Below is a copy of the email that followed our walk through with Mrs*** on 2/16/ It addressed the issues that she presented to us at that time and it is a reiteration of what we all agreed upon on that day.She is now requesting additional work to be completed that is not in the scope of our contractWe seem to be at an impasse since she will not accept what we are offering as a resolution Attached emailHi ***,The following is per our meeting on Monday 02/16/with myself and *** to review your concerns:Upon reviewing all the items you stated at the time of our walk through we will address the items below that you were concerned about and which we agreed to.* Caulk perimeter of upstairs bathroom for grout joint with grout caulking to match grout for uniform appearance* Repair gaps in base board and crown moldings visible at the time of walk through and paint as needed* Clean paint off of hardwood areas on 2nd floor* Caulk, fill, sand, and paint stair treads and risers (color of choice) as agreed upon at time of walk through* Touch up paint on either side of hall bath vanity as agreed upon at time of walk throughPlease note that all of the items we reviewed were cosmetic and NOT structural Heat being turned on and change of seasons will cause products to expand and contract Also, all items were performed per out contract.Please inform us as to when we will be able to address the issues listed and confirm what color you wish t paint to stairs prior to scheduling your appointmentThank you***I feel we responded and DID offer a solution which she agreed to on that day and then changed her mind the next day
1. Our company did NOT contract with Ms. [redacted] for a "whole house remodel". We performed work on her bulkhead, removed cased openings on the front wall and added engineered LVL headers to replace an existing 2" x 4" header on a bearing wall, installed (1) window, some finish trim, painting,...
and some hardwood flooring on the first floor.2. The "cracks" that the home owner has mentioned are cosmetic on some trim work, on a pre-existing door and at certain sections of the house due to expansion and contraction due to a forced hot air system. 3. Per our contract we were to REPAIR the existing stair treads WITHOUT removing them. The cracking is due to shrinkage of caulked areas.4. Per our contract we did not install any kitchen cabinetry we only painted the existing cabinets.5. The beam that holds up that Ms. [redacted] stated is cracking is a steel beam and therefor the beam is NOT cracking. The cracks she sees is the pine that the beam is wrapped in which was existing and NOT part of our contract. There is some cosmetic separation at the caulking where the beam and the sheet rock meet.6. The cracked window was never mentioned to us prior to this complaint7. The water stains on the ceiling area are due to flashing and/or ice dams on her roof. Per our contract NO roofing was completed by us.8. As for her concern about the house not being structurally sound and an investigation being complete, a permit was pulled on this project and on December 3rd 2014 the building official inspected AND signed off on her project.9. Her complaint about the owner not wanting to speak with her and the manager not wanting to resolve her concerns is false. Our manager made several attempts to meet with Mrs. [redacted] at her project to no avail. Finally, both the owner and the project manager met her at her project on 2/16/15 at 4:00 pm. Her concerns were addressed and upon leaving her home we had all agreed on how to proceed with repairing her issues. On the next day an email was sent to Mrs. [redacted] to reiterate the items and how they were to be addressed as agreed upon at the time of the meeting.10. Mrs. [redacted] in turn sent an email requesting other items be completed that were not in the scope of our work or what we had agreed to do. Hence the complaint.11. We are surely aware of how to work on old houses since it's been part of my business for over 20 years, and have in fact done work for the [redacted]. Mrs. [redacted]'s house is now more structurally sound in the areas we addressed than when she purchased it. This home seems to have been a summer cottage that over the years seems to have been converted by inexperienced people to a year round residence.In closing, we performed ALL the work we stated in our contract and had it inspected and signed off by a building official. In my opinion we went above and beyond
