November 11, To whom it may concern, My name is [redacted] and I am the sole owner or Roe Gordon Construction in North Richland Hills, TexasI have been in the home remodeling business since 1980, working mostly in N.ETarrant CountyI am writing this letter in response to the ridiculous complaint letter that [redacted] wrote to you in reference to a contract dispute we are in the middle of at this timeMr [redacted] is easily the most unreasonable person I have ever metI read the complaint and I don’t know if its insurance issues or my hand drawn plans or what he is complaining aboutI have a Contract with Mr [redacted] to build an addition on his home in Keller, TexasI got the permits necessary and purchased the materials to do the job and on October 9th, I emailed Mr [redacted] and reminded him that this was the week that we had scheduled to deliver materials and start constructionMr [redacted] emails back that no materials or anyone affiliated with [redacted] Construction are allowed on his property and stopped construction on the project! Mr [redacted] threatened to call the Keller Police if any materials were deliveredNobody knows the real reason why, but [redacted] is in definite breach of contractMr [redacted] is a liar and I have hired attorney Ryan Sellers to represent me in a breach of contract and libel defamation lawsuit against [redacted] ***I have attached the last emails between Mr [redacted] and myself for you to reviewIt is very clear that I am doing everything possible to try and keep the project on schedule and appease Mr***Nothing I did was going to make Mr [redacted] happyHe’s not a happy person! I am rejecting this response because: Mr *** is lying about doing the work and still won't do the workI have tried to compromise and negotiate with him but still today refuses to do the work and threatened to unload all the materials in my yard and driveway until we resolve this issueI told him not to do that and until this is resolved, he is not allowed on my propertyI hired an attorney to resolve this and still since July of I have not been able to speak to one single person at his company*** refuses to answer his phone or meet and he refuses to resolve this issueI will include some emails here showing how he will not do the work unless I sign some surprise contracts with his sub-contractors that he never told me about until after I made a large $15,deposit in his bank and that aren't mentioned in the original contract of months agoThey couldn't even pick up the check or let me take it to their office, I had to deposit it in their bank accountMr *** didn't get permits secured until after this large deposit, didn't order any materials until after this deposit, contracted a framer that he knew wouldn't do the work unless I signed a separate contract with him and gave him a $non-refundable deposit after he knew I wouldn't sign any new surprise contractsIt is real easy to see what is happening here and he is trying to force me into signing additional contracts that have never been spoken about until 3+ months after signing our original contract and he had about $23,of mineHere are some of the emails here:

This is in response to the fact that he will not start the work without additional contracts signed by me with all his sub contractorsIt also has to do with the fact that he wrote me that he requires ALL his sub-contractors to carry insurance, since he said he doesn'tThis has to do with now him still requiring more contracts never verbalized to me in the first months of discussion and now wanting to used un-insured contractors for his non-licensed tradesmenI told him they need to have insurance and that our contract doesn't state anything about having to sign additional contracts with sub-contractors and that it is not to do that
He also said on Oct that he was ready to start on Oct,but here is an email I received from him on Oct 2, 2017:
Hi ***,
I am sorry but the first weekend in October is not going to workSince you have chosen not to sign Mr***’s contract, he has decided not to do the framing and demo work on your jobTherefore, Mr*** is trying to line up another demo and framing crew but everyone he has spoken to is backed up and has many jobs lined up resulting in a delay to get things started on your jobMr*** and his father have had a very good business relationship with Mr*** for many years and they do a very good job so we are hopeful that you will reconsider and sign the contracts necessaryI paid Mr*** his standard ten percent to schedule a startup date for his demo and framing crews and they will be ready to start in the second week of October should you agree to signing the demo and framing contract
Please keep in mind the electrician is also going to require a contract signed by you and Mrs*** before he disconnects the wires in your service panelWe also need to get Mrs***’s signature on the *** Proposal/Contract for our records as well
I have all the roof and floor trusses as well as all of the framing materials purchased and set up for deliveryThe only thing that I have left to purchase is the tongue and groove subfloor
Prices on building materials are going up every dayVendors and distributors say they have never seen anything like itPlywood/OSB/ framing lumber and sheetrock are up 15-30% over the last monthsFraming materials for your job were $2,higher on 9-then on 6-Since I am just now paying the invoices, I am just now able to see the price differencesI will be sending you a change order for those differences
I have paid for the dumpster as required by the CityI paid Mr*** his second payment for engineering and redrawing the second story floor design for the second timeWhen you decided not utilize the existing lamb beam located in the attic, the engineer had to trash his original floor design and come back out to remeasure and start over from the beginning
I just received your latest email from today and I will get with Mr*** on that and get back with you in a timely manner

This is an email telling me they won't do the work unless I sign additional contracts that are not provided for in our original contract (see attachment)
Nowhere does it state that these contracts will be required so I am not holding up anything; they are and are trying to force me to sign these contractsThey originally said they do this with all their clients and that it is for my protection and then later say it is to guarantee paymentI asked them if the sub-contractors all have insurance and *** puts a year construction warranty on their work then who are they trying to protect me from? My contract is with ***, not the sub-contractors and I have been happy and willing on many occasions to prove funding, which I have plenty, with no response
There are many many examples of *** delaying the processThe long and short of it still remains that he won't do the work unless I sign additional contracts with his sub-contractorsHe said he could find uninsured sub-contractors to do the work but that I would still have to sign additional contracts with his licensed tradeI will not do that since he promised his sub-contractors would be insured and because our contract states nothing about additional sub-contractor contactsI have found no one in the trade, banking, insurance businesses I've spoken to that was familiar with this practice he proclaims to have all his clients signHe fails to mention anything about them in the 4-months total of conversations; only after he has a bunch of my money and can try to bully me into signingWhat, did he forget about this incredibly important step all his clients have to do for 4-months? I doubt it highly; I think it was planned
This is the most dishonest form of business, especially since he went on this spending spree only after he had all this money, then surprising me with the news of these new contracts that are not provided for in our original contractThat *** will not pick up a phone or meet to resolve this and resort to calling me names, the architect names that I can't repeat here shows that he has the issuesHe did some things wrong in the beginning and I helped him solve some of these problems, that he couldn't get a simple hand drawn elevation done for months is surprising, especially since I paid for an architect to do it not him but he couldn't get along with him, acknowledges in October that he has to get his office staff to stop dragging their feet and get some job information to me, doesn't get the permits secured until September 6th, after my 3rd and largest deposit on September 5th, shows he is in no hurryThat he didn't order trusses until mid September and had to re-measure about September 12th, instead of July like he told me shows he has delayed thisThat he did all the spending after he knew I wouldn't sign these additional surprise contracts shows his character and shows that he is trying to bully and force me to sign these contractsThat he said in July that he has $in personal time (hours I'm told) invested in the project and won't give back any of it if I cancel and he will sue me to hold to the contract, even though the contract states that he waived his contractor feesThe original contractor fee waived was $(shown on the original contract) and yet he had not filed for permits yet, hadn't complete a correct set of drawings yet and hadn't spent any of the $I gave him at that point shows that he was trying to bully me all along the way and make up stuff since it would be virtually impossible to have that much time invested in a project without even completing a very simple set of exterior elevation drawings that he promised over and over againHow can he have more time/money invested at that early stage in the project without completing anything and having not even started construction than what he says the entire would have? not possible!
I feel ripped off but have still been trying to get him to do the work, but he refuses to this dayHe keeps saying he will but refuses to do so without these additional contractsSince September he has never said he would use all insured contractors as promised, so I can't let him start until he does what the contract says and what his written communications have saidAs I said there is still a lot more that he has done that I have not listed but will be happy to if you need to know more

To whom it may concern: My name is [redacted] and I am the proud owner/operator of Roe Gordon Construction, located in North Richland Hills, Texas. I have been working as a builder/general contractor, serving North East Tarrant County for over thirty-seven years. I am writing today in response to the recent letter you received from [redacted] After reading his letter I have come to realize that not only is he a total control freak, [redacted] is also an absolute liar! The truth and facts are as follows. [redacted] hired my company to do a three-room addition onto his home in Keller, Texas in April. Mr. [redacted] proved to be difficult to work with from the beginning constantly exerting his control and opinions. Mr. [redacted] is by far the most unreasonable client I have ever had the misfortune of working with and I totally understand why the previous general contractors and engineers [redacted] attempted to hire elected not to work for him. After two months passed, [redacted] finally signed the contract in early June. Mrs. [redacted] still has not signed the contract. Funds were not made available by Mr. [redacted] to purchase materials until four months later. According to the contract, a thirty percent deposit was required to start the job.  Over the next few months [redacted] payed very little money towards the startup deposit. His latest payment was two thousand dollars back in June. Mr. [redacted] was obviously having money issues. Then, on September sixth, out of the blue, [redacted] personally walked into my bank and deposited fifteen thousand into my construction account. He was in an absolute panic to hurry up and pay for the materials for his job in order to lock in current prices. Apparently, Mr. [redacted] had heard that the cost of building materials would be increasing drastically because of the supply and demand from the recent hurricanes. What he heard was true. [redacted] then informed my office that the money was to be used to purchase building materials and secure building permits, etc. The girls in the office followed Mr. [redacted]’s instructions to a T. Some of the materials were special orders, such as the floor and roof trusses and can only be used on [redacted]’s addition. I also got all the documents necessary from the structural engineers and the third-party energy consultants and after completing the extensive plan review process, I was notified by the City of Keller that my permits were approved and ready for me to pick up. My office then emailed Mr. [redacted] and informed him that that the original startup date that we had agreed upon, for the second week in October was going to work out fine. Everything was lined up to start… right on schedule! My office then emailed [redacted] and informed him that all the trusses and framing materials were being delivered to his address on Monday and Tuesday and the dumpster and demo crew were coming on Wednesday. Framers were scheduled to start on Thursday. Our plan was to have it ready for the roofers to put on shingles Friday afternoon. Then, for some uncalled-for reason… Mr. [redacted] went berserk! He called and emailed and made it clear to everyone involved that he did not want [redacted] or any Roe Gordon Construction subcontractors coming onto his property or any materials delivered onto his property. He warned that he would not hesitate to call the police if we did not comply to his demands. My office and attorney answered back to Mr. [redacted] and let him know that was not a problem and I have not contacted him since. Mr. [redacted]’s reason for breaching the contract and stopping construction on the addition is ridiculous!! All of a sudden, he wants proof of insurance on all workers coming onto his property. As I explained to Mr. [redacted] back in April, only the electricians, plumbers, HVAC and concrete contractors are required to carry liability insurance. Mr. [redacted] knew this well before contract was signed. Mr. [redacted] then has the audacity to ask for a full refund, when he knows good and well that the money he deposited to purchase materials with, has already been spent on his project. At his request, I might add. I have hired an attorney to deal with [redacted]. Personally, I think [redacted] needs to get some professional help. [redacted] wouldn’t know the truth, if it walked up and slapped him in the face!Unreasonable does not even begin to describe [redacted] has no reason to be posting negative reviews against my company and I ask that you not assist him on his obvious mission to try and ruin my company’s good name. My attorney, [redacted] and I will be happy to go through arbitration to keep this frivolous complaint from being posted about my company.  Thank you for your understanding in this matter.
