Complaint: [redacted] I am rejecting this response because:This is a lieI have already discussed this with RPM and his attorneyNot once have they admitted the fact I cancelled the consignment on the phone in February BEFORE THE SALE, nor have they even mentioned they had my address, my alternate phone number, my alternate address to contact me onTheir information is incorrect Sincerely, Richard S***

Complaint: [redacted] I am rejecting this response because: I will repeat myself again..Because Bailey failed to properly water test the boat ,water leaks were not discovered and therefore I was sold a almost brand new boat with hours on it that leaked through the transducer plate from the first launch of this boat in OctoberI have verification that the plate was not installed properly from the marina that is doing the warranty work..they will find the other problem with the hull after water testing properly!! I did not take the boat back to Bailey as he failed to issue me the transfer warranties for the boat and motor at time of sale of which I had no such knowledge of..He failed to install a transducer plate properly that caused one of the leaks of which I discovered in the first minutes after launching in October,Bailey could care less about customer care manners and has lied to me on many fronts on this issueI have documented emails and texts from him saying boat was water tested and there are no leaks..I have witnesses that can prove otherwiseThey owe me compensation for time off work and trips to california to have warranty work performed I find that Bailey is not competent of repairing this boat due to his past performanceI am the Victim here and it has cost me a lot of money in trip charges and time off work and it will cost me months at the least of missing prime fishing here in ArizonaBoat is in California Bailey will never see me or the boat again unless I find Kit R [redacted] the original owner and get a different story...This other leak could be a manufacturers defect but had the boat been tested properly these leaks would have been found by Bailey before the boat was sold..I am anxious to find out the issue with the other leak and how fast they found the problem..Bailey owes me for all the grief he has put me through[redacted] Sincerely, [redacted]

This customer did put his Alumacraft Fisherman boat, W.Cmfg boat trailer, and Yamaha 25hp engine on consignment with Roger's Performance Marine on November 22, We sold the boat in February Customer provided us a phone number to contact him and address on consignment sheetRogers Performance Marine called numerous times to the number provided the voice mail on the phone said it was his phone we left messagesWe sent letters and certified letters out and were returned to Rogers Performance MarineWhen he did he did contact Rogers Performance Marine he never once told us his number had changed or his address had changed according to what he had written down on our consignment sheetWe attempted to contact customer in March about the sale and needed titles We never spoke to him in February he never returned our calls from voicemails leftAnd nothing was mentioned about taking it off of consignmentHe sent our store an email regarding the status of his boatNow that we had a way of communicating with him we notified him that his boat had sold in FebruaryCustomer was very upset and would not speak to us via phoneWe stated that we had sent him certified mails and left voicemails (which we have record of) notifying him we needed titlesHe then stated his phone was no longer working and no letters were sentCustomer did send us titles but however they were not signedWe contacted him via phone and email and he kept stating he wanted the boat back as it had been sold to a customer we could not do what he requestedHe never requested the boat to be taken off consignment and Utah law on consignments states there has to be a written notice from the customer and the collateral has to be picked up from consignorThe customer then contacted the Utah State Motor Vehicle Enforcement DivisionThey did come and question Rogers Performance Marine saw our records of, phone calls, letters, and emailsThey said that there was no charges to be pressed against Rogers Performance Marine that the customer did not provide correct contact informationThe MVED officer also stated that the customer was within the lines of doing communications fraud and could be chargedAfter this Rogers Performance Marine hired an attorney and communicated with the customer through emailEventually the customer did send a power of attorney to Roger's Performance MarineWe feel like we did exactly what we could do provided the information provided from the customer

We have done all we can as a business to try and make this work for the customer, and he simply refuses to be workableWe have acknowledged that there may be a water leak with a boat, and we assured the customer we would address the problem as soon as the boat returns to our facilityWe were willing to drop everything we had going the second he shows up to address the issueHowever, we cannot do anything to help the customer if he is not willing to be able to be helpedAlso, the previous owner traded the boat in because he enjoyed the boat so much, he wanted to upgrade to ANOTHER LundNot one thing was said to us from the first customer about a leak at any point in time, and with a brand new boat to him under warranty, I'm certain he would've said something if there was an issueAs for the transducer, when we thought that might be the cause for the leak, we IMMEDIATELY sent out a marine silicone to fix it*** said that the silicone fixed nothing, telling us that it was not a faulty mounted transducerWhatever the case is for the leak, we are more than happy, and more than capable to fix the issue in a timely manor. However, until the boat returns to us, we have no control over the situation lastly, Bailey has many times admitted his wrong doing for the warranty papers and other issues, as well as personally apologized to *** for the inconveniences he is having, and *** even accepted the apologiesIt was only when we denied compensation for travel when *** decided we were incompetent and unworthy of his business Thank you

First and foremost, this was purchased as a USED boat, with no implied warranty directly from our dealershipThis being said, there is still transferable manufacture warranties on both boat and motor, we were sure to make our customer aware of the option, but there was never an
agreement made to pay the fee's to make the transferAs for the issues the boat may be having, we have always been willing and ready to help this customer, just like we would any customerWe have already tried sending supplies (at no charge) to our customer to try and fix the issue, as well as offering the best diagnostics we could without having the boat in our possessionNone of which are we required to do, however we want the customer to enjoy this boat so we have tried to do what we can given that his location is a bit of a hurdle to over comeIt seems as though the distance between our customer and our dealership is one of the bigger problems we are dealing withWe did not force him to come this far, we did not promise transportation of vessel in the event of warranty issues, all we did was offer our customer a boat that fit his needs, at a price that fit his budgetWe did all we could to ensure that the boat was in working order before it left our shop, and it was the customers choice to take it after he did his visual inspection on the boatEverything the customer had concerns with before the boat left was addressedWe ran the boat for him, we walked him through all functionalities of the boat, we gave him all the time he wanted to inspect the used boat, and we even gave him money off the already agreed purchase price to replace the tires when we returned home because he felt they had been slightly worn downAll things being considered, we have apologized to the customer multiple times for the inconvenience he may have to go through to get the warranty done, and we have also assured him, the second the boat returns to our dealership we will gladly get a technician on the boat to diagnose any issues it may have and get them addressed in a timely manor We are not required to travel to retrieve the boat, nor are we required to compensate time and travel to have warranty work done, but we are willing to take care of it when we can get our hands on itUntil then, we cannot do anything for else for this customer.We are simply abiding by LUNDS warranty policy in the owners manual that states the customer is to return the boat to an authorized LUND dealer for warranty work to be done
