horse and get him sound like Ken said he would more than once. I also have a statement from Ken himself stating that the horse looks good, but the horse was groomed for who knows how long and his mane was a tangled mess. He was also not risen three times a week due to the fact the horse was in pasture and un groomed. The untruthful comments/actions need to stop before they cheat another person out of $10,000. People need to know about their untrustworthy business and they way they use profanity to try and belittle clients.

Please find attached some additional documents to review regarding this case. Jennifer B[redacted]ID [redacted] To whom it may concern, This gentlemen bought this horse the first of June 2015, He came and rode the horse in person. The horse had no health or soundness issues. The buyer has a contract that stated he waived a vet pre purchase exam and took the horse in "as is condition", as stated in the contract. The next communication from him was in August and September, 3+ months after he purchased the horse (during which time he should have shod the horse, as they are usually shod by a farrier every 6-8 weeks), stating he loved the horse, he sent me photos of him riding and roping on the horse, never said anything about him being lame or injured. He even sent me a follow up email asking to buy another horse from me, at the time I didn't have anything that would work for what he wanted. I didn't hear form him until December (I believe) stating the horse was lame and that he couldn't find a farrier (horse shoer) good enough to trim him and that his farrier trimmed him poorly. He brought the horse back to be sold. We told him we had to wait for his feet to grow out and at 1/4 inch average growth a month (less in cold weather) and an average horse hoof being 4-5 inches long, that takes 162-20 months, it doesn't happen overnight, similar to pulling off your own fingernail, there is nothing you can do to make it grow faster. If you chop it off, nature has to take it's course and some peoples nails grow fast, others slow, same with horses. We did advertise him, and I explained to buyers that his feet had to grow out. He was advertised online, and on my page, When I pull an album down, when a horse leaves, that removes all the shares on [redacted]. The situation at it's most simple, is that he bought a horse, he liked and rode for several months, had no issues until December, when his farrier trimmed his feet too short and wrong and now unfortunately he's left for "nature" to take over and his feet to grow at whatever rate they naturally do. [redacted] has admitted that his farrier didn't trim him right and that he doesn't know any other good farriers in the area. I am sure there are other farriers in his area that could help him, or he could haul the horse to a nearby one and I did offer to try to help him find one. I empathize with his situation, however, he bought the horse "as is", he rode and liked the horse not only on site but for months after he took him home, enough to send me messages and want to buy another horse from us. Then a bad farrier trims his horse too short and suddenly he's upset with us, we didn't suggest that farrier, we don't know that farrier and we can't make his feet grow any faster then they do normally. This is a situation for his horses hooves that takes time and obviously another farrier would be in the horses best interest, even if it involved finding one who travelled, as most do go to neighborhing cities. He's not in my area, so I don't have on to suggest, however as I've mentioned before, I am happy to try to help him find one. I feel sorry for the horse, it's unfair that poor farrier skills have left him having to wait for his feet to grow and it's unfortunate that [redacted]'s only reason for not wanting him now, is due to a bad trim job on the horse, when he was so happy with him prior to an outside party causing issues. I feel sorry that he won't see the situation through and help the horse, instead he wants to just get rid of the horse....very disheartening to me.  The horse didn't cause this and neither did myself or my partner. We did our best to market a horse that was sold in good riding condition when he bought him (as evidenced by him riding and buying him and sending us happy updates for months afterwards) and returned to us, with issues caused by a third party that [redacted] hired doing an poor job of trimming the horses feet. As I mentioned on the phone, I had a death in the family and will be out of town, unavailable. I am attaching the copies of the photos and notes he sent on the horse, stating how he liked him and even stating he wanted to buy another horse from us. As well as a copy of the contract.  I am still willing to help and assist him in selling and marketing his horse and will even work with him from his location, I have empathy for the horse, it's not his fault and if I can be of further assistance in helping him locate a qualified farrier in his area to help the situation with the horses feet, I am willing to help with that to be the best of my abilities as well. Thank you for your time and assistance in this matter. Jennifer B[redacted]

I am rejecting this response because: I thought I bought a sound horse as stated by Ken. But it was also stated that you've known the horse for 5 years but had no idea what his name was or is. So how well did you know the horse? It was also stated that the horse was only at your facility for one month, how do you know everything about a horse in one month? You also state that you stand behind your horses you sell, I also have a vet that has seen him and says that he will never be 100%, like stated but your business states otherwise. Reason I bought the horse is because your state that "we fit the horse with the buyer, if it doesn't fit, we won't sell them the horse." If this statement were true, then why did Ken make the statement when I returned the horse that the horse is too much for me. He also said that I needed lessons and couldn't ruin the horse when I bought him. If he knew it wasn't a fit, why did he sell him to me? That goes against your ads you post on [redacted]. I put my kids on the horse and he bucked them off as stated in the message I sent you. Also I did like the horse when I got him because I rode him almost everyday, there are times I started to not ride him everyday and that's when I started having issues. Which I was told by Ken when I bought him that this horse would be the same if rode every day or once a month, which I found out was untrue. You guys both knew that it was a long time since I rode and needed a horse that would take care of me till I get the hang again, and be able to teach me how to rope. If you knew this, why was I asked if I wanted to rope steers when I showed up? Yes I was in search of another horse in which I did contact you about, which was the time in which I wasn't having issues with the horse. As stated I was expecting you to stand behind your horses and act professional and do your job. I turn I paid a lot of money for nothing. This horse was not taken care of at your facility like stated. I have pictures of the horse the day I picked him up. If Ken stated that the horse looks better I expect the horse to look good, he was a total mess. No wonder people didn't want to buy him and no wonder no new pictures that I paid for were ever taken. It shows that my money was going to something else and not my horse.
