Review: [redacted] took rock off of our land in golden valley county. We have a rock query there. This was 08/09/12. He has made two payments of $250.00 (01/28/13) and (06/14/13). I have to constantly ask for payment and he always says "the check is in the mail". On the date of the last payment we met in person and he apologized that he has been bad with making payments so he wrote on the invoice that he would pay 10% interest each month from 09/01/12. He was the one that suggested this on his own accord. The rock is flagstone 3/4" to 3inches and then slabs as well. The original bill was $1,255.20. He has paid $500.00 thus far. It could be argued that he took a lot more rock than is on the invoice but there is no way to prove this. I would just like to get payment on the rock he admits to having on his lot on 3rd ave and main street and then be done with him.Desired Settlement: I would like the money my brother and I are owed. This has been owed since 08/09/12

I'm responding to a complaint filed by [redacted]. I will respond on each point of concern.

Took is an interesting way to describe an verbal agreement in which I would attempt to market and sell rock owned by Ms. [redacted] and her brother. I did make two payments. I would have paid for all the rock if I would have had the money to do so. Paying for rock by me is difficult unless I can sell the rock and pay the seller.

I have to constantly ask for payment and he always says "the check is in the mail".

I have never used the term the check is in the mail. These discussions for payment were either in person or in texting. See texting emailed to Revdex.com 3-17-14.

I didn't use the word bad, more like unable to pay because of slow sales. I did agree to paying interest on the amount of 1255.20 purchase agreement [redacted]. I do not have a copy of the invoice I made the interest statement on. I intended to make a payment each month if I could. I would like to add here that to my knowledge the stone on the [redacted] Ranch was quarried by someone else and I haven't been able to verify if in fact she even owns it still. There has been no stone shipped from this ranch in quite sometime that I know of and had I not purchased the rock it would still be setting in the grass next to the rest of it. I purchased sample rock of the size and shape that would be the most costly as well as most difficult to establish a market for. I've purchased equipment and tools to process the rock and therefore my shortage of money at this time again due to poor sales.

This is where I'm very concerned. This is a slanderous statement. I'm very disturbed by the threats she has made to turn me in for stealing if she wasn't paid.

I guess she needs to put up evidence or be quite about taking rock without her knowledge. The rock is in view of a relatives home south of the stockpiles and they know when people are in the area. When you take slabs of rock or pallets of rock the grass is dead beneath and very easy to tell for sometime that there has been a removal of said rock, not to mention tire tracks in the soft soil would be noticeable as well. I was looking for stone one day and visited 3 stockpiles I have of similar stone looking for stone to fill a specific order I had. I didn't intend to end up at her place but when I decided to go I sent an message to her which failed to deliver because of no cell service. I did have equipment with me capable of loading and hauling stone, however there was no stone I was looking for available. I was on the [redacted] Ranch on foot however my equipment stayed on the truck and the truck stayed on a road east of [redacted] Ranch which I had permission to travel when needed. She was aware that I had been there because of her relative to the south.

I would just like to get payment on the rock he admits to having on his lot on 3rd ave and main street and then be done with him.

Complaint Background:

I would too like to resolve this also as I have enough to deal with I don't need to be accused of being dishonest. Cash poor yes, a thief is a whole different matter and it bothers me that [redacted] would think this of me. I follow the Bible as my guide to doing business and serving other people. I could quote the verses I live by and anyone who knows me will agree I love to spread the Gospel message.

I will pay her as soon as I am able.

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me. Once again he states that he is going to pay what is owed- that is all we want. This has gone on since 08/09/12. In any business we have been more than reasonable. So please pay in full. Saying and doing are two different things.
