Consumer entered into contract with Company in January of this year to assist with possible foreclosure of her home. Company was paid $600 and has since requested an additional $400. However, Company has provided no documents or updates.

Dear Ms.:

I am confused by the complaint that you filed with the Revdex.com. With respect to my fee, yes, you have paid my office a total fee of $600. As per the written fee agreement that you signed, the total attorney fee that I quoted you to prepare, file, and represent you on a Chapter 13 was $3,000 with $800 up front on my retainer. The court costs was $310. Thus, I was still owed $200 on my retainer plus the $310 in court costs. As I indicated to you when we last spoke on May 16, 2019, I am not willing to offer you a refund due to the fact that the $600 was earned in full pursuant to my written fee agreement. Extensive time and labor has already been put into your case. I said as much to you over the phone on May 16, 2019, and reiterated that in my withdrawal letter that was mailed to you with your documentation on that same day. A copy of that letter is attached hereto. Hench, I am confused by your complaint with the Revdex.com whereby you indicated that no documents or updates have been provided. The documents were returned. Nor do I understand why you are requesting an update on your case if you do not intend to proceed with my office?

With respect to your reference to my request for an additional $400, yes, we did discuss that, but in the context of your not filing a Chapter 13 but a Chapter 7 bankruptcy case instead. In that event, I explained that my fee would not be $3,000, but rather a flat fee of $1,000 plus an additional $335 to cover the Chapter 7 filing fee. Furthermore, I explained that I was willing to give you a full credit by applying the $600 paid to date for the Chapter 13 toward that $1,000 with the additional $335 filing fee being due on top of that. that would have left a balance of $400 on my fee, but you indicated that you wished to terminate my services.

In your complaint it states that you are seeking updated information and documentation. There is no demand for a refund so my presumption is you are not even requesting one. I can provide an itemized accounting of the partial retainer that you if so required.

As previously stated, your documents were returned to you on May 16, 2019, and I do not have any additional updates for you due to the fact that I have now marked your file as being closed. If I misunderstood you or if you have changed your mind and do wish to continue with my office then I will require an additional $400 should you decide to file a Chapter 7 bankruptcy case. As I explained to you during our last conversation, that was my legal recommendation. It still is. I will also need an additional $335 to cover the filing fee plus more congeniality and cooperation with my office.
