I had signed the lease on 16th Feb'20 for moving in date @ 20th Mar'20. This is pre-Corona, with Corona onset and the related developments to shelter in place got implemented by CA Governor on 19th Mar'20 couldn't get any movers n packers ( I don't have a car). I had been in discussion prior to that with Rodak team *** who is updated on the key challenges prior to move in date ( 11th Mar'20 onwards)). At same time the risk of going out, my office had asked us to work from home from 11th Mar'20 which is continuing till date.

Based on mutual agreement with *** have extended my stay in current property ( they agreed without any charges). What I noticed was Rodak website started charging me the rent from 20th Mar'20 with penalty fees. I followed up with *** asking to push the dates to post Shelter in place move in i.e. May'20.

As Shelter in place has been implemented from 19th Mar'20 ( a day before my occupancy and *** wasn't available for formalities and keys hence the 1st Apr'20 was *** O recommend date to come to office to close the formalities. She never came to office on 1st Apr'20 as agreed nr she called. At the same time picked my phone since. Post that the Shelter in place has extended to May 1st week.

I have been in constant communication ( has sent the mails to every alternate days to *** and been calling all available numbers) without any response till date i.e. 14th Apr'20 hence raised the maintenance request today through my login id.

Today I'm totally disheartened to hear your cold thoughts "You are liable for all past and future charges on your ledger under the terms of your lease".... And insisting me to terminate the agreement and the deposit would be forfeited and the other charges till date would be waived off. I have bound to send mail asking for termination mail as I was asked to do so.

I believe this is not an considerate decision and feeling helpless. I have not opted out of the property just

Desired Outcome

Refund I am interested tot stay at the property and only request is to support in unprecedented time and help in making my move in date to 1st July'20. I would have returned by that time.

signed a lease with our company on 02/19/2020. The term of the lease was 3/20/2020-03/19/2021. *** refused to pay rent and move in to the apartment and wanted it held for him until July 1, 2020. He states the shelter in place did not allow him to move, but moving to and from residences has never been restricted at the county or state level. We mutually terminated the lease .

Here's the correspondence we have from the signed lease termination *** and our company both signed:

"1.1 PARTIES AND OCCUPANTS
This document is an Addendum and is part of the Rental/Lease Agreement, dated 3/20/2020
between Rodak Properties (Landlord) and *** (Resident) for the premises
located at ***.
1.2 TERMINATION TERMS
Tenant and Landlord mutually agree that the tenancy at the premises is terminated effective as
of: Thursday April 30, 2020 at 12:01am
Tenant has a past due balance of *** - resulting from April 2020 rent of *** and March
2020 prorated rent of *** Your security deposit will be applied to any past due rent which
remains unpaid.
The parties agree that tenant must peaceably vacate the premises and remove all of their
personal property on or before the date indicated above. If you fail to quit and deliver
possession, legal proceedings will be instituted against you to obtain possession and such
proceedings could result in a judgment against you which may include attorneys' fees and court
costs as allowed by law, plus the Landlord may recover an additional punitive award of six
hundred dollars *** in accordance with California law for such unlawful detention.
This Termination relieves you of payment of any financial obligation for rent owed from May 1,
2020 on, under the original terms of the lease."

The tenant was also not charged a re-letting fee for terminating the lease. This tenants case was CLOSED on April 30, 2020. Thank you, I've attached a copy of the signed mutual termination of tenancy.
