In response to the complaint manydetails were omittedWhen any person or couple applies to work with RockyMountain Surrogacy, LLC they sign an agreement I which the retainer fee is non-refundable. We have chosen in the past to refund this feewhen no possible carrier could be foundThis was
not the case for Ms***. Ms*** had stated on her application that she wasworking with the Colorado Center of Reproductive Medicine (CCRM). Later I found out that she was also workingwith another clinic but failed to disclose this. Ms*** was introduced to thefirst potential carrier but she was denied by the Colorado Center ofReproductive Medicine. This fertilityclinic is one of the best in the nation and has the highest expectations fortheir carriersThis can sometimes make it difficult to find a carrier thatmeets their criteria. After the firstcarrier was denied, the second potential carrier was introduced. This second carrier was an experiencedcarrier that had carried a year before. Ms*** and her husband lookedover her profile and then was able to do a Skype video call with thisgestational carrier (GC) and her boyfriendPrior to ever making a formaldecision Ms*** and her husband had been informed that the GC had been seriously dating this person whomthey spoke with via Skype for close to year.As per the clinics requirements both the GC and her partnerwould need to travel to the clinic for medical screening. The GC requested time off of work and went tothe appointment in Denver, Colorado. Atthis screening they were informed that the GC had polyps and would need a DNCto be able to move forward. The only reason for this procedure was toeliminate any interference with later transferring embryos, not out of medical necessity orconcern for the GC’s healthMs*** wanted the GCto immediately schedule this procedure so that her insurance could cover it andthey could continue to move forward as soon as possible. The GCreturned from Denver on a Friday evening and Ms*** asked her on Monday if she could schedulethis procedure that very same dayScheduling this procedure within the time Ms*** demanded wasnot a possibility because of the Gc’s work schedule, her doctorsavailability and records not being available tothem yet. The news that the GC would haveto push the procedure approximately a month inorder to be done within the cycle days required by the fertilityclinic was very upsetting to Ms.***. During this time Ms*** would call RMS multiple times a day and tensionwas growing between the GC and Ms .***. Shortly after the one day work upthe GC was notified that her boyfriend had an Std and they both would need totake antibiotics to move forwardThe GC was shocked and upset with thissurprising newsThis new information would not push the cycle too much furtherbecause they would already be waiting for the procedure to be done. The news of the Std not only upset the GC but Ms***.Some days she would call 30-times a dayIf I did not answer she would emailnumerous times to see when I was availableEmails were expected to be returnedlate at night or even on weekends. Ms.*** explained to me that it was an emergency but at the time there wasnothing anyone could do and in my opinion waiting on a procedure was not anemergency. Finally,Ms *** asked the GC to cancel the procedure less than hoursfrom when it was scheduledThe GC was told she needed to cancel theappointment even though she had already signed paperwork with the hospital andscheduled time off work. The GC expressed herconcerns with rescheduling( due to her ability to get time off during thatparticular month and jeopardizing her employment, her childrens schedules andbirthdays and even informed her she had already canceled her vacation thatmonth because she was worried about having enough time off for doctorsappointments) and her response was simply “Yes well, I cannot afford for thereto be any more delays so…..”The GC’s doctor wasnot pleased with the cancellation since he had already scheduled his patientsaccordingly for the GC to get in as soon as possible. Ms*** later explained thatshe did not trust her GC, she felt she did not care about her body enough sinceher boyfriend had an STD, and that I should begin looking for another carrierbut keep the current GC on standby just in case we could not find areplacement. It was shortly after that the GCsent an email to Ms*** notifying her that she did not want to continue thesurrogacy arrangement based on the way Ms*** treated herMs*** did notrespect her family, her availability to take time off of work, or the fact thatthis GC was willing to carry Ms.***’ child. Following this email Ms***and I had a phone conversation with her explaining how extremely disappointedshe was and how she no longer wanted to retain RMS as her surrogacy agencyShewas extremely rude during the conversationTo show her that I wascompassionate of the problems that were endured I offered to refund her half ofthe retainer fee. I fully intend to refund the partial retainer fee but feelit is important that it is known that Ms*** and I had multiple phoneconversations and numerous email correspondenceAny time there was a limitedresponse was when it was a weekend or when I was travelingReceiving 30-40phone calls a day was very disturbing behavior especially on weekends, lateevenings or early mornings. Although these carriers will later becompensated for their time they are not just servants and both the GC andtheir families should be treatedwith compassion and respect
